Payment and Cancellation - 90 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 90 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 90 days before arrival: Guests pay 50% at time of reservation (non-refundable), the remaining 50% will be charged 90 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 90 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 90 days before arrival: initial 50% payment is forfeited; the remaining 50% will not be charged.
- For guests paying with points more than 90 days before arrival: 50% of points taken are forfeited; the remaining 50% will be refunded within 5-10 business days.
House Rules
- THIS RENTAL CONDITIONS AGREEMENT (“Agreement”) is entered into by and between Owner (“Owner”) and “Guest” (also referred to as “You” and “Yours”). In consideration of the performance of the provisions of this Agreement, Owner hereby agrees to rent to Guest and Guest hereby agrees to rent from Owner the home, subject, in all respects, to the provisions of this Agreement. The home and its appurtenances are referred to as the “Rental Home”. The real property under and around the Rental Home is referred to as the “Property” (the “Rental Home” and the “Property” are collectively referred to as the “Premises”). Taxes and Fees are subject to change without notice, Guest is responsible for any additional costs.
- 10% non-refundable deposit. NO REFUNDS within 90 days of arrival.

- 1. Maximum Occupancy. The maximum occupancy of the Vacation Accommodation is for the agreed number of registered guests for this booking. At no time shall more than the maximum occupancy for this booking occupy the Premises overnight. Should more than the stated number of guests occupy the Premises overnight, Guest will incur additional nightly charges and increased cleaning fees. If Guest would like to have visitors at the property, advanced written notice and approval is required by Property Manager.
- 2. Use of the Premises. This Agreement is for residential Rental Home use only. Guest shall comply with all laws, ordinances, rules and regulations governing or otherwise relating to the use and occupancy of the Premises. The Premises may not be used for any gatherings, parties, weddings, receptions, luaus, events unless disclosed to and approved by Property Manager. The parties agree that the occupancy covered hereunder is for day-to-day “transient purposes” only and that, as such, the terms, conditions and provisions of this Agreement are not subject to Chapter 521, Hawaii Revised Statutes.
- 3. Utilities and Services. Owner shall provide and maintain water, sewer, electricity, and high-speed internet connection, where available. Owner shall not be liable for any interruption in services beyond Owner’s control and Guest may not terminate this Agreement because such services are interrupted. Owner also provides weekly trash removal and recycling services. **If the property has a pool and pool heat is an option, pool heating will incur a propane charge. Propane charges are clearly stated on Property Manager website. If excessive propane is used due to Guest misuse of pool and jacuzzi equipment, Guest is responsible for any additional propane and equipment charges.
- 4. Condition of the Rental Home. Before Guest shall be permitted to occupy the Rental Home, the Owner or Property Manager shall clean, inspect, and take inventory of the Rental Home. When Guest departs, Guest must leave the Premises, and its contents, in the same condition as they were upon the Arrival Date, ordinary wear and tear excepted. Should any secondary ‘amenities’ i.e. Jacuzzi, BBQ, Air Conditioning, etc. be out of service for any reason prior to or during Guest’s stay, Property Manager and the Owner will do everything possible to remedy any issues as quickly as possible. This is NOT grounds for cancellation or refund.
- 5. Property Manager. Owner has hired an independent property manager. All questions and concerns relating to the Rental Home, Amenities, and Premises should be directed to the manager once Guest is on island.
- 6. Right To Enter. The Property Manager or our designated agents/contractors may enter the Property or Rental Home in order to inspect, make needed or agreed-upon repairs, decorate, change, or improve the Property or Rental Home, supply utility, and other services if necessary.
- 7. Payment for service and activities packages is required at the time of confirmation. Payment is due either 30 days prior to arrival or upon receipt of the estimate if the arrival is within 30 days. Payment methods accepted include ACH, credit card, or wire. Please note, a non-refundable 3.5% bank service fee will be added to invoices if paying by credit card. If guests add services or activities during their stay, a final bill will be presented 3-5 days after check-out.
- Credit Card On File: A credit card on file is required in the event additional services or activities are added during the guest's stay, in addition to confirmed payments. No charges will be billed to this card until the final service/activity invoice is sent. Guests will have the opportunity to pay by ACH, credit card, or wire upon reviewing final invoices.
- Services Cancellation Policy: Cancellation policies vary per provider and will be outlined in the quotes provided by your Concierge. "Private Tours" and "Private Chefs" may have stricter cancellation policies. Below is a general guideline for cancellation policies:
- - In-Home Services and Island Activities: 72 hours to 2 weeks
- - Private Chef Services: 2 weeks (14 days from the first scheduled meal)
- A 4hr minimum charge for chef/assistants per canceled meal will be billed. Food costs will be reimbursed in full unless purchased food cannot be returned.
- Holiday Pricing and Cancellations (Easter, July 4th, Thanksgiving, Dec 18th - Jan 3rd):
- - In-Home Services and Island Activities: 72 hours to 2 weeks (vendor/requests dependent)
- - Private Chef Services: 1 month (30 days from the first scheduled meal)
- Holiday Pricing for In-Home Services will be at a rate of Time and a Half (1.5x).
- 8. Additional Terms and Conditions. The Additional Terms and Conditions set forth in Exhibit “A” are incorporated herein by this reference. Violation of the Additional Terms and Conditions may result in additional charges to Guest.
- 9. Tust and Safety Fee (Vacation Rental Insurance). The Trust and Safety Fee is a required vacation rental insurance policy provided by Safely. For details on the insurance policy and coverage, please visit www.safely.com/purekauai

- Additional Terms and Conditions:
- 1. Smoking Policy. Smoking is not allowed anywhere inside the Rental Home or within 20 feet of any buildings on the premises.
- 2. Pets. No pets are allowed on the Premises.
- 3. Garage/Owner’s Possessions. If there is a garage, unless noted otherwise, the garage is set aside for exclusive use by the Owner; Guest is not allowed to use the garage or any of its contents without Owner’s express written permission.
- 4. Vehicles. Free Parking is available on/at the property. Maximum number of vehicles is determined in the Rental Rules. DO NOT park on grass or on roadways. Park only in driveway or designated parking areas.
- 5. No Shoes in Rental Home. Following Hawaiian custom, Guests are expected to remove their shoes before entering the Rental Home.
- 6. Wood Floors. The Rental Home has soft, high-gloss wood floors and/or sensitive tile and stone. In order to avoid damage to floors, please CARRY luggage inside the Rental Home and do not drag, roll or slide on floors.
- 7. Furniture and Fixtures. DO NOT move furniture in the Rental Home without permission and/or assistance from Property Manager staff or Property Manager. Indoor furniture may not be moved outside, and outdoor furniture may not be moved inside. Any damage to floors, furniture, walls, etc. or caused by sand may result in Guest charges.
- 8. Damage Caused by Guest. Guest shall be responsible and liable for all acts of, and damage and injury caused by, Guest's family, invitees, guests, agents, or other persons invited onto the Property and/or the Vacation Accommodation. Guest shall indemnify and hold Owner, Property Manager, the Property Manager and their agents harmless from and against all claims and demands for loss or damages, including property damages, personal injury or wrongful death, arising out of or in connection with this Agreement and the use or occupancy of the Property or the Vacation Accommodation by or through Guest during the term of this Agreement, or otherwise relating to the malfeasance or misfeasance of Guest or any of Guest's family, invitees, guests, or agents. Such indemnity shall include all costs, attorneys’ fees, expenses and any other liability incurred in connection with any such claims and demands.
- 9. Prompt Reporting of Problems/Defects. Guest agrees to immediately report any fire, flooding, problems, damage, or defects on or about the Premises to Property Manager or Property Manager. Any damage caused by Guest’s failure to report any problems or defects shall be Guest’s responsibility.
- 10. Guest's Belongings. Guest understands that our insurance does not cover Guest belongings or any damage that you may cause to the Property or the Vacation Accommodation. Guests agrees that Owner, Property Manager and the Property Manager are not responsible for loss, theft or damage of personal property, and no refunds will be given for any such occurrences. Guest and all other occupants of the Vacation Accommodation have been advised to always lock and secure the Vacation Accommodation. Guest agrees to either carry insurance covering all of your property located on the Property or in the Rental Home or to bear full responsibility for damage thereto, including damage from fire, water, theft, or any other cause.
- 11. Noise Restrictions. Under no circumstance shall loud noises be allowed after 9:00 p.m. or before 8:00 a.m. This restriction includes use of amplified music and drumming. Neighborhood noise citations may incur a Guest fine.
- 12. Care of Premises. Guest is expected to care for the Premises as if it were their own. Guest acknowledges that weekly pool and/or grounds maintenance will occur one or more day per week. Grounds maintenance includes mowing, weeding and the use of other machinery. Please close all doors and windows when leaving the Premises so as to avoid rain/water coming into the house, loss of property, etc.
- 13. Cooking. Guests may only cook in areas designated for cooking. (i.e. kitchen, BBQ area)
- 14. Subletting; Assignment. Guest may not sublet or allow anyone else to occupy the Rental Home or replace Guest as Guest unless Guest has procured Property Manager’s advance written permission. Guest may not assign this Agreement.
- 15. Keys. Guest will be provided with one (1) set of entrance keys, which keys must be returned to Property Manager, or left in the lock box, or kitchen counter when Guest vacates the Rental Home. No duplicate keys may be made or locks changed or added. If Guest fails to return the keys, Guest shall be responsible for all replacement costs for new keys and exterior door locks. If Guest is provided gate access cards or remote controls, it is Guest’s responsibility to return such cards and remotes upon departure or replacement costs will be incurred.
- 16. Currently Listed Property. IF the home is currently listed for sale at the time of the Guest occupancy, there could be requests made for showings. Owner or Property Manager will give 24 hours notice for any potential showings. In the unlikely event the home is sold prior to the date of Guest’s arrival, Owner & Property Manager will make every effort to have new owners honor all bookings OR Owner will make every effort, along with Property Manager to find a comparable home for the dates of the stay. Should no comparable home be found, all monies will be refunded to Guest.
- 17. Insects, Lizards, Roosters, Etc. Guest understands that there is a wide variety of plant, animal, and insect life on Kauai. You may see more insects, frogs, toads, centipedes, small lizards (geckos), roosters & chickens during your stay here than you are accustomed to seeing & hearing. Be advised that this is commonplace and shall not warrant relocation, refunds or financial compensation.
- 18. Indemnification; Hold Harmless. Guest agrees to indemnify and hold harmless Owner and Owner’s members, agents, employees, independent contractors and invitees from and against any liability for personal injury or property damage sustained by any person (including Guest’s visitors or invitees), as a result of any cause, unless caused by the negligent or willful act of Owner. Guest agrees that Owner may enter the Premises during reasonable hours to inspect the Premises, to make such repairs, alterations or improvements thereto as Owner may deem appropriate.
- 19. Severability. If any part of this Agreement shall be declared illegal, void or ineffective for any reason, then the same shall be deemed null and void and the remaining provisions of this Agreement shall continue in full force and effect.
- 20. Attorney’s Fees. In any legal action brought by either party to enforce the terms hereof or relating to the Premises, the prevailing party shall be entitled to all costs incurred in connection with such action, including reasonable attorney’s fees and costs.
- 21. Waiver. The failure of Owner to enforce any term of this Agreement shall not be deemed a waiver. The acceptance of rent by Owner shall not waive Owner’s right to enforce any term hereof.
- 22. Legally Binding. Guest agrees to abide and fulfill all parts of this Agreement, and furthermore agrees that it is a legally binding agreement. If Guest does not understand any portion of this Agreement, Guest should consult an attorney. This Agreement supersedes all prior oral discussions, written information, emails, or fax communications. All parties agree that in the event of a dispute, this Agreement will be interpreted in accordance with Hawaii law.
- 23. Facsimile & Electronic Signatures. Facsimile and Electronic signatures on this Agreement and any addenda or other documents related to this Agreement shall be binding and effective for all purposes and treated in the same manner as physical signatures.
- 24. Construction. Property Manager and Owner are not responsible for any inconvenience caused by construction noise and/or activity in the vicinity of the Property. Guest may call Property Manager to inquire as to the status of any neighboring construction. Any refunds due to a cancellation resulting from construction activity shall be subject to the Cancellation Policy.
- 25. Ocean Risks. The Property is in the general vicinity of the Pacific Ocean. Guest understands that there are risks inherent to persons and property located adjacent to the ocean. Guest and Guest's family, invitees, and guests shall make use of the ocean at their own risk. Ocean waves and undercurrents can be especially strong. Caution should be exercised when near or in the ocean. IF THE HOME IS LOCATED IN HANALEI OR ANIN BEACH AREAS, THIS IS THE TSUNAMI EVACUATION ZONE. PLEASE REFER TO EVACUATION INSTRUCTIONS AND SHELTER LOCATIONS POSTED INSIDE THE FRONT DOOR OF THE HOME.
- 26. Land Risks. The property may contain water features, ponds, pools, jacuzzis, rivers, lakes, ocean access, etc., which are dangerous and may not be protected by fencing, guard rails or signs. The Property may also contain trees and foliage which could have falling branches, fruit, coconuts, etc. The Property may also have or be near dangerous cliffs, valleys, trails, rocks, property decorations, etc. Guest and Guest’s family, invitees, and guests are aware of such risks and use the property and surrounding areas at their own risk.
- 27. TSUNAMI EVACUATION ZONE WARNING - if the property is located in the tsunami zone, there will be a tsunami evacuation route inside the front door of the home.
- FORCE MAJEURE:
- I. If forces beyond Property Manager’s reasonable control, e.g., storms (i.e. floods, hurricanes, etc.), road closures, transport strikes, pandemics, etc., cause the Guest’s vacation to be extended or otherwise changed, the Guest is responsible for any extra costs associated with such changes, e.g., extra lodging, and transportation.
- II. In the unlikely event the entire vacation is canceled due to circumstances beyond Property Manager’s reasonable control (i.e. floods, hurricanes, etc.), Property Manager shall use best efforts to provide alternative travel dates, or refund any monies that are refundable.
- III. In the event the Rental Home you rented is sold and the new owner does not honor the reservation, Property Manager will either refund all monies or will make every reasonable effort to secure a comparable Vacation Home. Due to the unique nature of our homes, Property Manager cannot not guarantee an exactly comparable home.
- IV. Property Manager is not responsible for any costs incurred by Guest for airfare/transportation or other travel expenses for trip cancellations for any reason.
- V. In the event that the Kuhio Highway closes as a result of road work, flooding, bridge closure, landslide, or any other event outside of Property Manager’s control, Property Manager is NOT responsible for finding or paying for guests’ expenses incurred as a result of the inability to reach the home.
- RELEASE OF KNOWN & UNKNOWN CLAIMS: Sporting activities, including, but not limited to swimming, snorkeling, hiking, kayaking, surfing, paddling, weightlifting, Pilates, and yoga may result in injuries or damages to Guest and/or others. There are inherent dangers in sports and related activities. Guests agree to use common sense at all times while on the vacation. Guest’s participation in such sporting or other activities is entirely voluntary, and if Guests choose to participate in such activities, Guests do so at own risk. By agreeing to this Agreement, Guests and Guest’s children, parents/guardians, if applicable, agree that Property Manager and the Rental Home Owner shall not be liable for any damage, loss or injury that may result from your participation in any such activities. Guests also agree to hold Property Manager and Rental Home Owner harmless for any reactions the Guest may have to products used during massages, facials, or any other spa treatment. Property Manager does not provide medical insurance to Guests and assumes that each Guest has medical insurance.
- MEDICAL RELEASE: Guest agrees that Guest has either had a physical examination within the past six months and has been given Guest’s physician’s permission to participate in activities selected by Guest or has chosen to participate in activities (including use of equipment and machinery) without the approval of Guest’s physician. Guest does hereby assume all responsibility for participation in activities selected by Guest (including use of equipment and machinery). If Guest becomes ill or injured while on the vacation, the Guest, and Guest’s children, parents/guardians, if applicable, agree that Property Manager shall have the right, but not the duty, to take reasonable action to secure emergency medical attention and/or transportation for the Guest. The Guest agrees to pay for any expense incurred for such medical attention, transportation, or other related emergency services and to reimburse Property Manager for any such payments made or incurred by Property Manager. Any and all medical expenses incurred by the Guest are the sole responsibility of the Guest.

- Aloha and Welcome to the Beautiful Garden Island of Kauai
- Though you may see similar information in your accommodations agreement, some information bears repeating. You are staying in a residential neighborhood. We want your visit to be safe and enjoyable for both you and your neighbors.
- 1. Be Good Neighbors:
- a) Please keep noise to a minimum. Elevated noise activities or amplified music shall not be permitted before 8:00 AM and after 9:00 PM. Your neighbors probably have to go to work the next day, so please be considerate.
- b) Turn off outdoor lights at night whenever possible. We enjoy our dark nights when the stars are bright and beautiful. Of equal importance, our wildlife (particularly seabirds) becomes disoriented at night if lights are too bright.
- c) Hawaii has a non-smoking ordinance. There is no smoking within 20’ of all public buildings. Some of our homes and condominiums also have a smoking ban. Please check your house rules.
- d) Whenever possible, please recycle. Many of our rental accommodations include recycling containers. If none are available, all of our transfer stations offer recycling. As in other communities, our landfills are stretched to their limits. Anything you can do to help will be appreciated for generations to come.
- 2. Beach Safety: Be mindful of the surf. Our shorelines face thousands of miles of open ocean. Northern Winter storms and southern Summer storms can bring us extremely dangerous surf conditions. NEVER turn your back on the ocean, Summer or Winter. Rogue waves can appear even in calm surf conditions. You can check ocean conditions at www.KauaiExplorer.com/ocean report. There are lifeguards at Haena Beach Park, Hanalei Pavilion, Lydgate, Poipu Beach Park, Salt Pond and Kekaha. For your family’s safety , we advised that you check with lifeguards before going into the ocean. If you are at a non-guarded beach, at least check with local residents who are there regarding unseen currents or other dangers.
- 3. 9-1-1: In case of fire or medical emergency, call 9-1-1. A fire extinguisher can be found mounted by the exit identified on the Emergency Escape Plan. The address and phone number of the accommodation is posted on the inside of the front door. The phone number for Wilcox Hospital in Lihue is 245-1100.

- 4. Weather: We do experience flash flooding during periods of heavy rain. If you must drive in this kind of weather, drive with extreme caution. Flash floods can cause the road out of Hanalei to close for undetermined periods of time. For up-to-date Traffic and Weather Information, please call 241-1725.
- 5. Disasters Emergencies: IF THE HOME IS LOCATED IN HANALEI OR ANIN BEACH AREAS, THIS IS THE TSUNAMI EVACUATION ZONE. PLEASE REFER TO EVACUATION INSTRUCTIONS AND SHELTER LOCATIONS POSTED INSIDE THE FRONT DOOR OF THE HOME. On the first business day of each month at 11:45 AM, our Civil Defense sirens are tested. However, if you hear these sirens at any other time, please tune to AM radio station KQNG (“KONG”) at AM 570 or FM 93.5 for up-to-the-minute reports and instructions. Also, the front of the Kauai phone book has emergency, disaster, evacuation and shelter information.
- 6. Security: Be cautious with your personal belongings. It is always best to lock up your valuables in the trunk of your car. Lock your doors and windows when you leave the property.
- 7. Island Driving Etiquette:
- a) Please honor the posted speed limits. Frequently check your rear view mirror. If more than 4 or 5 cars are stacking behind you, pull completely off to the side of the road and let them pass. This can also help you when driving at night as our dark roads can be confusing. The cars following you likely know where they are going and can help light the way for you.
- b) If you are lost, remember that this is a small island and you will find your way soon. Keep driving until you find a safe place to pull over and turn around. If you can head downhill, you will get to the ocean within a few miles. Never make a U-Turn on the highway.
- c) When navigating the one-lane bridges, cross the bridges caravan style. It is usually appropriate for 5 or 6 cars to cross at a time. A simple rule of thumb is: Drain the Lane, If you arrive Late-Wait.
- d) When parking at the beaches, parks or even within the property you have rented, be careful to park fully off the street, in assigned or clearly marked parking spaces.
- e) If you want to stop to enjoy the scenery, please pull completely off to the side of the road.
- f) All vehicular parking related to this use and property, including maintenance vehicles, shall be accommodated on the subject property at all times. On-street parking shall not be permitted at any time.
