Payment & Cancellation - 30 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 30 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 30 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 30 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 30 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 30 days before arrival: 100% refund.

- THIS IS A VACATION RENTAL AGREEMENT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS TO TENANCY AND EXPEDITED EVICTION OF RenterS. YOUR SIGNATURE, PAYMENT OF MONEY, OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL
- This Rental Agreement (the “Agreement”) is entered between Rare Space Hospitality Group as Agent (the “Agent”) for the Owner or Owners (individually or collectively referred to as “Owner”) of the vacation rental Property listed at the top page of this Agreement (the “Property”) and the “Renter” named on the first page of this Agreement, as of the date this Agreement is signed by Renter. Agent and Renter agree that the following terms and conditions shall apply to Renter’s rental of Owner’s Property.
- Check-In/Check-Out Procedures: Unless otherwise noted our properties are now direct, self check in. We need a signed copy of this Agreement and payment in full prior to your arrival. Access codes are generated and sent at check in time. Please plan your arrival and check in accordingly.
- CHECK-IN After 4:00 PM CST: Unless you have arranged and paid for an early check-in, check-in is at 4:00 PM CST. Neither housekeepers nor housekeeping inspectors will allow early entry for any reason and are to inform Agent of any attempt. This is for the safety of you and our staff.
- CHECK-OUT Before 10:00 AM CST: Unless you have arranged and paid for late checkout, all persons and personal items must be out by 10:00 AM CST. This is for the safety of you and our staff. Housekeepers will enter and begin cleaning promptly at 10 AM CST. There is a $110 per hour fee, one hour minimum, if you or your items are in the property after 10 AM CST. Rare Space Hospitality Group has the right to remove personal possessions of Renter(s) after 10 AM CST.
- CANCELLATION & REFUND POLICIES: A 50% deposit is taken when the reservation is processed. Free cancellations within 24 hours of booking for reservations made outside of 60 days. A $250 per unit handling fee will be charged on cancellations made more than 60 days prior to arrival. 100% of the total rental funds received are non-refundable on cancellations made less than 60 days prior to arrival. We strongly recommend you obtain "travelers' insurance." If you made your reservation on an OTA, Airbnb/VRBO/Expedia, Marriott, the policy stated on those sites supersedes this policy.

- PAYMENTS: Initial payment is 50% of total reservation with remaining balance to be automatically charged to your credit card on file on due date, 14 days prior to arrival. We accept credit cards (VISA, MasterCard, Discover, and American Express). A valid credit card must be filed for each reservation. Failure to make final payment on due date could result in Agent canceling reservation without refund. Rare Space may cancel your reservation or remove Renter(s) or any other Occupants from Property immediately if you fail to provide a form of payment that can be validated by Rare Space Hospitality Group.
- CAPACITY/OCCUPANTS: Please list all Renter(s) who will be staying at the Property during your dates of stay. Please include the ages of all minor children. The number of Renter(s) shall not exceed the capacity of the Property listed on the first page of this Agreement, and the Property may only be occupied by the persons listed below. Renter is required to limit occupancy of each bedroom to the posted limit on the website and confirmation. Any party exceeding maximum occupancy inside or outside will be subject to immediate eviction without refund.
- Renter(s) not staying at the home are included in occupancy limits. Children under the age of 12 should not be left on the Property without an adult. Mobile units such as campers and tents cannot be used on the Property. The number of persons considered to be in occupancy includes all adults and children under age 18 but excluding children under 18 months.
- SMOKING: None of our Properties allow smoking. Violators are subject to immediate eviction, forfeiture of all monies and additional cleaning charges, at a minimum of $500.00 and could be substantially higher. When allowed, smoke outside, away from the premises or in designated areas. Dispose of your smoking remnants responsibly. Failure to do so will result in an additional cleaning charge.
- PETS: Pets are not allowed at any time, except at properties specifically noted as dog friendly. No other types of pets are allowed at any of our properties. Violators are subject to eviction without refund and responsible for additional cleaning charges, at a minimum of $500.00 and could be substantially higher. Where dogs are permitted, there is a $150.00 fee per dog per reservation. You are responsible for all clean up in the yard or indoors if needed. Failure to clean up will result in additional charges.
- TRASH REMOVAL: Trash pickup is noted in your check in package. Please bag and tie all trash. Remember to close and latch the lids of cans to prevent animals from getting in. Renters that do not properly bag all trash and place in containers will be charged a fee for any excessive trash.
- PARKING: No parking in neighbors’ driveways, swells or lawn is permitted. No off-street parking is permitted unless expressly advertised in Property listing. See arrival instructions for your property parking guidelines. Agent is not responsible for the payment of any tickets or fines or towing received by the guests for parking illegally.
- KEYS: Rener(s) agree to at a minimum a fee of $75 and could be substantially higher for replacement of lost keys.
- INTERNET/ELECTRONICS/APPLIANCES: The property has a WiFi connection for internet access and cable subscription which guests may use during occupancy. During the period of occupancy, the Property owner and Agent are not responsible for any interruption or loss of internet access, data loss, distortion or appliance issues. There will be no refund or reduction in the total rent for direct or indirect damages due to interruption, loss or quality of services mentioned herein. Property Owner and Agent will make every effort to service and remedy the issue.

- PHOTOGRAPHY/FILMING: No commercial photography or filming is permitted on the Property unless approved in advance by the Agent.
- RENTER/PARTIES/NOISE: The Renter must supervise their Renter(s) while on the premises. Noise in the Property must be kept to a reasonable level as not to cause a disturbance to the neighbors or general public. Neighborhood quiet hours are between 9 PM and 8 AM; noise audible outside Property is prohibited during these times. Renter(s) agree to conduct themselves throughout stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Rare Space Hospitality Group from police, neighbors, or neighborhood associations. In no event may the maximum occupancy (as listed on this Agreement) be exceeded without written consent.
- AUTHORIZED ACCESS: Persons authorized by Owner or Agent shall have the right to access the Property during rental to make repairs, inspections, or property maintenance. Renters may not turn away lawn care, pool/spa maintenance persons, or any individual who helps maintain property quality.
- DISPUTES: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Louisiana. Any dispute or action filed relating to this Agreement shall be instituted and prosecuted in the General Court of Justice within the State. Renter, by execution of this Agreement, specifically consents to such jurisdiction and venue and to the extraterritorial service of process should such service become necessary.
- DAMAGE WAIVER: Rare Space Hospitality Group requires each reservation to participate in the Damage Waiver Program which is included in your reservation. This Damage Waiver covers up to $250 of unintentional damage to your vacation rental property during your stay. Any damages found upon arrival need to be reported to the office at (504) 330-6251 by 8 AM the day after arrival so you are not charged for damage you did not create. Guests will be responsible for any damages or theft thereafter. Accidents causing damage need to be reported upon occurrence by calling (504) 330-6251.
- CREDIT CARD AUTHORIZATION: Renter hereby authorizes Agent to charge all deposits, fees, costs and charges arising under this Agreement to the Renter’s credit card provided to Agent. The reversal of any charges to Renter’s credit card arising under this Agreement shall constitute a breach of this Agreement by Renter.
- CAUSE FOR EVICTION & IMMEDIATE FORFEITURE OF RENT: Renter must be at least 21 years of age. Renter agrees to provide proof of age upon request. Cause for eviction and immediate forfeiture of rent includes, but is not limited to, the following: subletting or assigning this Agreement; activity constituting a nuisance which is offensive or disruptive; bringing pets into premises of non-pet friendly properties, without written permission; numbers in excess of occupancy rate; destruction of Property; illegal use of Property or conduct of illegal activities
- on the Property.
- For Renter(s) of Site 61 located at 3701 Tulane Ave, New Orleans, LA 70119, no illegal activity, including harassment, stalking, theft, or consuming items by purchased by other guests, will be tolerated. Renter(s) agree to respect the property and privacy and personal space of other Renter(s) and to keep noise levels to a minimum, especially in dorm rooms. Renter(s) agree to treat hostel staff with kindness and respect. Manager reserves the right to cancel reservation of Renter(s) who are disruptive, disrespectful of staff, building, neighbors or other Renter(s). Renter(s) agree that failure to comply with house rules may result in immediate eviction without refund.

- SAFETY; SURVEILLANCE; SECURITY:
- Safety: You acknowledge and agree that the Properties may contain certain safety features such as smoke detectors, carbon monoxide detectors, fire alarms, pool gates, pool alarms, or sound level monitoring units as may be required by law. You consent to our use of these safety features, and you agree not to interfere or tamper with these safety features. You agree to immediately report any problems or need for maintenance or repairs to Rare Space Hospitality Group. It is expressly understood that you must not, at any time, disable or remove any installed safety feature, and doing so will be considered a material breach of this Agreement and will be just cause for termination of this Agreement and your removal from the Property.
- Surveillance: Each Accommodation may be monitored by video electronic surveillance on the exterior of the house for guest security and to ensure that local law and the rules of the community are respected. You acknowledge that the Accommodation may be under 24-hour exterior surveillance and security monitoring and patrols, subject to and in compliance with relevant privacy laws. Accommodations may include noise alert decibel monitoring systems in order to ensure that neighborhood noise levels are respected.
- For Renter(s) of Site 61 located at 3701 Tulane Ave, New Orleans, LA 70119, the Property interior common spaces may be monitored by video electronic surveillance. Private areas including bedrooms and bathrooms are not monitored by video electronic surveillance. You acknowledge that the Accommodation may be under 24-hour exterior and interior common space surveillance and security monitoring and patrols, subject to and in compliance with relevant privacy laws. Accommodations may include noise alert decibel monitoring systems in order to ensure that neighborhood noise levels are respected.
- Security: You also acknowledge and agree that certain security measures may be provided by us in connection with the Properties. We reserve the right to commence, expand, reduce or discontinue any such security measures at any time without notice to you.
- ENVIRONMENTAL CONSIDERATIONS:
- Pests: New Orleans, Louisiana is home to a variety of insects including but not limited to roaches and termites. Properties receive regular pest control services but that may not prevent in full the presence of natural pests on the Property. Renter(s) agree that Agent cannot guarantee absence of presence of natural pests. Agent will service the issue upon reported incidence.
- Extreme Heat/Weather Events: New Orleans, Louisiana is prone to temperatures in excess of 100 degrees Fahrenheit and heavy rains including hurricanes. Renter(s) should exercise due caution during extreme weather events. Renter(s) understand A/C units will cool the Property more slowly when there is extreme heat. The environmental conditions considered herein do not warrant refunds.
- Central A/C and Air Conditioning Otherwise: Air conditioning units, window units, mini splits, and central A/C, are designed to accommodate up to a 20 degree Fahrenheit difference between the outside and inside air. Renter(s) agree that it is not an expected result to cool the interior of Property more than 20 degrees Fahrenheit from the outside temperature. Setting air conditioning, for example, at 80 degrees Fahrenheit or less when it is 100 degrees Fahrenheit commonly leads to air conditioning equipment “freezing” and becoming inoperable. Violators are subject to service charges from the occurrence of ‘freezing’ the A/C unt or for callouts for the A/C unit if it is functioning, at a minimum of $500.00 and could be substantially higher.
- Living in Historic Homes: Renter(s) agree that living in a historic home may involve, but not be limited to, the following: difficult to open doors/windows due to swelling or shrinking caused by high or low humidity/temperatures, low ceilings/doorways, narrow staircases, uneven and scratched floors, minor cracks in drywall, high humidity, cooling at a differential of 20 degrees Fahrenheit from external temperatures, and dust and allergens. Renter(s) further agree that the conditions of Living in Historic Homes considered herein do not warrant refunds. Renter(s) agree that Manager has no knowledge of lead based paint and/or lead based paint hazards in the Property.
- CONSEQUENCES OF BREACH; CHARGES FOR DAMAGE: Any failure by Renter(s) or any other Occupants to comply with any of the terms, conditions, or policies above is a breach of this Agreement and may result in a forfeiture of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. Rare Space Hospitality Group may terminate this Agreement for breach, and if you are notified of such termination you agree to leave the Property immediately. In addition, you are responsible for, and you authorize us to bill your credit card on file for the full amount of: any damage or loss that occurs at the Property during your stay and any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during your stay, and any damages (which may exceed the amount of fines) that result from the violation. You agree to contact Rare Space Hospitality Group using the contact information provided in your confirmation email, as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition at the Property, or if any incident occurs at the Property that is related to such a problem or condition. You further agree to give Rare Space a reasonable amount of time to respond to your report and to cooperate with Rare Space Hospitality Group’s efforts to address the concern or provide a remedy. Renter(s) are liable for any damage to the property above and beyond normal wear and tear and agree to accept charges to the card on file should damage occur during occupancy.

- INDEMNIFICATION, WAIVER, AND RELEASE. Renter shall indemnify, defend and hold harmless the owner of the Property and Agent (the “Released Parties”) from any and all liability for costs, expenses, claims, disputes, litigation, judgments, and attorney fees resulting from loss, damage, or injury the Property, to Renter, Renter’s Renters or licensees, or their personal property arising out of the Renter or the Renter’s Renters, invitees and licenses occupancy or use of the Property. If there is more than one Renter, all Renters are jointly and severally liable under this Agreement. Any personal injury or illnesses of any nature, severity or kind, occurring to Renter/Renters/or Renter’s invitees while staying at the Property, are not the responsibility of Agent. It is expressly understood and agreed that Agent has no liability, responsibility or accountability for any physical or psychological injury that may occur as a result of this Agreement. This waiver and release is intended to be a full and complete waiver and release of the Released Parties from any and all present or future claims.
- CERTIFICATION: I, or we, the Renter, hereby certify and consent that I/we have read the entire Agreement and conditions and agree to the terms and will comply with them during the course of this vacation rental.
