Payment and Cancellation - 60 Day Policy

Grace Period:

  • Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation request, and (2) reservation request was made at least 10 days before arrival.

Payment Policy:

  • 60 days or less prior to arrival: Guests pay 100% at time of reservation.
  • More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
  • For guests paying with points: 100% of payment will be deducted at time of reservation, once booking is verified within 48 hours.

Cancellation Policy:

  • 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
  • More than 60 days before arrival: 100% refund.

House Rules

  • Check­In/Check­Out Time. Check-in time is 4:00 PM. Check-out time is 10:00 AM. Early or late arrivals and departures may be arranged with the Rental Agent in advance. Any unauthorized check­outs between 1:00 PM and 6:00 PM will be charged a fee equal to 50% of one night’s rental fee which shall be charged to the Guest’s credit card. Unauthorized check­outs after 6:00 PM will be deemed “hold­overs” and charged a fee equal to 150% of one night’s rental fee which will be charged to the Guest’s credit card. Unauthorized early check­ins are deemed to be a trespass and may be subject to the cancellation of the reservation and forfeiture of all deposits paid hereunder and/or charged a fee equal to 200% of one night’s rental fee which will be charged to the Guest’s credit card. If Guest need to check in earlier than 4:00 PM or check out after 10:00 AM, the Guest must receive prior approval from the Rental Agent.
  • Delay in Tender of Possession. Although Agent will make every effort to have the Premises ready for Guest’s occupancy at the beginning of the term of the Rental, it may not be possible to do so for reasons beyond Agents control (such as where a prior guest has not vacated the Premises at the expiration of term of such other guest’s rental). If Agent cannot deliver possession of the Premises when required to under this Agreement, Agent shall promptly refund to Guest the Rent for the applicable period during which the Premises are not available to Guest.
  • Travel Insurance. Ski & Mountain Travel Insurance has been made available with your reservation. Ski & Mountain Travel Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. Trip Inconvenience coverage is available if the resort is forced to close its primary attractions during your trip due to lack of snow or severe weather. The plan also includes other valuable in-trip coverages such as Medical and Dental, Sporting Equipment, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. Additional terms and conditions apply; please read your Description of Coverage/Policy carefully and contact CSA at (866) 999-4018 with coverage questions.
  • DAMAGE INSURANCE/SECURITY DEPOSIT/LOST KEYS. In lieu of a Security Deposit, Rental Agent requires each Guest to pay a $59 premium for Damage Insurance, unless prior alternative and equivalent arrangements are agreed upon by Rental Agent. If the Guest does not participate in the Damage Insurance plan, the Guest will be required to provide a Security Deposit equal to the amount shown on corresponding Guest's Reservation Confirmation provided by Rental Agent which shall be payable by Guest on {Folio.Arrival} and held in escrow until the post-departure. Amount refunded will be contingent upon Property's post-departure inspection, to be completed by Rental Agent. The Security Deposit is intended to cover damage to the Property resulting from Guest occupancy of the Property. Any damage repair costs that exceed Security Deposit Amount will be charged to the Guest's credit card.
  • Damage Insurance Plan. As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3000.00. Any damages that exceed $3000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.00. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy: www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage Protection plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. to pay directly Exceptional Stay any amount payable under the terms and conditions of the Vacation Rental Damage plan. Please contact Exceptional Stays directly if you do not wish to participate in this assignment.
  • By submitting payment for the Damage Insurance with the Initial Deposit, the Guest authorizes and requests CSA Travel Protection and Insurance Services (“Insurer”) to pay directly to Rental Agent and/or the Owner of the Property any amount payable under the terms and conditions of the Damage Insurance.
  • Lost Keys/Parking Passes/Garage Door Openers. Guest shall be responsible for a fee in the amount of $100 for each key, parking pass and/or garage door opener provided to the Guest for the Property that is not returned to the Rental Agent, plus the actual cost of replacement of the key, parking pass or garage door opener, which may include the costs of re-keying locks. The Guest’s credit card will be charged for all replacement fees and costs.
  • CLEANING FEE. The Property will be in clean and orderly condition as of the Commencement Date. Should cleaning not be included in stay per rental property description on ExceptionalStays.com, any desired mid-stay cleaning(s) of the Property but be arranged by Guest, the Guest must make those arrangements through the Rental Agent with at least thirty (30) days advance notice. Guest must leave the Property in reasonably clean and orderly condition.
  • If the Property is not left in a clean condition, normal wear and tear excepted, Guest’s credit card will be charged for an excess cleaning fee in an amount equal to the actual excess charges incurred by Rental Agent over and above the regular and customary Cleaning Fee to have the Property properly cleaned and restored to the condition it was in as of the Commencement Date as a result of the Guest’s occupancy.
  • SERVICES AND GOODS PROVIDED BY OWNER: During the term of the Rental, Agent shall provide the following services: Actual cost of food and beverage to be paid by guests at the end of stay at cost plus 10% mark-up. Owner agrees to have the property well-maintained and to make any needed repairs not caused by Guest or Guest’s Invitees in a timely fashion. Additionally, Owner shall supply utilities to the extent they are available from the applicable utility - water, electricity and gas for its operation, cable service and local calls.
  • INCIDENTALS: Agent shall assist Guest in procuring additional third party services and goods as reasonably requested by Guest. Agent shall provide a concierge to procure these services and guest is responsible for any additional expenses related to services or activities.
  • MAINTENANCE AND DAMAGE. Guest acknowledges that, unless the Rental Agent is notified immediately upon occupancy, the Property including the furniture, furnishings and appliances shall be deemed to be in good working order, condition and repair. Guest shall keep the Property in a clean and sanitary condition, and shall immediately notify Rental Agent of any damage to the Property or its contents, or any inoperable equipment or appliances. Guest shall surrender the Property, at termination, in as good condition as received, normal wear and tear excepted. Guest shall not commit any waste upon the Property or any nuisance or act which may disturb the quiet enjoyment of any neighboring occupants. Guest hereby acknowledges and agrees that insurance policies of the Rental Agent and the Owner of the Property do not cover the Guest’s personal property.
  • OCCUPANCY. The maximum occupancy of the Property is (Property.Sleeps) people (adults and children). If the Property is occupied by more than (Property.Sleeps) people, the Rental Agent shall have the option, in Rental Agent’s sole and absolute discretion to declare Guest to be in breach of this Agreement and Rental Agent shall be entitled to require all persons occupying the Property to immediately leave the Property or be removed from Property and shall automatically forfeit the right to the return of any unused Rental Fees and/or shall be subject to a charge of $1,000 to the Guest’s credit card.
  • USE. The use of the Premises shall be restricted to residential use for a leisure vacation. The Premises shall not be used for commercial purposes without the express written authorization of Agent. Furthermore, Guest shall not violate any criminal or civil law, ordinance or statutes in the use and occupancy of the Premises, commit waste or nuisance, annoy, molest or interfere with any neighbor or other occupant of city in which the rented property resides or violate the rules and regulations of said city. Any such action may result in the immediate termination of this Agreement as provided herein and by law. No repairs, decorating or alterations shall be done by Guest.
  • EVENTS. Events are not allowed unless approval is granted in writing by Rental Agent. Unauthorized events will subject guest to eviction or an event fee equal to $500 per person over occupancy.
  • HOLDING OVER. There will be no holding over or late departure without prior approval by the Rental Agent. Any unauthorized holding over by Guest will be subject to a charge of 150% of the daily rack rate of the Property as published on the Rental Agent’s website www.ExceptionalStays.com plus any additional damages incurred such as the cost of alternate housing for guests displaced by Guest holding over which shall be billed to the Guest’s credit card.
  • NO SMOKING. No smoking is allowed inside the Property. Smoking inside the Property is strictly prohibited at all times. The Guest shall be responsible for all damage caused by smoking, including but not limited to, stains, burns, odor and removal of debris. Guest may be required to immediately leave the Property, or be removed, in which case the Guest forfeits all rights to the return of any unused Rental Fees. Guests violating this policy will be charged a minimum cleaning fee of $500 which shall be billed to the Guest’s credit card.
  • NO PETS. Pets are not allowed in or on the Property. If an unauthorized pet is in the Property, the Guest shall be responsible for all damage caused by pet. Guest and their invitees will be required to immediately leave the Property or be removed. If Guest is in breach of this no pet prohibition herein, Guest forfeits the right of the return of any unused Rental Fees. Guest violating this policy will also be charged a cleaning fee of no less than $500 and the Guest’s credit card shall be charged for all costs incurred by Rental Agent to repair any damage to the Property caused by the pet.
  • Pets Considered. Should a Property state 'Pets Considered' or 'Pet Friendly', this does not guarentee a pet will be excepted. Rental Agent authorization is required. Moreover, with any acceptance of a pet stay there is the addition of a pet cleaning fee and security deposit. This amount is based off the size and breed of the pet(s).
  • PARKING: Guest shall use only those parking spaces designated for their use by Agent.
  • ENTRY AND INSPECTION. Rental Agent and Rental Agent’s employees, contractors and agents shall have the right to enter the Property at any time in case of emergency. Rental Agent and Rental Agent’s employees, contractors and agents shall further have the right to enter the Property upon twenty-four (24) hour notice (or such shorter time period as may be agreed to by Guest), to make necessary or agreed repairs, decorations, alterations, improvement, supply necessary or agreed services, and/or inspect the condition of the Property.
  • LAWS AND RULES AND REGULATIONS. Guest shall comply with all statutes, ordinances and requirements of all municipal, state and federal laws regarding the Property, including the use, possession, production or sale of illegal drugs. Guest further agrees to adhere to all rules and regulations set forth by the regulatory parties for the condominium complex or homeowners association in which the Property is located (if any), including rules with respect to smoking, noise, odors, disposal of refuse, pets, parking and use of common areas.
  • PROPERTIES FOR SALE. If the Property is listed for sale, Rental Agent shall have the right to enter the Property and to allow prospective or actual buyers, lenders and agents and brokers of the Owner of the Property to enter the Property upon twenty-four (24) hours prior notice to Guest. A representative of Rental Agent or the Owner of the Property shall accompany prospective or actual buyers, lenders or Guest at all times. Guest agrees to cooperate with Rental Agent and the Owner of the Property when providing access to the Property in accordance with Section 17.
  • In Event of Sale. the event that Owner sells its interest in the Premises (or enters into an agreement to do so), Owner or the future owner shall have the right to terminate this Agreement provided it provides to Guest written notice of its election to so terminate this Agreement no less than one hundred and eighty (180) days prior to the Arrival Date. In the event of such termination, a check for the full refund of deposits paid by Guest to Owner shall accompany the termination notice.
  • HOT TUBS/POOLS. The use of hot tubs, pools, saunas, spas and steam rooms within the Property is at the Guest’s own risk. Guests are urged to exercise caution when using these types of amenities. Proper precautions and acclimatization is recommended.
  • Pools and Hot tubs are serviced prior to Guest arrival. Rental Agent recommends showering prior to use to maintain clean water and avoid drain/refill during Guest stay. If other liquids or solids are found present in hot tub, Guest will be charged $500 to drain/refill.
  • BIKE STORAGE. Bikes and similar transportation devices cannot be stored inside the home at anytime.
  • CONSTRUCTION ACTIVITIES. There are various construction projects that may be ongoing during Guest’s stay that Rental Agent has no control over. Rental Agent shall use its best efforts to notify Guest of any construction projects in the vicinity of the Property that may impact the Property at the time of booking; however, Rental Agent makes no representations or warranties as to the future status of construction projects that may impact Guests during their occupancy of the Property.
  • UNAVAILABILITY. If for any reason beyond the control of Rental Agent, the Property is unavailable, Rental Agent may cancel this Agreement and refund in full to Guest all payments made hereunder by Guest. Rental Agent will make every effort to provide suitable equivalent lodging.
  • INDEMNIFICATION AND WAIVER. Guest will indemnify, defend and hold harmless Owner of the Property and Rental Agent from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest, Guest’s guests or licensees or their personal property arising out of the Guest or the Guest’s guests, invitees and licenses occupancy or use of the Property. Neither Rental Agent nor the Owner of the Property shall be liable for any damage or injury to Guest, or any other person, or to any property, occurring on the Property, unless such damage is the legal result of the gross negligence or willful misconduct of the Rental Agent or the Owner of the Property. Guest agrees to hold Rental Agent and the Owner of the Property harmless from any claims for damages, except for injury or damage caused by the gross negligence or willful misconduct of Rental Agent or the Owner of the Property. Guest agrees to waive and release the Owner of the Property and Rental Agent (“Released Parties”)from any and all liability for costs, expenses or damages due to loss of property or for personal injuries or death (“Claims”)which may occur to Guest and/or Guest’s guests and licensees while on or about the Property, except for injury or damage caused by the gross negligence or willful misconduct of the Released Parties. Guest hereby assumes the risk of a Claim while using the Property. The waiver and release is intended to be a full and complete waiver and release of the Released Parties from any and all present or future Claims (known or unknown), except for injury or damage caused by the gross negligence or willful misconduct of the Released Parties.
  • CONFIDENTIALITY: The terms, conditions and information set forth in this Agreement, including without limitation the names of the Guests and Owner; and the existence of this Agreement, shall be held in strict confidence by the parties hereto, and such information shall be only disclosed on a need to know basis, including to the staff of Premises, or as required by a court of law.
  • INSURANCE. Guest acknowledges that neither Rental Agent nor the Owner of the Property’s insurance covers any of Guest’s or Guest’s invitees' personal property, including vehicles, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause, except for injury or damage caused by the gross negligence or willful misconduct of the Rental Agent or the Owner of the Property. Rental Agent and the Owner of the Property recommend that Guest carry or obtain insurance to protect Guest, Guest’s invitees and their personal property from any loss or damage.
  • MEDIATION. Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, as a condition precedent to the institution of any arbitration or litigation under this Agreement. Mediation fees, if any, shall be divided equally among the parties involved.
  • TIME. Time is of the essence of this Agreement.
  • ATTORNEYS FEES. In any action or proceeding involving a dispute between Rental Agent and Guest arising out of this Agreement, the prevailing party will be entitled to reasonable attorneys’ fees and any costs incurred in enforcing this Agreement.
  • NO WAIVER. Failure of Rental Agent to enforce any provision of this Agreement shall not be deemed to be a waiver. The acceptance of any fees or deposits by Rental Agent will not waive Rental Agent’s right to enforce any provision of this Agreement.
  • ENTIRE AGREEMENT. The foregoing, plus any attachments or addendums hereto, constitutes the entire agreement between the parties and may be modified only in writing signed by all parties. This Agreement and any modification, including any photocopy or facsimile, may be signed in one or more counterparts, each of which will be deemed an original and all of which taken together will constitute one and the same instrument. If there is more than one Guest, all Guests are jointly and severally liable under this Agreement.
  • NOTICES. Unless otherwise provided, any notice which either party may give or is required to give, may be given personally or by mailing the same, postage prepaid to Rental Agent or Guest at the address shown in the signature block or at such other places as may be designated by the parties from time to time. Notice will be deemed effective three (3) days after mailing, or on personal delivery, or when receipt is acknowledged in writing.
  • CREDIT CARD AUTHORIZATION. Guest hereby authorizes Rental Agent to charge all deposits, fees, costs and charges arising under this Agreement to the Guest’s credit card provided to Rental Agent. The reversal of any charges to Guest’s credit card arising under this Agreement shall constitute a breach of this Agreement by Guest. In the case of any reversal of charge by Guest, this provision shall serve as express permission to Rental Agent to recharge the Guest’s credit card for payment or to collect such fees, costs and charges by any other legal means. Guests shall be charged a 3.5% credit card processing fee for all amounts in excess of $5,000 that are paid by credit card.
  • NO ASSIGNMENT. This Agreement is not a “lease” of the Property, but rather a limited license to occupy the Property upon the terms and conditions set forth herein. Guest has no rights to assign or sublease, in any manner, the Property or any portion thereof. This Agreement may not be assigned by Guest without Owner’s prior written consent. Guest shall be strictly prohibited from charging any third party for the use of the Property under any circumstances. In the event that Guest violates this Section 34, this Agreement shall be immediately and automatically terminated by Rental Agent and Guest shall be required to immediately vacate the Property and the Rental Agent shall be entitled to retain all funds paid by Guest.
