Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 14 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 14 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 14 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 14 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 14 days before arrival: 100% refund.

- VACATION RENTAL AGREEMENT
- BY: Blackbird Hospitality Management Hereinafter called HOST
- AND: Signee Hereinafter called GUEST
- Witnesses that the HOST rented to the GUEST the premises located at:
- [RENTAL ADDRESS]
- THE PARTIES HERETO, IN CONSIDERATION OF THESE PRESENTS, AGREE THAT:
- 1. MAXIMUM OCCUPANCY: GUEST must accurately disclose occupancy including the number of adults, children and animals that will occupy said rented premises in the booking data provided through the online platform. That determines the maximum occupancy at all times and applies to day visitors and children as well. Unless otherwise approved by your HOST, occupancy over the indicated capacity may result in immediate eviction and forfeiture of amounts paid.
- 2. NO SMOKING or Vaping or illegal drugs of any kind will take place in or on the premises. Violation of this will result in a $500 charge. Vaping or smoking outside with windows and doors closed is accepted. GUEST is liable for the full cost to remove any odor from the home in the case that it exceeds the above charge.
- 3. NO ANIMALS of any description will be kept in or on premises without prior approval by HOST. * Animal Addendum is required with this contract for approval of pets, emotional support or service animals.
- 4. DAMAGE POLICY & INSURANCE– Guests must select either a refundable security deposit or a non-refundable damage waiver. The refundable security deposit will be held for 7 days post check-out and will be refunded provided there are no damages. The damage waiver is recommended.
- There will be no charges in the case that there is no:
- A) damage to property, its contents or furnishings,
- B) dirt, trash or other mess requiring excessive cleaning
- C) There is no negligent damage due to inclement weather. It is GUEST’S responsibility to secure items on premises in the case of inclement weather or outside conditions such as outdoor umbrellas, or any other item that may blow away or be damaged by high winds, or other inclement weather.
- D) any other costs incurred by your Host because of your stay. Any damage to the Vacation Rental or its contents must be reported before check-out.
- E) GUEST is not evicted by the owner (or representative of the owner) or the local law enforcement.
- F) No linens are lost, stained, or damaged.
- G) The unit is left locked and secured when unoccupied.
- To ensure that the proper party is held responsible GUEST must inform management within 24 hours of arrival of any pre-existing damage or issues or may be held responsible for any cost involved in repair to be taken from the security deposit.
- Damage not covered by, or exceeding the coverage limit of, the accidental rental damage insurance, Security Deposit, or booking platform coverage, is your full responsibility. In the case that an insurance claim must be file with homeowner's insurance, the guest is liable to pay the deductible. You grant your HOST the right to be reimbursed via the booking platform or your credit card for any such damages, including, but not limited to, additional cleaning fees. If the booking platform refuses reimbursement, HOST has the right to pursue reimbursement by reasonable means including small claims court and/or police report. HOST does not make a habit of filing claims or requiring reimbursement for small expenses under $50.
- 5. CLEANLINESS– You are expected to treat the entire premises with respect, keeping in mind that this is an individual’s home and you are a house guest. Even if a cleaning fee was charged, you are expected to leave the premises in a clean, neat and orderly condition to allow our cleaners to provide a thorough clean in the very short window between guests. Management must be notified within 24 hours of arrival if unhappy with conditions upon arrival.
- 6. NOISE & QUIET HOURS: Quiet hours are between 10pm and 9am. At all times GUEST must keep noise levels to a minimum as to not disturb the peace and quiet of surrounding neighbors. Noise exceeding local ordinances or causing a neighbor complaint will be grounds for immediate eviction without possibility of a refund.
- 7. PARKING – Maximum number of cars GUEST’s party may bring is displayed on the listing, as well as allowed parking areas.
- 8. LOCK OUT – (For keyless entries) This home is on a keyless entry and your code is active for the duration of your booking. (For both keyless and keyed entries) In the case that the GUESTS lock themselves out of the house and a key is provided, if keys are lost or not returned, the charge is [$150]. We recommend that you always use the keyless entry, and if backup access
- 9. LINENS & SUPPLIES: For details on what is supplied, please refer to the listing at the time of booking. Please do not refer to reviews for this information, as it may not be current or accurate. The GUEST is responsible to inform all individuals in their party to use only septic safe tissue, and no other items will be flushed in the toilet even if it says "flushable". Any damage caused by GUEST to the septic or plumbing system will be the full responsibility of the GUEST. Such damages are often hazmat cleanups and are VERY expensive. These terms are subject to change at the HOST’S discretion.
- 10. REPORTING OF DISSATISFACTION OR NOT AS ADVERTISED: GUEST agrees to report any issues of dissatisfaction to HOST immediately but no later than 24 hours after discovery. GUEST will cooperate with HOST and allow HOST’s team members to come to the property to verify the issue and remedy before making any reports to the booking platform of dissatisfaction. If GUEST declines this, any possibility of a refund will be forfeited. NOTE: Photos are taken of the premises after each cleaning and prior to GUEST check in. These date and time stamped images will be used against claims brought by GUEST as well as the findings of HOST’S agents.
- Any claims made by GUEST that are fraudulent or outrageous in nature or meant to mislead or defraud the HOST, credit card company or payment processor in exchange for a refund or threat of a bad review will be immediate grounds for removal from the premises with no refund and GUEST’S account being reported to the booking platform for removal and is liable for all financial or other damages to HOST.
- If the GUEST reports a false issue or complaint where a technician is called in without any findings of the reported issue, the GUEST will be responsible for covering the entire cost of the technician's invoice.
- FOR RURAL AREAS: The home has monthly external pest treatments, and due to the rural nature, it is normal to find some bugs inside the house.
- If the GUEST's communication or behavior becomes unreasonable, disruptive or harassing toward the HOST, they will be asked to immediately vacate the premises without the possibility of a refund and GUEST agrees to comply.
- 11. REHOUSING – HOST shall not bear financial liability to rehouse or refund GUEST for any amount if unsatisfied or if GUEST chooses to vacate early after HOST has made best efforts to resolve GUEST’S dissatisfaction. GUEST will seek assistance from the booking platform or their travel insurance.
- 12. CANCELLATION: GUEST can cancel at any time regardless of the cancellation policy, but the cancellation policy will be enforced once the booking is under the non-refundable period, regardless of the reason for cancellation.
- We highly recommend you purchase travel insurance to cover any losses or contact the booking platform with any issues.
- 13. GUEST may not lease or sub-lease, nor permit any other persons to occupy premises outside of pre-determined occupancy, except with prior approval of the HOST.
- 14. SECURITY CAMERAS / TECHNOLOGY- There are no interior cameras of any kind. Exterior cameras, video doorbells, keypads, smart home technology, etc. are installed for the safety and protection of the property and its guests and may not be tampered with or disabled. GUEST will be immediately evicted with no return of funds paid upon violation of this policy. We respect our GUEST’S privacy and review footage only upon a report or cause.
- 15. GUEST must keep property locked & secure when not there. Lockbox, keypad or gate code is not to be shared outside of GUEST’S party.
- 16. GUEST agrees to allow the HOST or his/her AGENT to enter and view said premises with proper notification and a light cleaning (no laundry) is required biweekly during extended stays.
- 17. INTERNET USAGE and LIABILITIES An illegal or abusive Internet usage is not allowed. It is not allowed:
- a. To send information and data of a commercial nature and/or for marketing purposes to third parties without requested to do so (spamming)
- b. To use peer-to-peer networks if uploading or downloading of copyright-protected intellectual property with or without the knowledge of the owner is intended; c. to spread and distribute illegal or immoral content and data; and/or d. to use applications which could destroy or change the physical or logical structure of the Host equipment or network.
- In case of non-compliance with the above obligations, or in case of any other illegal action, the GUEST shall be liable for damages. The GUEST indemnifies and holds harmless the HOST from any third-party claims on first demand and in case HOST settles any damages itself for avoiding further damages to compensate the HOST for all damages incurred, (including costs of legal advice and defense).
- The HOST does not guarantee WIFI speed or that their WIFI will be compatible with all of GUEST’S devices or software (including but not inclusive of VPN networks), is not responsible for any damages or inconveniences GUEST sustains while using Internet access with their own Internet devices and will not offer any refunds as a result. HOST is not responsible for any internet outages that are outside of the control of the HOST and will not offer any refunds for such. The renters must have their own spyware/virus protection or data security, etc.
- 18. FALSIFIED RESERVATIONS: If your booking was made under false pretense, including, but not limited to, a falsified name, age, booked for a 3rd party or size of party, or undisclosed animals (including service or emotional support animals) you will be subject to immediate eviction and forfeiture of all amounts paid. There may be exterior cameras that may be used upon the HOST’s discretion to verify the size of your group.
- 19. WRITTEN EXCEPTIONS: Any exceptions to this entire agreement must be approved in writing.
- 20. INCLEMENT WEATHER, UNINHABITABLE or ACT OF GOD POLICY: Should the premises be destroyed by fire or other casualty, extreme weather, pandemic or act of God to become unfit for human habitation or to prevent travel to the property then this agreement shall thereby be ended with NO refund to the GUEST for any rent term unused. Inclement weather preventing travel to or from the property will not be the responsibility of the HOST. We highly recommend you purchase travel insurance to cover any losses in this case or immediately notify Airbnb who will assist you under their guest guarantee. In the case that the HOST is able to recuperate funds from an insurance claim, a refund of rents and fees paid will be returned at the HOST’S discretion.
- 21. INTENT OF THIS LEASE: The rental of these premises is for vacation or recreational purposes only and the GUEST understands this unit is not available for primary or permanent residency. The GUEST certifies that they reside at the address provided on this agreement as their primary place of residence. Even in the case of a reservation of 30 days or more, this agreement falls under lodging law, and the GUEST maintains a primary residence elsewhere and is not protected by state residency or tenant law.
- 22. EVENTS POLICY: The premises may not be used for parties, large gatherings, receptions, weddings, or any type of function which would cause abnormal wear and tear or mess or exceed the maximum number of occupants specified in this lease without written permission. **Evidence of these activities will result in a potential [$1500 ] fine and/or loss of security deposit. At the HOST's discretion, they may choose to grant a written exemption to this events policy, which will not be considered a part of this agreement.
- 23. SIGHT UNSEEN - The HOST has endeavored to depict the property and its amenities as accurately as possible in online advertisements. The GUEST acknowledges that they are renting the property without physically inspecting it beforehand and assume any associated risks. Given the communal nature of vacation rentals and the possibility of other guests occupying the premises, despite diligent upkeep efforts, the HOST cannot assure that the property will be presented by cleaners exactly as depicted in the photos or devoid of signs of regular usage. It is incumbent upon the GUEST to thoroughly review the comprehensive advertisement and policies pertaining to the property.
- 24. BOOKING PLATFORM POLICY: In the case that the booking is processed via a platform such as or similar, all exchanges of funds will be made through these websites according to their terms, unless agreed to by both parties. They are a payment exchange service only, and not a booking agent. All other terms and conditions in this contract supersede and take precedent over any booking platform's terms or conditions.
- 25. HOUSE RULES: The GUEST agrees to adhere to all house rules or instructions issued by the HOST through any means of communication, including but not limited to messages, email correspondence, property listings, welcome books, information books, or any other form of communication received by the GUEST.
- 26. COMMERCIAL / FILMING / PHOTOGRAPHY: No filming or photography is permitted for the purposes of commercial distribution or profit. This agreement is for recreational purposes only. Photos shared on social media must include a tag or credit of the rental property or owner.
- The property may not be used for any events, meetings or any other sort of commercial use without prior approval. Please inquire for details on use of the property for such purposes.
- 27. PINATAS / CONFETTI / GLITTER / FIREWORKS POLICY: No confetti, glitter or pinatas are allowed anywhere on the premises or grounds. No tape or anything else that will mark the walls may be used to hang decorations or for any other reason. No fireworks of any kind, even safe and sane, may be brought or used in or on the premises.
- 28. CHILD SAFETY: The Guest acknowledges that the rental property is not childproofed and understands that they are solely responsible for ensuring child safety during their stay. This includes supervising any children present on the premises and taking appropriate precautions. The Guest further acknowledges that any use of child-related items or equipment within the rental property is at their own risk, and they agree to exercise caution accordingly.
- The Guest agrees to indemnify, defend, and hold harmless the Host, including its agents, representatives, and affiliates, from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees and court costs) arising out of or related to any injuries, accidents, or incidents involving children during the Guest's occupancy.
- 29. MINIMUM RENTAL AGE for the primary guest is 23 years of age at the time of reservation. The party who is on the contract must occupy the subject property for the full duration of the rental lease. Any exceptions to this must be in writing by the HOST. In the case that this contract is executed, and evidence later shows the minimum age requirement was not met, then the reservation will be considered canceled by the GUEST and the cancellation policy will be in effect.
- 30. INDEMNIFICATION & HOLD HARMLESS: The GUEST agrees to indemnify, defend and hold the HOST OR RENTAL MANAGER or CO-HOST of the property harmless for from any and all claims, demands, liabilities, damage, cost or expense whatsoever (including attorney’s fees) arising from or related to any claim in connection with your use and/or occupancy of the Vacation Rental and it’s amenities, including, but not limited to, any claim or liability for personal injury, property damage, wrongful death, accidents, allergic reactions, illnesses or any other casualties or health problems, including viruses, which may arise during tenancy or as a result of said occupancy, loss of personal belongings or theft of property which is made, incurred or sustained by you and/or anyone you invite to use the Vacation Rental as your guest.
- Safety precautions undertaken by HOST are not foolproof, and GUEST shall hold HOST harmless from all claims to person or property arising out of the use and occupancy of the premises.
- 31. POOL / HOT TUB / PLAY STRUCTURE / HAMMOCK:
- a. The GUEST acknowledges that the property may or may not contain a pool and/or hot tub (hereinafter referred to as "Amenities"). The GUEST agrees to use the Amenities at their own risk and accepts full responsibility for their safety, as well as the safety of any accompanying individuals.
- b. The GUEST acknowledges and understands that the use of the Amenities involves inherent risks, including but not limited to drowning, slipping, falling, or sustaining injuries. The GUEST voluntarily assumes all such risks and releases the HOST from all liability arising from the use of the Amenities.
- c. The GUEST agrees to abide by all rules and guidelines provided by the HOST regarding the use of the Amenities. The GUEST shall ensure that all individuals using the Amenities under their supervision also comply with these rules and guidelines.
- d. The GUEST shall exercise reasonable care and caution while using the Amenities. Children and individuals who are not competent swimmers must be always supervised by a responsible adult when in or around the Amenities.
- e. The GUEST agrees to keep the gates, doors, and covers of the Amenities closed and secured when not in use, especially when children are present. The GUEST shall not tamper with or attempt to disable any safety features, equipment, or devices related to the Amenities.
- f. The GUEST agrees to refrain from using the Amenities while under the influence of alcohol, drugs, or any substances that may impair their judgment or physical abilities. The GUEST shall ensure that all individuals using the Amenities under their supervision are also in a fit condition to do so safely.
- g. The GUEST acknowledges that the HOST has not made any representations or warranties regarding the safety or condition of the Amenities. The GUEST accepts the Amenities in their "as-is" condition and agrees that the HOST shall not be held responsible for any defects, malfunctions, or hazards associated with the Amenities.
- h. The GUEST acknowledges that the HOST insurance may not cover any injuries or damages sustained while using the Amenities. The GUEST is encouraged to obtain their own insurance coverage to protect against such risks.
- i. PLAYGROUND / PLAY STRUCTURE / HAMMOCK / SWINGS: The GUEST acknowledges and agrees that any use of these amenities located on the premises is at their own risk. The GUEST assumes full responsibility for the supervision of any children or minors utilizing the amenities during their stay. The HOST shall not be held liable for any injuries, accidents, or incidents that may occur as a result of the use of the amenities. The GUEST agrees to indemnify and hold harmless the HOST from any claims, damages, or liabilities arising from the use of the amenities by themselves, their guests, or any accompanying children or minors.
- 32. LEGAL ACTION: By signing this agreement, the GUEST waives the right to pursue legal action in court and agrees to resolve disputes through arbitration or mediation. The GUEST must first seek any award from the online booking platform, with any additional awards limited to the coverage specified in the host's insurance policies.
- I agree that all rental monies are subject to the cancellation policy above. I have read my rights to
- purchase travel insurance. By signing below, I agree to all terms and conditions of this agreement.
- Animal Addendum to Vacation Rental Agreement
- GUEST desires to keep a certain dog/s described below on the Property and the Vacation Lease Agreement specifically prohibits allowing animals on the property.
- DEFINITIONS: The term “Pet” is used to describe any animal accompanying the GUEST including service and emotional support animals. The Lease Agreement is hereby amended by this Pet Addendum to grant such permission to the GUEST. In exchange for this permission, the GUEST agrees as follows:
- 1. To accurately disclose total number of animals GUEST’s party will bring prior to arrival.
- 2. To pay additional pet rent in the amount of [$75] Dollars [service animal/s excluded]
- 3. To keep the animal/s from causing any annoyance or discomfort to others and to immediately remedy any complaints concerning the animal/s.
- 4. To keep the animal/s from damaging any property belonging to the HOST or others.
- 5. To keep the animal/s off of and/or cover furniture and beds. Floors must be protected from scratches from dog crates. Coverings must be provided by the GUEST. Any animal/s hair found on linens or furniture will result in an extra cleaning fee.
- 6. To leave no evidence of the pet/s upon departure.
- 7. To keep the animal/s under control at all times and abide by [local ordinance] leash laws.
- 8. Not to leave the pet/s unattended for more than 6 hours. Option: animal/s must not be left unattended by GUEST at any time.
- 9. To hold the HOST harmless from all liability, harm or damages, arising from the GUEST's keeping of the animal/s on the premises, including but not limited to any liability resulting from the HOST turning said animal/s over to local pet policing authorities should the animal/s be found unsupervised for more than 6 hours at a time or causing damage or noise disturbance.
- 10. To dispose of the animal/s droppings quickly in a sealed bag and placed in the outside trash bin. No droppings will be left on the ground or brought in to the property.
- 11. To ensure that animal/s will wear the appropriate animal license, a valid rabies tag and tag bearing the owners name and phone number. All licenses and tags must be current.
- 12. To provide the HOST with the following information 30 days prior to arrival: that all vaccinations are current, and proof of flea/tick medication or that the animal/s is/are free from fleas, ticks, or other infestations.
- 13. The GUEST certifies that the animal/s does not display a tendency to be aggressive or harmful and is fully responsible for any such behavior in the case that it occurs on the premises or anywhere during the GUESTS scheduled booking.
- 14. GUEST agrees to control flea infestation and will exterminate if necessary, and upon demand, in all areas affected with full cost to be paid by GUEST.
- 15. GUEST agrees that HOST will not be responsible for the injury, harm, or death of the animal, and agrees to hold HOST harmless for any injury, damages or losses suffered as a result of any harm caused on the animal or by the animal upon another person, guest or employee. GUEST shall be responsible for the entire amount of all damages and/or losses caused by the animal/s as well as the entire amount of any injury to individuals or property.
- I ACCEPT FINANCIAL RESPONSIBILITY FOR THE ENTIRE AMOUNT OF ANY DAMAGES OR INJURY TO PERSONS OR PROPERTY THAT MAY OCCUR BECAUSE OF MY PET.
- RENTAL AGREEMENT AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK
- For the use of amenities such as Kayaks and Paddleboards
- The individual named below (referred to as "I" or "me") desires to participate in the rental or usage (the “Activity”) of an amenity (“Amenity”) provided by Blackbird Hospitality Management, LLC. In consideration of being permitted by the Companies to participate in the Activity and the intangible value that I will gain by participating in the Activity, and in recognition of the companies' reliance hereon, I agree to all the terms and conditions set forth in this instrument (this “Release”).
- 1. Amenity Rentals.
- a. I agree to operate and otherwise use any Amenity I rent responsibly and in accordance with reasonable safety practices.
- b. I agree that I am solely responsible for any harm, injury, or death that I, or anyone I invite to use an Amenity, may suffer as a result of the usage of such Amenity, further agree that I am responsible for any damage or destruction to the real or personal property of any person while I, or anyone I invite, is using the Amenity.
- c. I agree that I am solely responsible for the theft, damage, or destruction of any Amenity I am renting during the period of such rental. I am further aware that any Amenity I rent may be equipped with a GPS tracking device for theft-prevention purposes, and I consent to the usage of such a GPS tracking device in connection with my rental of an Amenity.
- 2. I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANIES OR ANY HOST, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANIES OR THE HOST. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANIES, A HOST, A THIRD-PARTY, OR OTHERWISE.
- 3. I hereby expressly waive and release any and all claims, now known or hereafter known, against the Companies, and its officers, directors, shareholders, employees, agents, affiliates, successors, and assigns (collectively, “Releasees”), on account of injury, disability, death, or property damage arising out of or attributable to the Activity, whether arising out of the ordinary negligence of the Companies, a Host, or any Releasees or otherwise. I covenant not to make or bring any such claim against the Companies or any other Releasee, and forever release and discharge the Companies and all other Releasees from liability under such claims. This waiver and release does not extend to claims or any other liabilities that `law does not permit to be released by agreement.
- 4. I shall defend, indemnify, and hold harmless the Companies and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by the Companies or any other Releasees arising out or resulting from any claim of a third party related to the Activity, including any claim related to my own negligence or the ordinary negligence of the Companies.
- 5. I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless the Companies from any claim based on such treatment or other medical services.
- 6. This Release constitutes the sole and entire agreement of the Companies and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Companies and me and their respective successors and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Michigan without giving effect to any choice or conflict of law provision or rule (whether of the State of Michigan or any other jurisdiction).
