Payment and Cancellation - 60 Day Policy

Grace Period:

  • Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation request, and (2) reservation request was made at least 10 days before arrival.

Payment Policy:

  • 60 days or less prior to arrival: Guests pay 100% at time of reservation.
  • More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
  • For guests paying with points: 100% of payment will be deducted at time of reservation, once booking is verified within 48 hours.

Cancellation Policy:

  • 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
  • More than 60 days before arrival: 100% refund.

House Rules

  • 1. Property. Rental Agent agrees to lease to Guest, and Guest shall lease from Rental Agent, the Property as set forth above. The Property contains [#] bedrooms and [#] bathrooms. The following areas of the Property are excluded from this Agreement: caretaker buildings, any secured storage areas, and any mechanical or work areas. The maximum occupancy of the Property is [#] people (adults and children). If the Property is occupied by more than [#] people, Rental Agent may in Rental Agent’s sole and absolute discretion declare Guest to be in breach of this Agreement, require all persons occupying the Property to immediately leave the Property or be removed from the Property, and/or add a charge of $1,000 to the Guest credit card. Guest will automatically forfeit the right to the return of any unused Rental Fees. The use of the Property shall be restricted to residential use for a leisure vacation. The Property shall not be used for commercial purposes without the express written authorization of Rental Agent.
  • 2. Term. The Property shall only be occupied as an immediate short-term vacation domicile for the term commencing on, [date] at 4:00PM (“Commencement Date”) and terminating on, [date] at 10:00 AM (“Rental Period”).
  • 2.1 Check-In/Check-Out Time. Check-in time is 4:00 PM. Unauthorized early check-ins are deemed to be a trespass and may be subject to the cancellation of the reservation and forfeiture of all deposits paid hereunder and/or charged a fee equal to 200% of one night’s rental fee which will be charged to Guest’s credit card. Any unauthorized check-outs after 10:00 AM will be charged to the Guest credit card as per charges below. Unauthorized check-outs after 6:00 PM will be deemed hold-overs and charged a fee equal to 150% of one night’s rental fee which will be charged to the Guest credit card. Check-out time is 10:00 AM. Early or late arrivals and departures must be arranged with the Rental Agent in writing in advance. If Rental Agent is able to accommodate an early check-in and/or late check-out the following fees will apply: (a) early check-in shall incur an additional fee of $200; (b) check-out between 10:00 a.m. and 1:00 p.m. shall incur an additional fee equal to $35 per bedroom in the Property; and/or (c) check-out between 1:01 p.m. and until 4 p.m. shall incur an additional fee equal to $50 per bedroom in the Property. There will be no holding over or late departure without prior approval by Rental Agent.
  • 2.2 Force Majeure. Although Rental Agent will make every effort to have the Property ready for Guest-occupancy by check-in time on the Commencement Date, it may not be possible to do so for reasons beyond Rental Agent’s control (such as where a prior guest has not vacated the Property at the expiration of such other guest’s rental period). If Rental Agent cannot deliver possession of the Property when required to under this Agreement, Rental Agent shall promptly refund to Guest the Rental Fee for the applicable period during which the Property is not available to Guest. If for any reason beyond the control of Rental Agent the Property becomes unavailable during the Rental Period, Rental Agent may cancel this Agreement and refund in full to Guest all payments made hereunder by Guest. Rental Agent will make commercially reasonable efforts to provide suitable equivalent lodging.
  • 3. Credit Card Authorization; Fees.
  • 3.1 Credit Card Authorization. Guest hereby authorizes Rental Agent to charge all deposits, fees, costs and charges arising under this Agreement to the Guest’s credit card provided to Rental Agent. The reversal of any charges to Guest’s credit card arising under this Agreement shall constitute a breach of this Agreement by Guest. In the case of any reversal of charge by Guest, this provision shall serve as express permission to Rental Agent to recharge the Guest’s credit card for payment or to collect such fees, costs and charges by any other legal means. Guests shall be charged a 3.5% credit card processing fee for all amounts in excess of $5,000 that are paid by credit card.
  • 3.2 Rental Fee. The total anticipated fees for renting the Property, including rent, taxes, service fee, cleaning fees (if any), damage insurance and (if selected, optional and at additional cost) Ski & Mountain Travel Insurance for the Rental Period is {{formatCurrency reservation.totalinsurance currency}} (“Rental Fees”). An initial deposit in an amount equal to 50% of the total Rental Fees (the “Initial Deposit”) is due at time of booking. A final deposit in an amount equal to the remaining balance of the Rental Fees (“Final Deposit”) shall be due no later than sixty (60) days before the Commencement Date (the “Final Deposit Due Date”)). Unless cancelled by Guest in accordance with Section 4, the Final Deposit shall be due and payable as of the Final Deposit Due Date and Guest authorizes Rental Agent to automatically charge and process the Final Deposit with credit card number provided by Guest unless other payment arrangements have been made.
  • 3.3 Damage Insurance/Security Deposit. In lieu of a security deposit, Rental Agent requires Guest to pay a SafelyStay, Inc. Trust and Safely Fee for damage insurance up to $10,000 of coverage for contents damage and up to $1,000,000 coverage for property damage and bodily injury, unless prior alternative and equivalent arrangements are agreed upon by Rental Agent. Guest hereby authorizes SafelyStay, Inc., to verify Guest’s identity and check criminal databases subject the terms and conditions found at Any deductible or minimum claim amount will be the responsibility of the Guest, and Rental Agent will process using the form of payment on file for Guest. If Guest does not participate in the Damage Insurance plan, the Guest will be required to provide a security deposit for $10,000 (“Security Deposit”) which shall be payable by Guest sixty (60) days prior to arrival and held in escrow until a post-departure inspection of the Property by Rental Agent. Any amount refunded will be contingent upon the Property post-departure inspection, to be completed by Rental Agent. The Security Deposit is intended to cover damage to the Property resulting from Guest occupancy of the Property. Any damage repair costs that exceed the Security Deposit amount will be charged to Guest’s credit card.   • 3.4 Additional Fees. The Guest credit card will be charged for all additional fees and costs incurred set forth below:
  • 3.4.a Lost Keys/Parking Passes/Garage Door Openers. Guest shall be responsible for a fee in the amount of $100 for each key, parking pass and/or garage door opener provided to the Guest for the Property that is not returned to the Rental Agent, plus the actual cost of replacement of the key, parking pass or garage door opener, which may include the costs of re-keying locks.
  • 3.4.b Excess Cleaning Fees. If the Property is not left in a clean condition, normal wear and tear excepted, Guest will be charged for an excess cleaning fee in an amount equal to the actual excess charges incurred by Rental Agent to have the Property properly cleaned and restored to the condition it was in as of the Commencement Date as a result of the Guest occupancy.
  • 3.4.c Unauthorized Events. Unauthorized events will subject the guest to eviction and/or a charge equal to ES's standard event pricing plus $100 per person over occupancy, as determined by ES.
  • 3.4.d Smoking Policy Violations. Guests violating the Smoking Policy set forth below will be charged a minimum cleaning fee of $500.
  • 3.4.e Pets. If Guest is in breach of the Pet Policy set forth below, Guest forfeits all rights to any unused Rental Fees. In addition to such forfeiture and those remedies set forth below, Guest will also be charged a fee of not less than $1000 and will be charged for all costs reasonably necessary to restore the Property to its original condition from prior to the breach. Any acceptance of a pet-stay by Rental Agent will incur an additional pet cleaning fee and require a separate security deposit. This amount is based off the size and breed of the pet(s) and will be as agreed to in writing by the parties.
  • 3.4.f Hot tubs/Pools. If any external; liquids or solids are found present in a hot tub or pool, Guest will be charged $500 to drain/refill.
  • 3.4.g Any damage to the Property caused by ski boots or other improper footwear shall be repaired at the cost of the Guest.
  • 3.4.h Hold Overs. Any unauthorized holding over by Guest will be subject to a charge of 150% of the daily rack rate of the Property as published on the Rental Agent websites and, plus any additional damages incurred such as the cost of alternate housing for guests displaced by Guest holding over, which shall be billed to the Guest’s credit card. Guest shall have no right to hold over beyond the check-out time, and if Guest does not vacate as required such failure shall be deemed a default and Guest’s occupancy shall not be construed to effect or constitute anything other than a tenancy at sufferance. No option to extend this Agreement shall have been deemed to have occurred by Guest’s holdover. In addition, if Guest fails to vacate and surrender the Property on or before the check-out time, Guest shall indemnify, defend, and hold harmless Rental Agent from and against any and all costs, losses, expenses, or liabilities incurred as a result of or related to such failure, including without limitation, claims made by any succeeding guest and reasonable attorneys’ fees.
  • 4. Cancellation; Refunds. GUEST IS ADVISED TO CLOSELY READ THE FOLLOWING CANCELLATION PROVISIONS WHICH WILL BE STRICTLY ADHERED TO. Guest may cancel this Agreement by sending written notice of cancellation to Rental Agent via mail or email. Guest acknowledges that by entering into this Agreement, the Rental Agent and the owner of the Property have relied upon Guest’s reservation of the Property and have ceased marketing and advertising the Property for rent to other parties for the Rental Period.
  • 4.1 Pre-Final Deposit Due Date. If the Rental Period is less than thirty (30) nights, and if Guest gives proper notice of cancellation PRIOR to the Final Deposit Due Date or 60 days before arrival, the entire Initial Deposit shall be refunded to Guest, less an amount equal to one night's rent, taxes and the service fee. If the Rental Period is equal to or greater than thirty (30) nights, the entire Initial Deposit shall be NON-REFUNDABLE. For stays at 135 Hood Park Rd. the final deposit due date shall always be set at ninety (90) days before arrival.
  • 4.2 Final Deposit Due Date and Onwards. If Guest cancels this Agreement AFTER the Final Deposit Due Date, GUEST SHALL NOT BE ENTITLED TO THE REFUND OF ANY PORTION OF ANY DEPOSITS PAID BY GUEST AND GUEST SHALL BE LIABLE FOR THE FULL AMOUNT OF THE FINAL DEPOSIT. If the Final Deposit has NOT been paid by the Final Deposit Due Date and Guest cancels this Agreement after the Final Deposit Due Date, Rental Agent shall be authorized to charge Guests credit card for the entire Final Deposit, plus a 3.5% credit card processing fee on the entire amount of the Final Deposit.
  • 4.3 Trust and Safely Fee. The Trust and Safely Fee is refundable only if the reservation is canceled in writing at least twenty-four (24) hours prior to the Commencement Date.
  • 5. Optional Travel Insurance. Guest acknowledges that neither Rental Agent nor the owner of the Property carry insurance that covers any of Guest or Guest’s invitees personal property, including vehicles, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause, except for injury or damage caused by the gross negligence or willful misconduct of the Rental Agent or the owner of the Property. Rental Agent strongly recommends purchasing this protection. Ski & Mountain Travel Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. Trip Inconvenience coverage is available if the resort is forced to close its primary attractions during your trip due to a lack of snow or severe weather. The plan also includes other valuable in-trip coverages such as Medical and Dental, Sporting Equipment, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance.   • 6. Use and Maintenance.
  • 6.1 Guest Inspection. Guest acknowledges that, unless the Rental Agent is notified immediately upon occupancy, the Property including the furniture, furnishings, and appliances shall be deemed to be in good working order, condition and repair. Any defect, damage or fault not reported by Guest to Rental Agency within the first twenty-four (24) hours from check-in will be deemed waived and ineligible for a refund. Guest shall keep the Property in a clean and sanitary condition, and shall immediately notify Rental Agent of any damage to the Property or its contents, or any inoperable equipment or appliances.
  • 6.2 Use. Guest shall not violate any criminal or civil law, ordinance or statutes in the use and occupancy of the Property, commit waste or nuisance, annoy, molest or interfere with any neighbor or other occupant of Telluride or violate the rules and regulations of Telluride, including the use, possession, production or sale of illegal drugs. Guest further agrees to adhere to all rules and regulations set forth by the regulatory parties for the condominium complex or homeowners association in which the Property is located (if any), including rules with respect to smoking, noise, odors, disposal of refuse, pets, parking and use of common areas. Events are not allowed unless approval is granted in writing by Rental Agent. Any such action may result in the immediate termination of this Agreement as provided herein and by law. No repairs, decorating or alterations shall be done by Guest. The Property will be in clean and orderly condition as of the Commencement Date. If Guest desires to have a mid-stay cleaning(s) of the Property, the Guest must make those arrangements through the Rental Agent with at least thirty (30) days advance notice, at Guest’s additional expense. Guest must leave the Property in reasonably clean and orderly condition. Guest shall surrender the Property, at termination, in as good condition as received, normal wear and tear excepted. Guest hereby acknowledges and agrees that insurance policies of the Rental Agent and the owner of the Property do not cover any Guest personal property.
  • 6.3 Ski Boots Advisory. Please be advised that ski boots cause substantial damage to Property interiors. Wearing ski boots inside the Property is strictly prohibited, except in entryways, ski rooms, and mudrooms. Guests are also requested to refrain from wearing shoes inside the Property. Guests are encouraged to bring slippers or other appropriate indoor footwear for use during Guest occupancy of the Property.
  • 6.4 Smoking Policy. Smoking anywhere on the premises of the Property (inside or outside) is strictly prohibited at all times. Smoking includes cigarettes, vaping, and marijuana products. The Guest shall be responsible for all damage caused by smoking, including but not limited to, stains, burns, odor, and removal of debris. Guest may be further liable for any nuisance caused to neighbors or other surrounding properties arising from the presence of smoke and/or odors. Upon violation of this Policy, Guest may be required to immediately leave the Property, or be removed, in which case the Guest forfeits all rights to any unused Rental Fees.
  • 6.5 Pet Policy. Pets are not allowed in or on the Property unless the Property has been designated “Pets Considered or Pet Friendly” and Guest has obtained the requisite written permission from Rental Agent. The Guest shall be responsible for all damage caused by a pet, whether or not such pet has been properly authorized. Violation of this Policy may result in Guest and his/her invitees being required to immediately leave the Property or being removed, in which case the Guest shall forfeit all rights to any unused Rental Fees. Even if the Property is “Pets Considered” or “Pet Friendly,” this does not guarantee any particular pet(s) will be accepted.
  • 6.6 Hot Tubs/Pools. Pools and hot tubs are serviced prior to Guest arrival. Rental Agent recommends showering prior to using to maintain clean water and avoid drain/refill during Guest stay. The use of hot tubs, pools, saunas, spas and steam rooms within the Property is at the Guest's own risk. The Property is located at a high elevation and Guests are urged to exercise caution when using these types of amenities. Proper precautions and acclimatization to altitude are recommended.
  • 6.7 Parking; Bikes. Guest shall use only those parking spaces designated for their use by Rental Agent. Bikes and similar transportation devices cannot be stored inside the home at any time.
  • 7. Rental Agent Entry and Inspection. Rental Agent and Rental Agent's employees, contractors and agents will have the right to enter the Property at any time in case of emergency. Rental Agent and Rental Agent’s employees, contractors and agents shall further have the right to enter the Property upon twenty-four (24) hours’ notice (or such shorter time period as may be agreed to by Guest), to make necessary or agreed repairs, decorations, alterations, improvement, supply necessary or agreed upon services, and/or inspect the condition of the Property.
  • 8. Property For Sale. All properties for sale by their respective owners include a disclosure to that effect on the property’s designated page on Rental Agents website. If the Property is listed for sale, Rental Agent shall have the right to enter the Property and to allow prospective or actual buyers, lenders, agents and brokers of the owner of the Property to enter the Property upon twenty-four (24) hours’ prior notice to Guest. A representative of Rental Agent or the owner of the Property shall accompany prospective or actual buyers, lenders or guests at all times. Guest agrees to cooperate with Rental Agent and the owner of the Property when providing access to the Property. In the event that the owner sells its interest in the Property (or enters into an agreement to do so), Rental Agent may terminate this Agreement provided it provides to Guest written notice of its election to so terminate this Agreement no less than one hundred and eighty (180) days prior to the Commencement Date. In the event of such termination, a check for the full refund of all deposits paid by Guest to Rental Agent shall accompany the termination notice.
  • 9. Construction Disclaimer. Telluride and Mountain Village are growing resort communities. There is a possibility that various construction projects that may be ongoing during Guest’s stay that Rental Agent has no control over. Rental Agent shall use its best efforts to notify Guest of any construction projects in the vicinity of the Property that may impact the Property at the time of booking; however, Rental Agent makes no representations or warranties as to the future status of construction projects that may impact Guests during their occupancy of the Property.
  • 10. Indemnification And Waiver. Guest hereby agrees to indemnify, defend, release and hold harmless the owner of the Property and Rental Agent (the “Indemnitees”) from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest, Guest’s invitees, pets and any personal property of any of the foregoing relating to occupancy or use of the Property except for injury or damage caused by the gross negligence or willful misconduct of the Indemnitees. The Indemnitees will not be liable for any damage or injury to Guest, or any other person, or to any personal property, occurring on the Property, unless such damage is the legal result of the gross negligence or willful misconduct of the respective Indemnitee. The waiver and release is intended to be a full and complete waiver and release of the Indemnitees from any and all present or future claims (known or unknown), except as expressly set forth herein.
  • 10.1 Guest Responsibility for Invitees. Guest agrees to ensure that any invitee of Guest complies with all provisions of this Agreement applicable to the conduct of Guest while using the Property. Guest shall be liable, and Rental Agent shall have the right to recover, for any act or omission by Guest’s invitee in violation of the terms of this Agreement as if such act or omission had been performed by Guest.
  • 11. Confidentiality. The terms, conditions and information set forth in this Agreement, including without limitation the names of the Guests and owner, and the existence of this Agreement, shall be held in strict confidence by the parties hereto, and such information shall be only disclosed as required by applicable law.
  • 12. Default. If either party materially breaches this Agreement (including, without limitation if Guest fails to pay any deposit, rent or cost when due, or perform any term hereof), may terminate this Agreement immediately after three (3) days’ written notice of such default that remains uncured. In the case of Guest violating Section 6, Guest shall immediately desist in such violation or be subject, at Rental Agent’s option, to immediate eviction from the Property and termination of any rights under this Agreement.
  • 13. Dispute Resolution. Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, as a condition precedent to the institution of any arbitration or litigation under this Agreement. Mediation fees, if any, shall be divided equally among the parties involved. Mediation shall take place in San Miguel County of Telluride, Colorado. In any action or proceeding involving a dispute between Rental Agent and Guest arising out of this Agreement, the prevailing party will be entitled to reasonable attorney fees and any costs incurred in enforcing this Agreement.
  • 14. Notices. Unless otherwise provided, any notice which either party may give or is required to give, may be given personally or by mailing the same, postage prepaid to Rental Agent or Guest at the address shown in the signature block or at such other places as may be designated by the parties from time to time. Notice may also be provided by email with receipt confirmation, to be accompanied by any of the foregoing hardcopy options. Notice will be deemed effective three (3) days after mailing, or on personal delivery, or when receipt is acknowledged in writing.
  • 15. Miscellaneous. Guest agrees time is of the essence in this Agreement. Failure of Rental Agent to enforce any provision of this Agreement shall not be deemed to be a waiver. The acceptance of any fees or deposits by Rental Agent will not waive Rental Agent’ s right to enforce any provision of this Agreement. This Agreement, plus any attachments or addendums hereto, constitutes the entire agreement between the parties and may be modified only in writing signed by all parties. This Agreement and any modification, including any photocopy or facsimile, may be signed in one or more counterparts, each of which will be deemed an original and all of which taken together will constitute one and the same instrument. If there is more than one Guest, all Guests are jointly and severally liable under this Agreement. This Agreement is not a lease of the Property, but rather a limited license to occupy the Property upon the terms and conditions set forth herein. Guest has no rights to assign or sublease, in any manner, the Property or any portion thereof. This Agreement may not be assigned by Guest without Rental Agent’s prior written consent. Guest shall be strictly prohibited from charging any third party for the use of the Property under any circumstances. In the event that Guest violates this Section 15, this Agreement shall be immediately and automatically terminated by Rental Agent and Guest shall be required to immediately vacate the Property and the Rental Agent shall be entitled to retain all funds paid by Guest.
  • 16. Voluntary Obligation of Eligible Guest. It is the policy of Rental Agent that all Guest(s) must be at least 25 (twenty-five) years of age to be eligible to enter into this Agreement for the short-term rental of the Property. Guest hereby represents and warrants that he/she is at least 25 years of age of age at the time of execution of this Agreement, and that Guest enters into this Agreement knowingly and voluntarily, having read and understood all terms and conditions set forth herein.
