Payment & Cancellation - 30 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 30 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 30 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 30 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 30 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 30 days before arrival: 100% refund.
House rules
- Wailea Point’s House Rules support the spirit of Aloha in our Maui paradise. They promote safety and welfare and a quality of life free of nuisance and unreasonable disturbance. They also help preserve Wailea Point’s architectural integrity. Some of the House Rules are truly Rules – they must be adhered to – and some are reminders to act with courtesy and common sense.
- If you see a violation of the House Rules and if you’re comfortable approaching the individual or group to remind them of the Rule, please do so politely. Attempt to have constructive conversations with neighbors about issues that concern you. If you prefer not to take the personal approach or if it’s not appropriate for the situation, please report it to Security by phone (Security contact number shown within the unit), or in person at the Kiosk or to any Security person you see on the property. If the violation occurs on common elements, feel free to take a cell phone photo or video to record the incident to help Security respond appropriately. And always – call 911 if immediate safety is at risk.
- In case of conflict, the House Rules are superseded by Hawaii Condo Law 514B, Code of the County of Maui, and Wailea Point’s Declaration and Bylaws.
- To provide feedback about House Rules or anything else regarding our community, please contact the office or a member of the Board of Directors. Acting together, we make Wailea Point an Aloha community.
- Definitions
- Accompanied Owner’s Guest – Owner’s overnight guest who stays at Wailea Point while the Owner is in residence. See B-2 for rights and restrictions.
- Accompanied Renter’s Guest – Renter’s overnight guest who stays at Wailea Point while the Renter is in residence. See B-2 for rights and restrictions.
- Common Areas/Elements – pools, spas, pavilions, sports courts, lawns, or any other part of Wailea Point property that is not part of the Owner’s unit.
- Day Visitor – A visitor who does not stay overnight at Wailea Point. See B-2 for rights and restrictions.
- Family – Owner’s or Renter’s spouse/domestic partner, parents, children and their spouses/domestic partners, and grandchildren, except those excluded in writing by the Owner or Renter. See Sections B-3 and B-5 for rights and restrictions.
- Renter – An individual who leases/rents a unit and who is listed as a Resident on page one of the Property Management Information Form (PMIF). The resident’s spouse/partner is also defined as a Renter. See B-5 for rights and restrictions.
- Resident – a person who is staying overnight at Wailea Point. See B-1 for rights and restrictions.
- Unaccompanied Owner’s Guest – Owner’s overnight guest who stays at Wailea Point while the Owner is not in residence. See B-1 for rights and restrictions.
- Unit – A Wailea Point apartment.
- Documents
- All documents cited in the House Rules may be found on the website or Office staff can provide a hard copy or a digital copy.
- A. General Rules
- A-1 Every person who enters Wailea Point must obey posted signs, House Rules, the Association's Bylaws and its Declaration.
- A-2 Owners are responsible for the conduct of anyone they permit or invite into Wailea Point.
- A-3 At the request of the General Manager, an Owner must immediately correct any condition that is contrary to the signs, rules, or laws. Regarding any Guest(s) or Renter(s) who refuse to conduct themselves accordingly, the Owner shall immediately set in process, and follow through with, the eviction and/or removal of such individual from Wailea Point.
- A-4 The General Manager and/or Board of Directors may assess fines for violations. See Section O.
- A-5 “All residents and guests must exercise extreme care to avoid making noises in the use of musical instruments, television, and amplifiers that may disturb occupants.” (Bylaws V3(i)). This applies equally to cell phones/smart devices, computers, game consoles, sound systems, and other personal electronic devices. Residents and Guests must be especially careful when using electronic devices, such as cell phones, on lanais and in common areas.
- A-6 Quiet Time must be observed from 10 p.m. to 8 a.m. except that sport courts may be used starting at 7 a.m. Residents must make every reasonable and practicable effort to prevent noise that can be heard outside the unit by reducing volume or using headsets or earbuds during Quiet Time.
- A-7 Smoking outside a unit or a unit’s lanai is not allowed except on the Four Seasons (north) side of Wailea Point’s main road, extending from below the Office to across the street from the Makai Pavilion and in front of and behind the Boat Garages. Cigarettes and matches must be disposed of properly, not discarded on the ground.
- A-8 No unsightliness in the public view is permitted, including but not limited to the following: hanging laundry; outside litter or trash containers except as provided by the Association; inappropriate, broken or damaged furniture or dead plants on lanais; or automobiles with substantial body damage, ill-fitting, torn or damaged vehicle covers.
- A-9 Recreational use of drones is not allowed for the sake of the privacy and security of the residents. All of Wailea is a recreational drone-free zone.
- B. Residents, Guests, Owners, and Renters
- B-1 All Residents (anyone staying overnight)
- a. All Residents have access to the lawn areas, fitness center, pavilions, pools, spas, and sports courts.
- b. Whenever practicable, a Resident must submit a Property Management Information Form (PMIF) at least 48 hours in advance of the arrival of anyone who will stay overnight in the unit.
- c. A Resident must notify the Kiosk in person or by phone of the name and approximate arrival time of any Day Visitor or service appointment with anyone who is not listed on the Owner’s Entry Authorization Form.
- d. All Residents must notify the Kiosk prior to or at the time of their departure, even if leaving for only one night. This aids Security in their watch over vacant units.
- B-2 Guests
- a. To enter Wailea Point, an Unaccompanied Owner’s Guest must show the Kiosk an acknowledged PMIF or a government-issued photo ID that matches the name on the PMIF.
- b. Residents’ accompanied and unaccompanied overnight guests have access to the lawn areas, fitness center, pavilions, pools, spas, and sports courts.
- c. Day Visitors:
- i. Are not allowed to use the fitness center.
- ii. Must be accompanied by a Resident to use the pools, spas, pavilions, and sports courts.
- iii. Must depart the property promptly when the visit is concluded.
- B-3 Owners
- a. Time-sharing ownership is not allowed. See WP Declaration 7.D. for expanded definition.
- b. Each Owner must submit an updated Owner Information Sheet to the Office within 10 days of any change to the information on the form.
- c. Owners must maintain their units in good and sanitary condition, free of water leakage, insects, vermin, mold, and any other condition that creates reasonable concern that it would spread to or otherwise damage or affect adjacent units or the common elements. If damage to another unit or the common elements results due to such a situation, the Owner is responsible for the remediation costs.
- d. If a unit will be vacant more than 7 consecutive days, the Owner is responsible for assuring that the water valve to the unit is turned off.
- e. Returning Owners, please notify the Office of your arrival plans by phone, email, or PMIF at least 48 hours in advance so that you may be informed of inconveniences such as work going on in the building or nearby, and to provide time to trim shrubs/lawn, and to prevent construction vehicles from blocking access to your garage upon arrival.
- f. When a unit will be vacant for more than thirty (30) days, Owners are encouraged to have a local representative to conduct periodic inspections of the unit.
- g. Trading the use of a unit for other services or for use of another property constitutes renting and is subject to House Rules regarding rentals.
- h. An Owner’s Family (see Definition) has the right to access the lawn areas, fitness center, pavilions, pools, spas, and sports courts whether or not the Owner is residing at Wailea Point. Unless they are specifically listed on an Owner’s Entry Authorization Form, the Owner must notify the Kiosk before Family members arrive.
- i. An Owner may exclude any family member from access to the rights defined above or from access to the Owner’s unit by submitting a signed note to the Office.
- j. Owners may reserve the Amenity Suite in accordance with the restrictions in Rule I-5.
- B-4 Owners who Rent
- a. An Owner must notify the Office that a unit is going into rental status and provide the name of the rental agent or the rental website, if there is one.
- b. Upon request, an Owner must promptly provide the office a copy of a signed lease agreement.
- c. An Owner may rent or lease the entire unit, and only its entirety, for residential purposes only.
- i. Effective with the Amendment to the Restatement of the Declaration recorded on October 18, 2022 (“Rental Term Amendment”) an Owner may rent the unit for a minimum of three hundred sixty-five (365) consecutive days and only once per 365-day period. (WP Declaration 7.A as amended).
- ii. For a period ending on December 31, 2024, an Owner who rented their unit prior to the recordation of the Rental Term Amendment, and who has the required GET and TAT certifications, may continue to rent their unit for a minimum of thirty (30) consecutive days and only once per 30-day period; provided, however, that if the unit is transferred to another Owner through sale, estate, corporate or trust ownership prior to the expiration of this period, the unit shall be subject to the minimum term specified in B-4 (c)(i).
- iii. In the event the County of Maui approves a rezoning of Wailea Point Village from Hotel to Apartment or otherwise passes rules or regulations that impose minimum rental terms greater than those provided in B-4(c)(ii), the Owner must comply with the regulations and requirements set forth by the County of Maui.
- d. No Owner may accept compensation for the use of a unit except under the terms of a lease that complies with the Governing Documents and these Rules.
- e. A rental agreement transfers to the Renter the right to occupy the entire unit and the right to access the lawn areas, fitness center, pavilions, pools, spas, and sports courts even if the Renter does not occupy the unit for the entire duration of the rental agreement.
- f. An Owner who resides off Maui while the unit is rented must designate an agent residing on Maui to act in the Owner’s behalf. (Hawaii Revised Statutes Section 521-43(f)) The Owner must provide the contact information to the Wailea Point Office.
- g. Whenever practicable, at least one week before a rental period begins, a Property Management Information Form (PMIF) signed by the Owner or the Rental Agent must be received by the Office indicating the name(s) of the Renter(s) and any Accompanied Renter’s Guests. Receipt of the PMIF will be promptly acknowledged.
- h. No one, including the Owner, may occupy the unit when the Renter or Renter’s Family is absent and neither the Owner nor the Owner’s Family may use the Common Elements during the rental period.
- B-5 Renters
- a. The Renter named on the PMIF must be the first person to check in at the Office if it is open or at the Kiosk if not and must show an acknowledged copy of the PMIF or a government-issued photo ID which matches the PMIF on file.
- b. Renters and their Guests have the right to use the lawn areas, fitness center, pavilions, pools, spas, and sports courts. Renters may reserve the Pavilions according to the Rules presented in House Rules Section I and on the Activity Reservation form.
- c. Renters may not reserve the Amenity Suite.
- d. Renter’s Family (see Definition) who are residing at Wailea Point or are guests of the Renter may use the lawn areas, fitness center, pavilions, pools, spas, and sports courts.
- e. Only the Renter’s Family and their accompanied Guests may occupy the unit when the Renter is absent.
- C. Pets and Assistance Animals
- C-1 These rules apply to owners’, guests’, and renters’ pets. Owners are legally and financially responsible for the actions of their own pets and for the actions of guests’ or renters’ pets.
- C-2 Each unit may have no more than two pets. (Bylaws Art. V Sec. 3 (n))
- C-3 Pets are prohibited from entering the fitness center, the office, and the gates of the pool areas and pavilions.
- C-4 Pets must be on a leash of no more than 10 feet in length and under full control at all times.
- C-5 Pet owners must immediately dispose of all of their pet’s fecal matter in a proper, legal, and sanitary manner.
- C-6 Any pet causing a nuisance or unreasonable disturbance or displaying aggression to any individual or other pet should be reported to the Office or to Security personnel. Nuisance noise from a dog is defined as unprovoked barking, yelping, or whining incessantly for 10 consecutive minutes or intermittently for 20 minutes (Maui County Code Section 6.04.040.C).
- a. After the first reported infraction, the General Manager will issue a warning to the pet’s owner.
- b. Depending on the seriousness of the offense, repeated infractions may result in fines, escalating fines, and/or the General Manager may issue a notification to the pet’s owner requiring that the pet be removed from the property within 5 days. (Bylaws Art. V Sec. 3 (n))
- C-7 Assistance Animals
- a. Under federal and state law, an individual is disabled if he/she has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment, or is regarded as having such an impairment. Major life activities include, but are not limited to, walking, seeing, hearing, speaking, breathing, thinking, communicating, learning, performing manual tasks, and caring for oneself. (42 U.S.C § 3601 et seq.; Hawaii Revised Statutes Chapter 515)
- b. Notwithstanding anything to the contrary contained in the Declaration, Bylaws or these House Rules, but subject to reasonable restrictions, animals upon which disabled residents depend for assistance shall be permitted to be kept in the units of such persons and shall be allowed throughout the common elements while under the control of the animal’s owner/handler by use of harness, leash, tether, cage, carrier, or other physical control. If the nature of the person’s disability makes physical control impracticable, or if physical control would interfere with the assistance that the animal provides, the animal must be under the control of the animal’s owner/handler by voice control, signals, or other effective means. This shall also apply to animals depended upon by disabled Guests of Residents.
- c. Any person disabled with a not-readily apparent disability requesting a reasonable accommodation to keep an animal in their unit must contact the General Manager.
- D. Security, Gate Access, and Unit Access
- D-1 Residents must notify the Kiosk of the arrival plans of Day Visitors and service appointments who are not listed on the unit’s Entry Authorization Form. See Sections B & C regarding entry of overnight guests.
- D-2 All vehicles entering the property must be registered at the Kiosk.
- D-3 If a vehicle displaying a Wailea Point entry sticker is sold to a non-owner, the entry sticker must be removed prior to the sale.
- D-4 Except in emergencies or to provide services to the Association, contractors may enter the property only after 8:00 a.m. Monday through Friday excluding holidays. They must depart the property by 5:00 p.m.
- D-5 Cleaning service providers are permitted entry after 7:00 a.m. They must depart the property by 7:00 p.m.
- D-6 Patrol and Administrative staff may request identity verification of any person entering or on the property.
- D-7 The General Manager has the right to instruct Patrol personnel to inspect any unit as warranted.
- D-8 Anyone occupying a unit cannot unreasonably deny access through the unit during reasonable hours for routine maintenance, landscaping, painting, or repairs
- D-9 Owners must provide means of entry to their Unaccompanied Owners Guests, Renters, real estate agents, contractors, and regular service providers. An owner may request the Office to provide entry to the unit twice per calendar quarter. For more than that, a Work Order may be written up for this service and the owner invoiced.
- D-10 Wailea Point accepts no responsibility for loss of or damage to items left at the Kiosk or anywhere on the property. Lost and Found is in the Office.
- E. Common Areas
- E-1 Lawn areas may not be used for golf practice.
- E-2 Other activities on the lawn are allowed if they do not endanger common elements or nearby units and do not interfere with the rights, comfort, or convenience of others.
- E-3 Once per calendar year, the Association may schedule a homeowner/guest event on a lawn for a maximum duration of four (4) hours. The event must end by 10:00 pm.
- E-4 Climbing on trees, fences, walls or other common elements is not allowed.
- E-5 Skateboards, roller skates, roller blades and scooters are not allowed.
- E-6 Private golf carts, bicycles, motorcycles, scooters, skateboards, roller skates, roller blades, scooters, etc. are not allowed on the Seawalk.
- E-7 Rubbish must be drained, placed in a securely tied garbage bag, and deposited in a garbage container located in the unit’s garbage area.
- E-8 Please comply with Recycling Guidelines available on the website or from the Office and use the recycle containers located in the unit’s garbage area.
- E-9 Changing the use of a Common Element requires approval by at least 67% of Owners. (Declaration 7.C.(1))
- F. Entrances and Lanais
- F-1 Sidewalks, stairways, entryways and corridors must not be obstructed in any way that impairs access.
- F-2 Small plants, sculptures, benches, and wall hangings are permitted near front doors.
- F-3 Please keep baby strollers, beach gear, and toys inside units or garages or on lanais.
- F-4 Garbage cans, household supplies, trash, or other such articles must not be visible from outside the unit.
- F-5 Attaching anything to window glass that is visible from the outside except shade films is not allowed.
- F-6 Hanging items on outdoor railings, glass wind breaks, or walls not near entry doors is prohibited.
- F-7 Throwing any item or substance from windows or lanais is prohibited.
- F-8 Upper units must not allow water to drip onto the lanais of units below them.
- F-9 Plants must be in containers that prevent water or soil dripping onto other units or onto common elements.
- F-10 Built-in gas grills may be used on lanais provided they are connected to a built-in exhaust fan.
- F-11 Fires, open flames, hibachis and gas/charcoal grills are prohibited inside units, on lanais, and in common areas, except for built-in gas grills (see F-10).
- G. Pools and Spas
- G-1 WARNING
- a. No supervisor or lifeguard is on duty.
- b. Use pools and equipment at your own risk. The Association is not responsible for injuries resulting from use of pools or equipment.
- c. For safety reasons, no one is permitted in the pools unless they are a competent swimmer or are accompanied by a competent swimmer who shall be responsible for their safety.
- G-2 General Requirements
- a. Hawaii State Department of Health requirements are posted at all pools and must be obeyed.
- b. Incontinent individuals, including persons who are not toilet trained, must wear swim diapers or leak-proof attire at all times.
- c. Diaper changing is permitted only in restrooms. Changing stations are available in both restrooms near the Mauka Wading Pool.
- d. Before entering pools and spas, please shower sufficiently to remove sunscreen, dirt, and sand, and please remove hairpins.
- e. Place a towel on chairs and chaise lounges before using.
- f. Public use of audio equipment may be used only during formal exercise classes.
- g. Earbuds or headphones must be used with electronic devices, such as gaming, video, audio etc. No speakers or amplification is allowed.
- h. Food is not allowed within six (6) feet of pools and spas.
- i. Beverages in breakable containers are not allowed in the pool and spa areas. If broken glass enters a pool or spa, the pool must be drained and cleaned resulting in considerable expense and closure for some period of time. The responsible Owner may be billed.
- j. Mattresses or other large flotation devices or toys are not allowed in pools or spas.
- k. Diving, splashing, running or horseplay is not allowed within pool gated areas or pavilions.
- l. Persons having open sores, wounds, or communicable disease are not allowed in the pool.
- m. Please be considerate of others, pick up after yourself, and leave these facilities as you would wish to find them.
- G-3 Makai Pools and Pavilion
- a. These facilities are intended to provide a quiet environment.
- b. Except for Association-sponsored or private events, use of these facilities is limited to activities and conversations that can be heard only near the participating individuals. For lively conversations and activities, please use Mauka Pavilion.
- c. Devices other than exercise equipment, kickboards, personal flotation devices, snorkel masks, and goggles are not allowed in the pool.
- d. Conversations on cell phones/smart devices in the Makai pool or spa areas or pavilion are not allowed. Please silence the ringer.
- G-4 Mauka Pools and Pavilion
- a. These facilities are intended to provide a family-friendly environment.
- b. The lap pool is for exercise only.
- c. At the lap pool and main pool, devices other than exercise equipment, kickboards, personal flotation devices, snorkel masks, and goggles are not allowed.
- d. At the wading pool small, soft inflatable toys are allowed.
- e. Conversations on cell phones/smart devices in the Mauka pool or spa areas or pavilion are allowed if they do not interfere with the rights, comfort, or convenience of others. Calls must be taken outside the pool/pavilion area at anyone’s request.
- H. Fitness Center
- H-1 Day Visitors are not allowed to use the Fitness Center.
- H-2 All persons using the Fitness Center equipment do so at their own risk. Users of the Fitness Center must be able to operate the equipment and utilize the facilities in a safe and appropriate manner.
- H-3 Personal Trainers are allowed provided an Activity Reservation Form has been filed at the office. Personal Trainers must follow the rules for Vendors and Contractors.
- H-4 Proper attire must be worn, including shirts and appropriate athletic footwear. For health and safety reasons, bare feet and flip-flops are not allowed.
- H-5 Please use the provided disinfectant materials to leave the equipment and surrounding areas clean after use.
- H-6 Personal audio equipment, including cell phones and smart devices, are not allowed unless used with headphones or earbuds.
- I. Pavilions and Amenity Suite
- I-1 Moving pavilion furnishings to another area requires the permission of the General Manager.
- I-2 The remote control for the TV in the Mauka Pavilion may be checked out by a Resident at the Kiosk after signing acceptance of the TV Remote Rules.
- I-3 No more than 150 people at a time may be in the Mauka Pavilion main room and 75 in the lower Makai Pavilion.
- I-4 Residents may reserve a pavilion for private events under the following conditions:
- a. A pavilion may not be reserved if the other pavilion is reserved, under repair or renovation, or scheduled to be under repair or renovation on the requested date.
- b. Fundraisers are not allowed.
- c. An Activity Reservation Form must be submitted to the Office at least four days prior to the event so that a notice of reservation can be posted.
- d. For private functions such as presentations, classes, etc., only the Mauka Pavilion may be reserved.
- e. The swimming pools, spas, and fitness center cannot be reserved for private events and are not included in pavilion reservations.
- f. Additional Terms and Conditions are listed on the Activity Reservation Form. Changes to these may only be made by the Board of Directors.
- I-5 The Amenity Suite may be reserved only by Owners. Owners and Residents of the Amenity Suite must abide by the Amenity Suite Rules found on the website and in the Office.
- J. Tennis and Pickleball Courts (rules posted at Tennis Court and Lower Pickleball Court)
- J-1 Courts may be used between 7 a.m. and 10 p.m. Please curb your enthusiasm from
- 7 a.m. to 8 a.m.
- J-2 Unreserved play time is limited to 60 minutes when others are waiting.
- J-3 Appropriate footwear must be worn. Black-soled shoes are not allowed.
- J-4 Profanity and shouting are not allowed. Please respect the peace and privacy of nearby residences.
- J-5 Food is not allowed on the courts. Beverages must be in non-breakable containers.
- J-6 Please place trash and broken balls in nearby trash receptacles.
- J-7 Reservations: Court time may be reserved subject to the following:
- a. One unit may make one pickleball reservation only once every other day. One unit may make one tennis reservation only once every other day.
- b. Courts may be reserved only for their intended purposes. Unreserved courts may be used for other appropriate purposes.
- c. From 7 a.m. to 11 a.m., the tennis court may be reserved for 1 hour except that reservations for 1½ hours for doubles may be made on Sunday, Tuesday, or Thursday.
- d. From 7 a.m. to 11 a.m., the lower pickleball court may be reserved for 1 hour for singles and 2 hours for doubles.
- e. From 7 a.m. to 11 a.m., the upper pickleball court may be reserved for 1 hour only.
- f. Please remove your name if you will not be playing at reserved time.
- g. After 11 a.m., reservations may be made for any length of time.
- h. If the reserving party has not begun play within 10 minutes of the reserved start time, the reservation becomes void.
- i. Switching reservations or partners in order to use the court for consecutive periods is not allowed.
- j. If a violation is observed, please speak to the offending party or take a photo of the reservation problem and inform Patrol in the Kiosk.
- K. Vehicles and Parking
- K-1 Residents are highly encouraged to park in garages to ease parking constraints.
- K-2 Parking is not allowed on blacktop pavement unless authorized by Patrol Staff or the General Manager.
- K-3 Trellised parking areas may be used for cars, trucks, and vans.
- K-4 Trellised parking may be used by golf carts that display a Wailea Point disability sticker.
- K-5 The six spaces in front of the Fitness Center are for short-term parking while using the pavilion, pool, or fitness center.
- K-6 The red brick areas at the upper and lower pools are reserved for golf carts and for cars with state Disability Parking mirror tags or license plates.
- K-7 Garage doors must be kept closed when not in use.
- K-8 Golf carts must be electric-powered and may only be operated by licensed drivers.
- K-9 Covers used on vehicles and golf carts parked outdoors must be of a neutral color, in good condition, and firmly secured to withstand storms and winds throughout the duration of the stay.
- K-10 Vehicles may be washed and polished in the Owner’s driveway and at the designated area near the Landscape Shop in the Boat Garage Area. Boats and other equipment may be cleaned only at the designated area near the Landscape Shop.
- K-11 An Owner, Renter, their guests, and employees may park on the unit’s garage parking pad only if the pad fully accommodates the vehicle without restricting traffic.
- K-12 A resident must direct guests, workers, visitors, etc., to park in trellised parking areas or, if available, on the unit’s garage parking pad if the pad fully accommodates the vehicle without restricting traffic.
- K-13 When parking is severely constrained, such as during Construction Season, the General Manager may direct vehicles to park on an unoccupied unit’s garage parking pad if the pad fully accommodates the vehicle without restricting traffic.
- K-14 If a vehicle is parked inappropriately, it must be moved to an appropriate spot immediately after the vehicle owner or the appropriate WP Owner is notified. If a vehicle is being stored outside for someone other than an Owner or if a vehicle does not have an appropriate pass, the vehicle owner or the appropriate WP Owner must remove the vehicle from the property immediately after notification.
- K-15 When the General Manager deems that overnight parking is seriously constrained, Residents with more than two (2) cars, trucks, or vans parked outside the garage and not on a full garage parking pad will be notified to temporarily but immediately move one or more vehicles to an area of the property that is not so congested.
- L. Employee Services and Relations
- L-1 Requests for Wailea Point maintenance services through the work order program must be submitted to the Office. Service will be provided on a time-available basis.
- L-2 Owners will be billed for a minimum of 30 minutes at the prevailing rate for Wailea Point maintenance services.
- L-3 Tipping Wailea Point employees is not allowed because many deserving employees work behind the scenes. Instead, please give to the Wailea Point Employee Holiday Season Fund, which all employees share.
- L-4 Concerns about individual employees should be directed to the General Manager or to the President of the Board of Directors.
- M. Building Modifications
- M-1 An Owner who wishes to redecorate or remodel their unit must first submit a Remodel Application.
- M-2 Redecorating and remodeling are governed by Wailea Point’s Tiered Construction & Remodeling Approval Program, available on the website or from the Office.
- M-3 Tier 1 projects may occur year-round and require only the General Manager’s approval. Examples include repairing or replacing appliances, plumbing, light fixtures, air conditioning units, interior window treatments, and cleaning carpet, air ducts, and lanai tiles.
- M-4 Tier 2 and higher projects require Board of Directors’ approval and are permitted only from April 1 through October 31, Wailea Point’s construction season.
- M-5 Applications must be submitted in a timely manner. The approval process may take up to 60 days for complex projects or projects requiring extensive review.
- M-6 After project approval, Owners must promptly complete their projects. If construction is not completed within one construction season, during the interim until construction restarts, the under-roof lanai must be enclosed and the unit must appear from the outside as if no construction is underway. If that is not feasible, the Owner must seek a waiver from the Remodel Committee.
- M-7 No wiring, antennae, appliances, or other devices may be installed on the exterior of the building, or protrude through a unit’s wall, windows, or roof, except as permitted by the Board of Directors or in accordance with Federal Communications Commission regulations.
- M-8 Nothing shall be allowed, done, or kept in any unit or common element of Wailea Point which would overload or impair the floors, walls, or roofs of any building, or conflict with and/or negatively affect any Association insurance coverage. (Bylaws Article V, Section 3.(q))
- N. Real Estate Showings
- N-1 Before a unit may be shown to a prospective buyer, the Owner must notify the General Manager of the intent to have the unit shown and provide the listing agent’s name and contact numbers.
- N-2 Only “Registered Agents” may show units at Wailea Point.
- N-3 An agent may register by obtaining a copy of the House Rules from the Office and signing an agreement to abide by them. Re-registration is required whenever new House Rules are issued.
- N-4 Showings must be by appointment only.
- N-5 A Registered Agent or Owner must notify the Kiosk of the name of the interested party(s), appointment time, and unit(s) to be shown.
- N-6 A Registered Agent or Owner must meet the interested party(s) outside the gate and remain with them while they are on the property.
- N-7 Owners must provide their Registered Agent with a means of entry to the unit.
- N-8 Open Houses or social-sales functions such as coffees, teas, or happy hours are not allowed.
- O. Payments, Late Fees, and Fines
- O-1 Wailea Point’s Collection Policy, found on the website, lists payment due dates and sanctions applicable to delinquent payments. It includes:
- a. Monthly Fees – the first of each month. A late fee will apply after the 10th of the month.
- b. Work Order Invoices – within 30 days of date of invoice.
- c. Fines – within 30 days of the date of mailing the notification.
- O-2 Violations will be handled as shown below. Owners are responsible for violations committed by their Guests, Renters, Employees and Contractors. Fines must be paid within 30 days of the date of the fine notice. The General Manager will refer any violation resulting in a written warning or a fine to the Board of Directors, which has the ability to assess different fines and/or restrict rights. Owners may appeal fines within 14 days of the date of the fine notice in writing or email addressed to the President of the Board of Directors and the General Manager.
- a. The first violation of a House Rule, Bylaw, or Declaration will result in a verbal reminder of the Rule.
- b. The second violation of the same Rule will result in a written warning, which must contain:
- i. what rule was violated by whom, when and where;
- ii. that a verbal reminder of the Rule had been previously given, by whom, to whom, when and where;
- iii. that a subsequent violation of the same Rule will result in a $250 fine and that each repeat violation following that will result in a $500 fine;
- iv. and if applicable, that a specified grace period is being granted during which the violation must be corrected to avoid a fine.
- c. The third violation of the same Rule will result in a $250 fine, stated by written notice which must contain the information of O-2.b.i. and O-2.b.ii. and the statement that the next violation will result in a $500 fine, with escalation of fines following that, along with possible rights restrictions.
- O-3 The Board of Directors has approved the following fines:
- a. When an Unaccompanied Owner's Guest is determined to be a Renter – for the first occurrence, $1,000 per day for the duration of the fraudulent occupancy and, for the second occurrence, $1,500 per day for the duration of the fraudulent occupancy. Subsequent violations may incur legal action and/or eviction of occupants.
- b. For executing a time-shared rental lease, a lease of less than 30 consecutive days, or more than one lease within a 30-day period – $1,000 per day for the duration of the lease.
- c. For holding an Open House, broker or realtor coffees, teas, or other social-sales functions – $1,000 per occurrence.
