Payment & Cancellation - 30 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 30 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 30 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 30 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 30 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 30 days before arrival: 100% refund.

- Main Rules:
- * We are pet-friendly for 2 doggies but require you to let us know and pay an additional fee of $180 and agree to our pet rules.

- Sauna Usage Policies:
- - Children ages five and under are not permitted in the sauna.
- - Children between the ages of six and 16 must be accompanied by an adult in the sauna at all times.
- - Allow yourself at least five minutes after exercising to cool down before entering the sauna.
- - Pregnant women and persons suffering from heart disease, diabetes, high or low blood pressure, circulatory or respiratory problems, seizures or epilepsy should not enter the sauna without prior medical consultation.
- - Do not use the sauna while under the influence of any type of alcohol, drugs, anticoagulants, antihistamines, vasoconstrictor, vasodilators, stimulants, hypnotics, narcotics or tranquilizers.
- - Clean swim attire must be worn and participants are required to bring a towel to sit on when using the sauna.
- - Remove all metal jewelry prior to entering the sauna.
- - The surface of the rocks, heater, and surrounding area can be extremely hot. Exercise caution.
- - Prolonged use of sauna not recommended due to fatiguing effects. Limit yourself to a maximum of 15 minutes.
- - Do not smoke, exercise, eat or drink beverages in the sauna room.
- - Leave the sauna immediately if you experience any nausea, dizziness, hot flashes, cold chills, headaches or other discomfort.
- - Drink plenty of fluids before and after leaving the sauna.
- - Use of chlorinated pool or spa water and oil on heating rocks is prohibited in a wet sauna.
- - Do not use the sauna to dry clothes, swimsuits or towels or place materials near the heater or guard fence.
- - Newspapers, magazines, or other reading materials are prohibited.
- - After using the sauna, participants must shower prior to entering the pool or whirlpool as this will cause the chemicals to become unbalanced.
- - If repair or assistance is needed, contact us IMMEDIATELY
- Hot Tub Usage Policies
- - Please keep noise levels to a minimum as we have neighbors surrounding.
- - Please check the temperature of the water in the hot tub before use. Maximum safe water temperature should be established by a medical practitioner, not to exceed 104 degrees Fahrenheit.
- - Minors under the age of 18 shall not utilize the hot tub unsupervised. Unsupervised use by children is strictly prohibited. Never leave children unattended in the vicinity of the hot tub.
- - Do not add anything to the water including foaming bubbles, chemicals, soaps, bath oils, etc. If these items are used in the hot tubs, an additional cleaning fee will be assessed.
- - Persons with skin, ear, or other body infections should not enter the hot tub because of the possibility of spreading the infection.
- - Alcoholic beverages or drugs should not be consumed while using the hot tub. BE AWARE that the use of alcoholic beverages or drugs before or during hot tub use may lead to unconsciousness with the possibility of drowning, heart attack, or injury due to passing out or falling.
- - Absolutely no candles are allowed on or in the hot tub.
- - Absolutely no shoes are to be worn in the hot tub.
- - Water is an excellent conductor of electricity. Electrical shock or electrocution can occur in a hot tub if live electrical current (including current from a telephone) comes into contact with the water. Stay out during lightning or rain storms because of the possibility of electrocution.
- - Surrounding areas may be slippery and dangerous when wet.
- - Persons who have high blood pressure, skin sensitivities, or who might be pregnant are strongly urged not to use a hot tub. If in doubt, please consult with a physician prior to using the hot tub.
- - Observe reasonable time limits to avoid nausea, dizziness and fainting. Should you experience any of these symptoms, carefully exit the hot tub immediately.
- - Lessee agrees to leave the hot tub in the same condition it was received.
- - Lessee agrees to fully reimburse and indemnify Lessor for damage caused to the hot tub during lease term, including damage caused by any person, including invited or uninvited guests, pets, animals, and children.
- - Lessee understands there will be no reduction in rental fees if the hot tub is unused or unavailable during the term of Lessee’s rental period.
- - Please do not turn off or unplug the hot tub.
- - It is recommended that no jewelry is worn in the hot tub due to chemicals used. The chemicals in hot tubs can also affect color-treated hair and damage swimsuits.
- - The hot tub shall be covered and locked when not in use, especially if there are any children in the vicinity. Hot tub covers are easily damaged. Lessee agrees to inspect the hot tub cover for any damage upon arrival and advise Lessor of any problems.
- Property Manager, LLC
- SHORT TERM RENTAL AGREEMENT
- This Short Term Rental Agreement (the “Agreement”) is made by and between Property Manager LLC (“ASATR”) and (“Guest”)* as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
- Guest. The term “Guest” shall include Guests, Invitees, their successors, heirs, agents and assigns including any minors.
- Property. The property is furnished and includes such items as: fridge/freezer, stove/oven/microwave, cooking utensils and equipment, bed sheets, bath towels, beach towels where necessary, essential cooking spices, baking and cooking supplies. [this is not a comprehensive list.]
- Rental Party: The rental party shall consist of Guest and not exceed the maximum number of occupancy allowed.
- ***Identification must be presented for Guest**
- Maximum Occupancy: Maximum number of guests is listed on each property listing site.
- Minors and Legally Incapacitated Guests: Minors are defined as anyone under the age of 18. Anyone under the age of 18 or legally incapacitated must have a guardian sign and take full responsibility for any and all damages and/or penalties. In the sole discretion of ASATR, the guardian also be required to make an additional security deposit.
- Term of the Lease. The lease begins at 4:00 p.m. on (the “Check-in Date”) and ends at 11:00 a.m. on (the “Checkout Date”). If the Property appears dirty or damaged upon Check-in, Guest shall inform Manager immediately.
- Minimum Stay: Minimum stay is listed on each booking site according to the appropriate season, date, weekend, etc.
- Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the Property and shall cause all members of the rental party and anyone else Guest permits on the Property to abide by the following rules at all times while at the Property. Guest is responsible for any damage or costs caused by the negligence or intentional acts of all persons who Guest permits to be on the Property. If Guest does not abide by any of the rental rules, the Guest stay may be terminated with no refund as well as any fines and or fees associated.
- Access: Guest shall allow Manager access to the Property for purposes of repair and inspection. Manager shall exercise this right of access in a reasonable manner.
- Rental Rate and Fees; Damages
- Deposit: No security deposit is required unless otherwise stated by booking agent/site. However, payment for the rental stay must be paid in advance
- Fireplace (if applicable): Failure to properly clean ashes from the fireplace, if used, will result in a $50 charge
- Fire-pit (if applicable): Failure to properly clean ashes from the fire-pit, if used, will result in a $50 charge
- BBQ Grill (if applicable): Failure to properly clean the BBQ grill, if used, will result in a $50 charge
- Charge for Damages: Manager shall communicate all claims of damage to Guest within 14 days after the Checkout Date for the following:
- Damage to the property
- dirt or other mess requiring excessive cleaning;
- failure to adhere to the rental rules outlined in exhibit A; or
- any other cost incurred by Manager or the Owner due to Guest’s stay.
- Rental Rate. Rental rates will be communicated via booking site. Payment in full shall be due according to time frame specified by booking site.
- *Cancellation Policy: If Guest wishes to cancel his/her reservation, the prepaid rental will be refunded as follows:
- 100% (minus cancellation fee) if canceled more than thirty (30) days prior to Check-in Date
- 0% if canceled fewer than 30 days prior to the Check-in Date
- If rates fluctuate, both owner and guest will abide by rates agreed upon in this contract.
- Cancellation Fee: $150 for standard reservations ; $200 for standard reservations that are defined as peak season.
- Peak season dates include, but not limited to, the following large events such as, but not limited to, SXSW, ACL, Lone Star Rally, Formula One; Holidays such as Memorial Day, Easter, Fourth of July, Labor Day, Thanksgiving, Christmas, New Year’s Eve; or Seasonal such as Spring Break, Summer Dates (Memorial Day – Labor Day)
- If Guest cancels on or after 30 days prior to Check-in Date, no rental fees (including the administrative fee) will be refunded
- *When booked through Marriott HVMB, these cancellation policies do not apply. Please refer to Marriott HVMB for the cancellation policy that applies.
- Property Damage Protection
- Included in your rental rate, our coverage safeguards you against accidental damages up to $1500, ensuring your relaxation and enjoyment during your stay.
- RELEASE, DEFEND, INDEMNIFY AND HOLD HARMLESS:
- ALL GUESTS AS DEFINED IN PARAGRAPH 1 ABOVE AGREE TO RELEASE, DEFEND, INDEMNIFY AND HOLD THE RELEASED PARTIES, BOTH OWNERS AND PROPERTY MANAGERS OR AGENTS, HOLDIGN THEM HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF:
- ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO GUESTS OR INVITEES, RELATED TO THE USE OR OCCUPATION OF THE DWELLING PLACES, GROUNDS, SWIMMING POOL OR OTHER FACILITIES; OR
- ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OR OCCUPATION OF THE DWELLING PLACES, GROUNDS, SWIMMING POOL OR OTHER FACILITIES.
- ALL GUESTS AS DEFINED IN PARAGRAPH 1 ABOVE UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES.
- 11: NO REFUNDS FOR INABILITY TO ACCESS OR USE RENTAL PROPERTY
- IN THE EVENT EVENTS BEYOND THE CONTROL OF THE LANDLORD INCLUDING BUT NOT LIMITED WEATHER SUCH AS HURRICANE, BLIZZARD, SNOWFALL OR FREEZING RAINS, EXCESSIVE RAINFALL, FLOODING OR DAMAGE OCCASIONED THEREBY MAKING EITHER ACCESS TO OR OCCUPATION BY GUEST IMPOSSIBLE OR UNDESIRABLE, NO REFUNDS WILL BE MADE. GUESTS ARE ENCOURAGES TO SEEK TRAVELERS INSURANCE OR OTHER SECURITY.
- 12. Property Damage Protection: Terms and Conditions
- Responsibility for Accommodation:
- - As a Guest, you acknowledge and agree that you are responsible for maintaining the Accommodation in the condition it was in upon your arrival. You are liable for your own actions and those of any individuals you invite to or grant access to the Accommodation.
- Property Damage Protection Coverage:
- - You understand that any damage protection coverage, provided to you does not extend to wanton, malicious, or willful acts, and may not cover gross negligence. In the event of damages claimed by the Host due to such acts, you agree to reimburse the Host for the cost of replacing damaged items with equivalent ones.
- Reporting Damages:
- - In the event of damage to the Property, you must promptly report it to the property management company. Failure to report damages promptly may affect coverage under the Property Damage Protection plan.
- Assistance with Claims:
- - You agree to cooperate with the Host in good faith and provide any necessary assistance and information to facilitate the Host's claim under your homeowner’s, renter’s, or other insurance policy for damages or losses caused by you during your stay.
- Reimbursement and Remittance:
- - If your credit card is charged for damages and the Host is subsequently reimbursed by Property Damage Protection, any remaining balance will be remitted to you, net of costs and related charges.
- Limit of Liability:
- The maximum liability under the Property Damage Protection plan is $1500. Any damages exceeding this limit will be your responsibility and must be paid promptly.
- Exclusions:
- The following are excluded from coverage:
- (a) Wear and tear
- (b) Damage caused by weather
- (c) Damage not caused by the guest
- (d) Liability related to the use of recreational equipment
- (e) Liability related to pets, including bites
- (f) Liability resulting from bed bugs
- (g) Liability from viruses
- (h) Liability related to invasion of privacy
- (i) Liability for injuries caused by a guest to another guest
- (j) Liability for damages caused by a guest to neighbors or property not maintained by the named insured
- (l) Theft
- (m) Missing Items
- (n) Intentional damage, as determined by PDP Committee
- (o) Hot Tub Dumps due to guest negligence
- (p) Linens
- (q) Damage resulting from pets, including bites or scratches.
- (r) Damage caused by smoking inside the Property, if smoking is prohibited.
- Property Damage Policy Modification:
- These Property Damage Protection Terms and Conditions are subject to modification by the property management company at any time. Any changes will be communicated to you in writing or through updated documentation.
- The parties agree to the terms of this Short Term Rental Agreement, as evidenced by digital agreement.
- Exhibit A
- RENTAL RULES
- Failure to adhere to any and all of the rental rules may result in a fee or fine.
- -Smoking is NOT allowed inside the property. Fine of $500 plus expenses incurred, including any rental revenue from dates we have to block off or move/ cancel guests.
- -People other than those in the guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of guest.
- -All of the properties are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
- -Keep the property and all furnishings in good order
- -Only use appliances for their intended uses
- -Property Specific Pet Policy: listed on each booking site/ listing page
- – Properties that do NOT allow pets- Pets are NOT allowed anywhere on the property- $500 fine + $50/day.
- – Properties that DO allow pets: Pet Policy:
- – Additional Pet Fee of $180 +tax
- – Guest is responsible for the clean up of all fecal matter, or will be fined a minimum of $150
- – We ask that you keep pets off of furniture and beds, or bring a blanket to lay down for them.
- – Guest is responsible for any and all damage caused by pets
- – Maximum of 2 pets, weighing no more than 35lbs each, without further approval
- – Fencing is NOT meant to keep pets in. It is only there for privacy and we are not responsible for any pets who may get out of the fenced yard or creatures getting in.
- – Additional cleaning fee may incur with excess amounts of hair and uncleanliness.
- – We must have a valid credit card on file.
- PARKING: Described on each booking site/ listing page
- BBQ Grill / Firepit, if applicable: The amenities must be used for their intended purposes. The firepit may not be available during seasons of a Burn Ban by the local regulations. It is your responsibility to adhere to all local ordinances and burn bans. You may be required to request access to specific amenities. See exhibit 8 for any fees that may be associated with the amenities.
- Housekeeping: There is no daily housekeeping service. While linens, bath and pool towels are included in the unit, daily maid service is not included in the rental rate. Please do not take our white towels out of the home!
- Storms: If there is a storm, earthquake, or anything that causes significant damage to the property or property’s area which inhibits you from staying, no refunds will be given.
- We encourage all of our travelers to purchase traveler’s insurance.
- Post checkout:
- We make check-out very easy. No keys to return and no laundry to clean! Please make sure all trash and alcohol is removed from property, dishes are cleaned and put away in their proper place, and the BQQ grill, fireplace/pit are cleaned. Failure to do so may result in an excessive cleaning fee. Thank you!
- We ask that you leave the property in a reasonable condition for our house cleaners, but enjoy your last day! The key-code to the door will automatically be disabled within an hour of your departure time. If you’ve left anything behind, please let us know and we’ll arrange to get it returned to you!
- RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISKS
- and
- INDEMNITY/HOLD HARMLESS AGREEMENT
- for use of
- SWIMMING POOL AND/OR SPA/ HOT TUB
- 1. Defined terms under this Agreement: “Property Manager” – Property Manager, LLC “Minors” – shall mean the following minors who are the children, foster children, wards or otherwise legal responsibility of the Users. “Released Parties” – shall mean the Property Manager and the Property Owner and each of the above-named parties’ partners, officers, directors, committee chairpersons, committee members, agents, management company(s), contractors, employees, servants, successors or assigns. “Swimming Pool” – shall mean the swimming pool and/or hot tub, jacuzzi, spa, or the like located at ::property address::. “Users” – shall mean each signatory to this document, the Rental Party, and each signatory’s Minors, heirs, successors, representatives and assigns.
- 2. The undersigned Users do hereby execute this Release, Waiver of Liability, Assumption of Risks and Indemnity/Hold Harmless Agreement (the “Agreement”) for himself/herself/theirself and his/her/their heirs and any of their Minors, guests, and invitees and acknowledges the inherent risks involved in the use of the Swimming Pool, which risks include, but are not limited to bodily injury, sickness, disease or death from using the Swimming Pool. Users also acknowledge and understand that use of the Swimming Pool by Users, as defined below, is potentially dangerous and that the type of injury or damage described above can occur when using the Swimming Pool. USERS UNDERSTAND THERE WILL BE NO LIFEGUARD ON DUTY DURING THE TIMES USERS WILL BE ALLOWED ACCESS TO SWIMMING POOL UNDER THIS AGREEMENT AS SET FORTH IN PARAGRAPH 3 BELOW AND AGREE TO ASSUME ALL RISKS ASSOCIATED THEREWITH.
- 3. The allowed use of the Swimming Pool by Users, their Minors, their guests, and invitees under this Agreement will begin only on the dates and for the times set forth attached hereto and incorporated herein for all purposes.
- 4. All minors must be accompanied by a responsible adult over the age of 18 years old.
- 5. No glass in the Swimming Pool or the surrounding area
- 6. Users must securely close the gate upon entering or exiting the Swimming Pool area.
- 7. Users agree to clean up any trash or other items left by Users in the Swimming Pool or in the vicinity after each use. Any damages to the Swimming Pool or personal property in the Swimming Pool area by Users under this Agreement will be the responsibility of the Users. Should the Property Manager have to pay for any clean-up or damages by Users under this Agreement, the Users will be responsible for all costs incurred.
- 8. In exchange for being permitted to use Swimming Pool and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the Users, for himself/herself/theirself, release and agree not to make or bring any claim of any kind against the Released Parties for: (1) any injury (including death), disease or sickness to Users, Minors or their guests and invitees related to the use or operation of the Swimming Pool; (2) any damage to personal property whether or not caused by the negligence of the Released Parties or not; or (3) any other cause arising out of or related to Users, Minors or their guests and invitees use of the Swimming Pool.
- 9. In consideration for being allowed to use the Swimming Pool under this Agreement, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged: USERS AGREE TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF: (1) ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO USERS OR THEIR MINORS, GUESTS OR INVITEES RELATED TO THE USE OR OPERATION OF THE SWIMMING POOL; OR (2) ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OR OPERATION OF THE SWIMMING POOL. USERS UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS INDEMNITY AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES.
- 10. Users stipulate and agree that invalidation of any term(s) or provision(s) of this Agreement by judgment or other court order shall not affect any of the other terms or provisions and such other terms and provisions shall remain in full force and effect.
- 11. Users understand and agree the Property Manager may terminate this Agreement at any time.
- 12. Users agree that he/she/they will be responsible for any and all legal fees incurred by the Property Manager for any proceeding or action brought under or with relation to this Agreement.

We hereby acknowledge that we have read the Pool Rules and Guidelines attached and hereby accept them and agree to abide by each such Rule and Guideline, as may be amended from time to time.
- ACKNOWLEDGEMENT:
- I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named on the guest list.
- THE CREDIT CARD SUPPLIED AT THE TIME OF RESERVATION WILL BE HELD FOR BACKUP SECURITY PURPOSES ONLY
- Per Page 1 of this Agreement, it is hereby agreed that unpaid rent, excessive cleaning, damage, penalties for nonadherence to rental rules, lost keys or lock-outs may be charged to this card if necessary.

- RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISKS
- and
- INDEMNITY/HOLD HARMLESS AGREEMENT
- for use of
- SWIMMING POOL AND/OR SPA/ HOT TUB
- 1. Defined terms under this Agreement: “Property Manager” – Property Manager, LLC “Minors” – shall mean the following minors who are the children, foster children, wards or otherwise legal responsibility of the Users. “Released Parties” – shall mean the Property Manager and the Property Owner and each of the above-named parties’ partners, officers, directors, committee chairpersons, committee members, agents, management company(s), contractors, employees, servants, successors or assigns. “Swimming Pool” – shall mean the swimming pool and/or hot tub, jacuzzi, spa, or the like located the Property. “Users” – shall mean each signatory to this document, the Rental Party, and each signatory’s Minors, heirs, successors, representatives and assigns.
- 2. The undersigned Users do hereby execute this Release, Waiver of Liability, Assumption of Risks and Indemnity/Hold Harmless Agreement (the “Agreement”) for himself/herself/theirself and his/her/their heirs and any of their Minors, guests, and invitees and acknowledges the inherent risks involved in the use of the Swimming Pool, which risks include, but are not limited to bodily injury, sickness, disease or death from using the Swimming Pool. Users also acknowledge and understand that use of the Swimming Pool by Users, as defined below, is potentially dangerous and that the type of injury or damage described above can occur when using the Swimming Pool. USERS UNDERSTAND THERE WILL BE NO LIFEGUARD ON DUTY DURING THE TIMES USERS WILL BE ALLOWED ACCESS TO SWIMMING POOL UNDER THIS AGREEMENT AS SET FORTH IN PARAGRAPH 3 BELOW AND AGREE TO ASSUME ALL RISKS ASSOCIATED THEREWITH.
- 3. The allowed use of the Swimming Pool by Users, their Minors, their guests, and invitees under this Agreement will begin only on the dates and for the times set forth attached hereto and incorporated herein for all purposes.
- 4. All minors must be accompanied by a responsible adult over the age of 18 years old.
- 5. No glass in the Swimming Pool or surrounding area
- 6. Users must securely close the gate upon entering or exiting the Swimming Pool area.
- 7. Users agree to clean up any trash or other items left by Users in the Swimming Pool or in the vicinity after each use. Any damages to the Swimming Pool or personal property in the Swimming Pool area by Users under this Agreement will be the responsibility of the Users. Should the Property Manager have to pay for any clean-up or damages by Users under this Agreement, the Users will be responsible for all costs incurred.
- 8. In exchange for being permitted to use Swimming Pool and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the Users, for himself/herself/theirself, release and agree not to make or bring any claim of any kind against the Released Parties for: (1) any injury (including death), disease or sickness to Users, Minors or their guests and invitees related to the use or operation of the Swimming Pool; (2) any damage to personal property whether or not caused by the negligence of the Released Parties or not; or (3) any other cause arising out of or related to Users, Minors or their guests and invitees use of the Swimming Pool.
- 9. In consideration for being allowed to use the Swimming Pool under this Agreement, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged: USERS AGREE TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF: (1) ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO USERS OR THEIR MINORS, GUESTS OR INVITEES RELATED TO THE USE OR OPERATION OF THE SWIMMING POOL; OR (2) ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OR OPERATION OF THE SWIMMING POOL. USERS UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS INDEMNITY AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES.
- 10. Users stipulate and agree that invalidation of any term(s) or provision(s) of this Agreement by judgment or other court order shall not affect any of the other terms or provisions and such other terms and provisions shall remain in full force and effect.
- 11. Users understand and agree the Property Manager may terminate this Agreement at any time.
- 12. Users agree that he/she/they will be responsible for any and all legal fees incurred by the Property Manager for any proceeding or action brought under or with relation to this Agreement.
- We hereby acknowledge that THERE IS NO LIFEGUARD ON DUTY and that THIS IS A SWIM AT YOUR OWN RISK FACILITY. We hereby acknowledge that we have read the Pool Rules and Guidelines attached and hereby accept them and agree to abide by each such Rule and Guideline, as may be amended from time to time.
- ACKNOWLEDGEMENT:
- I/we, the undersigned, hereby apply for the above-listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of the Guest and all rental party individuals.
