Payment & Cancellation - 60 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 60 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 60 days before arrival: 100% refund.

- ASSOCIATION OF APARTMENT OWNERS OF HONO KAI HOUSE RULES
- The Association of Apartment Owners of Hono Kai has adopted the following House and/or
- Guest Rules to promote harmonious living. Owners and/or Agents are required to deliver the
- House Rules to each Tenant at the time of their occupancy. These rules may be amended by
- the Board of Directors as provided in the Association's By-Laws. Violations of House Rules
- are subject to the attached Fine Schedule. All suggestions and concerns must be directed to

- Owners and Tenants are always responsible for the reasonable decorum of their family members
- and Guests. Parents are responsible for the conduct of their children and shall not allow them to play
- or litter on stairs, lanais, walkways, parking lots, or pool area unattended. Prohibited activities include
- rollerblading, skateboarding, bicycling, and the use of scooters. Owners are responsible to give
- appropriate notice of these house rules, and that they should be understood and agreed to as a
- short-term tenant as they will be enforced with fines that will be the responsibility of the owner.

- The volume and bass levels of radios, TV sets, stereos, musical instruments, etc., shall be kept
- down to avoid disturbing neighbors. All Occupants shall avoid excessive noise of any kind at any
- time and shall consider the welfare of other Occupants of adjacent apartments at all times. Please
- close front doors and windows and turn on air conditioner or fan to limit the noise, especially in the
- evening. QUIET HOURS PREVAIL FROM 10:00 PM TO 8:00 AM DAILY.

- No livestock, poultry, rabbits, or other animals whatsoever shall be allowed or kept in any part of the
- project, except that apartment Owners and the Resident Manager may keep dogs limited to 20
- pounds and under when fully grown. Cats and other household pets may be kept, as long as they do
- not become a nuisance to other Owners. Do not feed the feral cats.

- Textile items, including clothes, towels, etc., shall not be hung on or from the lanai. railings,
- doorways, or windows in such a manner as to be visible from the outside of the building. Lanais are
- to be kept and appointed in an orderly manner that is consistent with the general appearance of all
- other lanais on the property. Do not throw cigarette butts over the lanai as it is an extreme fire
- hazard. No rugs shall be beaten from the lanais or walkways. No dust, rubbish, or litter may be
- swept into the common area. No items shall be stored outside of units.

- All trash shall be placed in dumpsters and trash lids are to be kept closed at all times. Do not
- dispose of household trash in cans by the pool or by the grill area. Bulky items, such as carpets,
- furniture, appliances, and construction materials shall be removed from the Association's property by
- the Owner and not placed in the dumpsters.
- 6
- Barbecuing is allowed only at the BBQ area located next to the pool. The BBQ area is open from
- 9:00 AM until 9:00 PM. In compliance with County Fire Codes, cooking on lanais is prohibited.
- Barbecues shall be cleaned by user after each use.
- 7
- Use or display of fireworks, firecrackers, etc. is not allowed on the Association's property.

- Expenses resulting from damage to buildings and all Association property caused by Owners,
- Tenants, or Guests shall be the responsibility of the Owner.
- 9
- Every apartment Owner is allocated one parking space per unit. Parking is allowed only within line
- spaces. Any additional vehicles must be parked on the street. Working on vehicles on premises is
- prohibited. Vehicles parked on the premises must remain operable or they will be towed. Vehicles
- are to be washed in the designated area only.
- 10
- Laundry hours are from 7:00 AM to 8:00 PM daily. Do not remove iron and ironing board from the
- laundry room. Remove laundry promptly from washers and dryers after completed cycles.
- 11
- Pool hours are from 9:00 AM to 9:00 PM. No more than four guests per unit are allowed to use the
- pool and/or yard facilities without prior approval of the Resident Manager. Observe pool rules and
- pool hours as posted. All persons using the pool do so at their own risk. Owners and Management
- are not responsible for accidents or injuries. No pets are allowed in or around the pool. Before using
- the pool, rinse sand off when coming from the beach. There shall be no glass or food items in the
- pool area. No horseplay or boisterous activity is allowed. No running or water games are allowed. No
- unauthorized radios or audio decks are allowed, except with ear phones. Correct bathing attire must
- be worn at all times. Young children must be accompanied by an adult. Do not remove lawn furniture
- to the beach. Management reserves the right to deny use of the pool to anyone at any time.

- Units above the ground floor during floor renovations are required to install some sort of noise
- reduction base material prior to the installation of the finished product -tile, laminate or wood flooring.
- 13
- All construction and contracted commercial activity must be conducted between the hours of 8:00
- AM and 5:00 PM. There will be no construction, demolition, or remodeling noise allowed on
- Sundays. Any construction or interior structural remodeling must be approved by the board in writing.
- Additionally, no exterior modifications including paint, doors, or windows may be made without
- written approval of the Board.

- Owners, subject to Board approval and at their own expense, may install a ducted split system air
- conditioner with an outside condenser. Maintenance of the unit is the responsibility of the owner.
- 15
- Smoking is permitted only in the designated smoking areas. Designated areas are the large Monkey
- Pod tree on the right side of the parking lot and the mailbox area. There will be no smoking in the
- common elements or the limited common elements including the lanais.

- Hono Kai Association of Apartment Owners (AOAO)
- House Rules Fine Schedule
- Effective 10/15/2022 - As Approved by the AOAO Board on 9/10/2022
- 1. Fines:
- The purpose of fines is to encourage the change of behaviors which might lower our property values
- (such as unsightly appearance of the property—even wet towels draped from railings may diminish the
- inherent worth of our property to observers); or behaviors that threaten the safety or well-being of
- others (such as, speeding on property, tripping hazards, or high-volume electronics).
- Delinquent accounts may be sent to the AOAO’s attorney for collection action. All legal fees and court
- costs are passed on to the owner in accordance with Hawaii state law.
- ALL FINES ARE CHARGED TO THE OWNER OF THE PROPERTY. If a tenant or guest generates a fine, it is
- always the owner who is held responsible. Owners, of course, have the option to require their tenants
- to repay the fines to them.
- Fines may be appealed, in accordance with Hawaii State law. Since fines generated by tenants or guests
- are the responsibility of the owner of the unit, only an owner may appeal a fine.
- FINES ISSUED WITHOUT WARNING
- 1. Disabling smoke detectors: $1,000
- 2. Having open fire or using a grill within 10’ of structure or creating other fire hazards: $1,000
- 3. Actions which might result in criminal or civil violations of the law: $1,000
- 4. Use of fireworks on property: $500
- 5. Smoking in an unapproved smoking area including a lanai, or throwing cigarettes or other
- smoking materials onto the property: $300
- 6. Modifying apartment exterior, lanai or structural interior without written Board approval:
- $1,000 (plus cost of to return to AOAO approved condition)
- ALL OTHER VIOLATIONS OF HOUSE RULES WITHIN SECTION 1-15
- 1. A written warning will be issued to the owner for the first offense
- 2. $50 for second offense
- 3. $100 for third offense
- 4. $250 for fourth and subsequent offenses
- 5. After 180 days without the same violation an owner’s escalating fines will be reset to a warning.
- OTHER FINES
- 1. Failing to provide access after reasonable notice to Hono Kai Maintenance for safety inspections
- or pest control unless otherwise approved by the Board: $300
- 2
- If any common area property is damaged while violating a rule the owner will be charged the cost of
- repairs in addition to appropriate fines.
- THE BOARD MAY ALSO ISSUE FINES OR WARNINGS AT ANY TIME FOR ANY ACTION THAT THREATENS
- THE STRUCTURAL WELL BEING OF THE BUILDINGS OF COMMON AREAS, AESTHETICS, PROPERTY VALUE,
- OR SAFETY OF OUR COMMUNITY, WHETHER OR NOT THEY ARE SPECIFICALLY NAMED IN THIS
- DOCUMENT.
- 2. Appealing Fines:
- A. The owner must make the appeal in writing no more than 30 days from the date the fine was issued.
- B. An owner may request a hearing in which case the Board will designate at least three of its members
- to meet with the owner for a hearing to review the charges and evaluate the evidence.
- C. During a hearing the owner may present oral and written evidence to support the appeal and may call
- and question witnesses during the hearing.
- D. A decision will be delivered in writing to the owner within seven (7) days after the hearing. The owner
- will be informed of the specific violation(s) and fine(s), if any, and the reasons for the decision.
- 3. Amendments to House Rules:
- House Rules may be amended or revised from time to time as deemed appropriate by the Board of
- Directors of the Association of Apartment Owners (AOAO).
- 4. Requests, complaints, or suggestions for our community:
- We request that all concerns be addressed in writing, to the Board.
- All owners are also invited to attend Board meetings to present their ideas and concerns. Owners may
- also contact Board members directly by email.
- All owners may, pursuant to and as allowed by the Condominium Property Act codified as HRS 514B,
- elect to proceed to mediation or arbitration in lieu of filing an appeal of a notice of violation or fine
- with the Board.
