Payment & Cancellation - 60 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 60 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 60 days before arrival: 100% refund.

- SHORT-TERM RENTAL AGREEMENT
- THIS AGREEMENT, governed by the laws of the State of Florida, is executed this day, between Property Manager and Guest, hereinafter referred to as "Owners" and Guest hereinafter, jointly and collectively called "Guest". This agreement is only for transient short-term rental of the rental premises listed below, and
- FIRST:
- IN CONSIDERATION of the following terms, covenants, agreements, limitations and conditions entered into by the parties hereto, Owner rents to Guest the property, 1161 Beach Road, Palm Beach Shores, Florida 33404 to be occupied only for the purpose of a transient, single-family, short-term/vacation dwelling unit.
- PAYMENT: Fifty percent (50%) of the total rent, taxes, and fees shall be paid and received by Owner in the form of a personal check, certified, cashier, bank check, through Airbnb/Property Manager/Homes & Villas by Marriott Bonvoy/Direct Booking or money order sixty (60) days prior to check-in, and the balance of rent, taxes, fees and any unpaid security deposit shall be paid and received by Owner no later than thirty (30) days prior to check-in. The security deposit, rent, taxes, and fees may be paid by personal check conditioned upon Owner's receipt of same more than thirty (30) days before the above-stated check-in date.

- Time is of the essence as to payment pursuant to this Rental Agreement, and any late payments shall, at the sole option of Owner, cause a forfeiture of Guest's rights pursuant to this Agreement and immediate cancellation of same without further notice to Guest.
- "CANCELLATIONS: Reservations Via Direct Booking or Property Manager may be canceled by Guest with notice to Owner within two (2) days of the date of the reservation call, if it is more than sixty (60) days before check-in and any deposit received by Owner shall be refunded to Guest minus a 4% of total booking administration fee. After two (2) days from the date of the reservation call, or less than sixty (60) days before check-in, any deposits, rent and fees paid shall become non-refundable if the reservation is canceled by Guest. Any reservations made via Airbnb will adhere to the Airbnb cancellation policy at the time of booking. Any reservations via Booking.com are eligible for a refund when cancelled 30 days before the reservation date. In the event of an emergency, Owner reserves the right at Owner's discretion, to refund on a case by case basis only, part of any deposit, rent or fees paid, minus an administrative fee, upon notice of cancellation by Guest. Any deposit, rent or fees retained by Owner pursuant to this provision shall be agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims."
- 60-Day Policy (Booking via Homes & Villas by Marriott Bonvoy platform)
- 1. Bookings Made 61+ Days Before Arrival
- Payment: 50% due at booking, 50% due 60 days before arrival.
- Refund: Full refund if canceled within 48 hours of booking or more than 60 days before arrival.
- 2. Bookings Made 30–11 Days Before Arrival
- Payment: 100% due at booking.
- Refund: Full refund if canceled within 48 hours of booking. No refund if canceled later.
- 3. Bookings Made 10 Days or Less Before Arrival
- Payment: 100% due at booking.
- Refund: No refund available.
- Additional Conditions:
- Within 60 Days of Arrival: No refund will be issued if the booking is canceled within 60 days of the arrival date, except under the 48-hour grace period mentioned above.
- More Than 60 Days Before Arrival: Cancellations made more than 60 days before arrival will receive a 100% refund.
- IMPORTANT NOTES:
- Travel insurance is highly recommended for all travelers, especially during hurricane season, which runs from June 1 to November 30. Please be advised that no refunds will be granted due to inclement weather, hurricanes, or the potential for hurricanes. If you are traveling during this time, we strongly encourage you to conduct your due diligence in securing appropriate travel insurance to protect your investment and ensure peace of mind.
- If refunds are required through Property Manager or direct bookings due to the home becoming uninhabitable as a result of a storm or hurricane, please note that a 4% fee will still apply to all refunds.
- THIRD:
- GUEST COVENANTS AND CONDITIONS:
- The parties agree that the following are material covenants and conditions of this Rental Agreement, the breach of which shall result in immediate forfeiture by the Guest of the subject rental premises in accordance with applicable law:
- 1. Guest shall not damage the rental premises or any part thereof or any personal property or appurtenance therein or thereto, and if the premises, or any part thereof, or any personal property or appurtenance thereto are damaged, obstructed or rendered inoperable by the misuse or negligence of Guest, Guest's guests, family, agents or employees, Guest shall pay the cost for repair or replacement of same immediately upon presentation by Owner of a bill for same.
- 2. Guest shall comply with all applicable federal, state, and county local laws, rules, regulations and ordinances including, but not limited to, the Palm Beach County, Florida,
- 3. Guest agrees not to commit waste or to use the rental premises or any appliances or appurtenances thereof or thereto for any disorderly or unlawful or offensive purpose.
- 4. Guest understands that maintenance, lawn service, pool maintenance, pest maintenance or any other vendors may enter the premises during their stay.
- 5. No pets are allowed in or around the rental premises at any time, unless specifically permitted by Owner in writing, at the time this Rental Agreement is executed and will be subject for a fee of $100 per stay. (Pets are not allowed on the furniture and feces have to be picked up upon departure or a $50.00 fee will be charged)
- a.) In the event of unauthorized pets being on the property, we reserve the right to charge the guest's credit card $250.00 per pet, as well as any costs
- associated with potential damage caused by the unauthorized pet.
- b.) Guests are responsible for their pets' conduct at all times. Any complaints from neighbors for excessive barking and/or improper control can result in
- removal from the property without refund.
- 6. Watercraft identified in Addendum A, not to have any motorized watercraft, including a jet ski or waverunner, may be stored on a trailer on the premises.
- 7. In the event the premises become uninhabitable, due to damage from wind, fire, rain, storm surge, or any other Act of God cause, and the Owner, at his sole discretion, shall decide not to repair or rebuild the premises, the term of this lease shall end and rent will be prorated up to the time of the damage.
- 8. Pursuant to §404.056(8), Florida Statutes, Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your public health unit.
- 9. Guest agrees to permit Owner or Owner's agents to enter the rental premises or any part thereof at any reasonable time for the purpose of examining same, to make necessary repairs, for potential future renters to view, and/or to protect any personal property from damage. Reasonable time for said entry, with notice to Guest, shall be between the hours of 8:30 a.m. and 8:00 p.m., although the parties may agree to additional hours for Owner's access. Owner or Owner's Agent may also enter the rental premises with the consent of Guest, or when necessary in case of an emergency or when the Guest unreasonably withholds consent or access.
- 10. a. Guest acknowledges and agrees that Owner may remove or cause to be removed from the rental premises any Guest or guest who, while at the rental premises, illegally possesses or deals in controlled substances, violates any of the terms of this Rental Agreement, is intoxicated, profane, lewd or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the rental premises, or anyone who fails to make payment of rent at the agreed-upon rental rate and fees at the agreed-upon times, or anyone who fails to check-out at the agreed- upon time unless an extension of time is expressly agreed to by the Owner and the Guest prior to check out. Admission to and removal from the rental premises is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by Owner to Guest, and if in writing shall be as follows: "You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this State."
- b. If any Guest who is asked to vacate early has paid in advance, Owner shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without prorating any portion of the day that Guest is noticed to vacate. Owner may retain any security deposit without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or Owner, at Owner's option, may proceed at law with any damages claim. Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, Owner may call upon any law enforcement officer of this State for assistance. If the Guest is arrested, Owner shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.
- 12. Guest agrees that Owner and Owner's agents shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall Owner or Owner's agents or employees be liable to Guest, Guest's family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein absent gross negligence. Guest further agrees that neither Owner, nor Owner's agents or employees shall be liable for any damage to the personal property of the Guest, Guest's family, guests, or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.
- 13. Smoking, illegal drugs, or vaping anywhere on the real property boundaries is strictly prohibited and will warrant immediate eviction from the property without refund and a fee of $500.
- 14. Guest is responsible for and shall indemnify the Owner and Owner's agents and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses or injuries sustained by any person including Guest, Guest's family, agents, guests or invitees as a result of or arising from the Guest's subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any part of the rental premises. Guest shall also be liable and indemnify Owner for attorney's fees and court costs incurred by Owner in enforcing any of the terms, covenants or conditions of this Rental Agreement or which are sustained by Owner as a result of or arising from or during Guest's subject occupancy and tenancy.
- 15. Guest relinquishes any long term tenancy rights, and reserves the right to be a guest only at stated property.
- 16. Guests may not assign this Agreement or sub-let the rental premises or any portion thereof.
- 17. Guest must be at least 25 years of age to rent the property
- 18. Unregistered guests after 10PM are prohibited. Maximum 8 guest overnights and 12 on the property at any given time.
- 19. Parties or local gatherings are strictly prohibited and will warrant immediate eviction from the property without refund.
- 20. Please ensure that the pool fence remains intact and is not taken down; otherwise, guests will be held liable, and will be charged $500.
- 21. A smart thermostat regulates the temperature - it can be manually changed, but our threshold is from 69-78F.
- 22. Check-in time is at 4 PM and Check-out is at 11 AM.
- 23. Please note there will be a $50/hour fee for late check out.
- 24. Please be advised that there is a $50 charge for lost keys.
- 25. Tropical Storms and Hurricanes: Florida is prone to tropical storms and hurricanes. We recommend all travelers to purchase insurance to cover any travel disruptions that may arise from these occurrences as refunds will not be granted for undesirable weather conditions.
- 26. Additional Terms:
- Rental comes “as is” This includes acknowledgement and acceptance of lack of cable TV and owner storage closet use.
- 27. Guest agrees to not turn the pool heating past 85 degrees and understand that a fee of $50.00 per day will apply if the temperature gage is set to higher than that of 85 degrees.
- 28. If the spa is operated for more than 3 consecutive hours or is left on without being switched back to pool mode, a $250 fee will be charged.
- 29. Guests must notify the owner within 12 hours of check-in of any cleanliness issues and allow the owner 24 hours to rectify them. Please note that no refunds will be issued.
- 30. Please remember that only toilet paper can be flushed down the toilets. Additionally, only water and tiny food scraps should go down the garbage disposal and sinks, as large quantities can cause clogs.
- 31. Please note, children are not allowed in the hot tubs or spas at any time.
- Waiver of Liability for Pool and Spa Use:
- Guest acknowledges that they have voluntarily chosen to use the pool and spa facilities located at 1161 Beach Road. In consideration for being permitted to use the Facilities, they hereby agree to release, waive, discharge, and covenant not to sue Owner, officers, agents, and employees (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while using the Facilities.
- Guest understand and acknowledge that using the pool and spa involves certain risks, including but not limited to the risk of injury or illness, and voluntarily assumes full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of using the Facilities, whether caused by the negligence of the Released Parties or otherwise.
- The guest further agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorney fees, they may incur due to the guest use of the Facilities, whether caused by Owner negligence or otherwise.
- I understand that this waiver and release of liability is intended to be as broad and inclusive as permitted by the laws of the state/province in which the Facilities are located and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
- Guest has read this waiver and release of liability, fully understands its terms, understands that they have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
- SECURITY AND VERIFICATION: We require the lead guest’s Government ID has to match the credit card used to pay the reservation (APPLIES TO ALL Property Manager AND DIRECT BOOKING)
- Credit Card Charges. The guest authorizes the Host to charge the Guest's credit card for damages, extraordinary cleaning required after guest's use of the Accommodations, unauthorized early check-in or late check-out, or as otherwise set forth in the fee scheduled below. Damages and extraordinary cleaning shall be determined in Host's sole discretion. Guest waives chargeback rights Guest may have under any cardholder agreement, including but not limited to all rights to contest charges permitted under this Agreement.
- PALM BEACH COUNTY, FLORIDA
- SPECIAL VACATION RENTAL PERMIT REGULATIONS AND CONDITIONS
- 1. Amplified sound which is audible on private property beyond the real property boundaries of the vacation rental property is prohibited.
- 2. External vendors, external rentals and live entertainment are strictly prohibited on the premises at all times. Non-compliance with any aspect of the rental agreement may result in immediate termination of the rental, with all payments automatically forfeited.
- 3. All trash and debris on the rental property must be kept in covered trash containers. The unit is equipped with trash containers for such purposes. Owners must post, and occupants must comply with, all trash and recycling schedules and requirements applicable to the vacation rental unit. Trash containers must not be placed by the street for pick-up until 6:00 p.m. the night before pick-up and must be removed from the area by the street by 6:00 p.m. the next day.
- 4. Owner provides the following name, address and telephone number of a contact person who resides locally and who is available twenty-four hours per day, seven days a week, for the purpose of promptly responding to complaints or concerns:
