Payment & Cancellation - 30 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
- Guests who book a home or villa that is located in the state of California may cancel for free provided that: (1) reservation is canceled within 24-hours of reservation request, and (2) reservation request was made 3 days before arrival.
Payment Policy:
- 30 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 30 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 30 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 30 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 30 days before arrival: 100% refund.
House rules
- 1.The premises are for the sole use as a personal vacation residence and the person(s) renting will be deemed the ""Renter(s).""
- 2.Rent: "Rent" shall mean all monetary obligations of Renter to Owner under the terms of the agreement, except the security deposit.
- 3.All rent, including, but not limited to, the cleaning fee, reservation fee, damage insurance and taxes for the premises shall be due at the time of reservation to secure the reservation.
- 4.Owner will not be held responsible or held liable for loss of the reservation, as a result of, the failure of the Renter to secure the reservation by paying the full rent, departure cleaning fee, and city bed tax, sometimes known as the Transient Occupancy Tax, due for the premises.
- 5.Renter is not required to supply a security deposit. Instead, Renter will purchase Damage Protection Program which is included with the total quoted cost at the time of booking with coverage of $8,000. The actual amount of Damage Protection Program will be determined by OWNER for each individual reservation. Payment for damage insurance is non-refundable. In the event that damages to the premises or theft of personal property located at the premises exceed the program limit, Renter will be responsible for the difference. By accepting this agreement you are authorizing Owner to charge your credit card up to $3,000 in the event of intentional damages to the premises, or theft of personal property at the premises, additionally, you may be charged for any lost revenue from future reservations due to the damage or theft that occurred. You will be notified if any damages and/or theft of personal property occur, which will also specify the cost of repair or replacement, as applicable, prior to the charges being placed on your credit card. The credit card shall also be charged for any other loss or damages that are not reimbursed pursuant to the terms of this agreement. You will receive a receipt for the repairs and/or replacement of damaged or stolen items. The following are GENERAL EXCLUSIONS from the Insurance policy and benefits will not be provided for any loss or damage due to:
- 1. Intentional acts of an Insured Person.
- 2. Intentional acts of an Insured Person.
- 3. Theft or damage to any property owned by or brought by an Insured Person onto the Rental.
- 4. Theft or damage caused by anyone visiting other than an Insured Person.
- 5. Theft without a valid police report.
- 6. Damage without a valid police report unless the damage is caused by an Insured Person.
- 7. Damage or theft in a Rental Property unit if the number of persons occupying the unit exceeds that unit's occupancy limit. Renter is required to purchase the DAMAGE PROTECTION PROGRAM included in the reservation total a minimal cost of $72 and maximum coverage of $8,000. THE DAMAGE PROGRAM is not refundable.
- 6. Renter understands that in the event of a cancellation, as described below, it would be extremely difficult, if not impracticable, to determine the exact damages that may or could be sustained by such cancellation because Owner may incur charges from a credit card company, may be unable to replace Renters reservation and Owner may incur booking charges, reservation fees, management fees, and other fees and costs. Therefore, the parties agree that the following cancellation policy and fees are reasonable, if booked directly through Nomadness Rentals. For purposes of this agreement, the term “Total Reservation Amount" includes the rent, plus any Transient Occupancy Tax, or its equivalent, and the reservation fee based on the rent. In the event that Renter had purchased travel protection or damage insurance, the cost of any such insurance shall not be refunded.
- 7. No refunds for early departure.
- 8. Pets ARE ONLY PERMITTED in "pet-friendly" properties. "Pet Friendly" means the property is designated specifically to allow pets. If the property/unit you are renting/booking is not specifically designated as "pet-friendly" then NO PETS are permitted in this property/units. Pet fee must be paid at the time of reservation, $145 (plus tax) pet fee per pet. Pet fee, size restrictions, maximum pet restrictions and breed restrictions may apply and will vary on a property-by-property basis. If pet fee is not paid at the time of reservation, then a $1000 penalty plus the pet fee will be charged to the Renter's credit card on file. Failure to get written consent from the property owner for Renter to bring more than one dog or dogs that are over 40lbs will result in a fine of $2,000. Renter agrees to remove and clean any pet hair from the property upon departure. In the event that housekeeping finds pet hair on or at the premises, an additional cleaning may be required in order to remove pet hair. In this case, Renter will be billed for the extra charges incurred by housekeeping to remove the pet hair. Pets are defined as DOGS only. No cats or other animals are permitted on ANY PROPERTY AT ANY TIME REGARDLESS IF THE PROPERTY IS DESIGNATED PET-FRIENDLY OR OTHERWISE.
- 1. Service animals are allowed in the unit/complex (with proper documentation). However, all service dog(s) must be leashed at all times when on the grounds of the complex and dog owner is responsible for picking up after the dog. A violation of the leash requirement and/or picking up after the dog will result in a penalty of $100 for each violation. Please note that all properties allow service animals, and therefore pet dander and/or pet hair may be possible even at non- pet-friendly units. Nomadness cannot be held responsible for any traces of pet hair found in the units and renters with allergies should book at their own discretion.
- 2. Pets must not be left unattended in the unit. If the Renter leaves a pet unattended in the unit, penalties will apply. Additionally, excessive pet noise including but not limited to barking is not permitted. If excessive pet noise is reported, penalties will apply. Penalties may include but are not limited to fines, removal of the pet from the Property, and termination of the lease without refund.
- 9. OWNER is not responsible for the loss of money, jewelry, or valuables of any kind, or for damages to or loss of car and/or its contents by fire, theft or any means whatsoever while on the premises.
- 10. Renter hereby releases and agrees to indemnify, defend and hold Owner harmless, as well as their respective members, officers, managers, directors, shareholders, and employees, from any and all damages, liabilities, costs, attorneys fees, injuries or claims of any nature whatsoever, to real and personal property and bodily injury to Renter and to members of Renters party, or all other occupants or invitees arising during the possession and occupancy of the premises, except as may be caused by the willful acts or gross negligence on the part of Owner. Renter acknowledges that the subject property may constitute a view lot, which means it may not have any fencing, wall, or barricade separating the yard from a hillside or slope and, therefore, acknowledges the need to be careful and observant, so that no one slips or falls down the embankment. Renter and members of Renters party and all other occupants and invitees shall stay only on the paved walkway when traversing to the back of the property because straying from the paved walkway could be dangerous and cause possible harm if a person was to slip and/or fall down the embankment. Renter further acknowledges that the premises may contain bunk beds, dumbwaiter, spa, pool. Renter must be sure that the dumbwaiter [and spa, pool] are properly used for the purposes intended and that children should not be left unsupervised in areas accessible to the foregoing].
- 1. Renter(s) acknowledges that spa/Jacuzzi/pool/sauna/dumbwaiter/bunkbeds usage is at their own risk. Renter(s) assume all liability when using aforementioned amenities.
- 11. Renter agrees that Renter will be entirely responsible for any and all damages to the premises and/or its contents whatsoever, during the term of this agreement.
- 12. Renter understands that the premises are to be kept clean and in well-maintained condition and that upon check-out, Renter will return the home in the same or better condition in which they found it. If not, Renter will be charged for all repairs or additional cleaning that may be necessary, with the exception that Renters cleaning fee will be used to pay for standard cleaning protocol: washing all linens and bedding, cleaning the bathrooms and kitchen, mopping and vacuuming all the floors, and dusting. Any cleaning service required above and beyond the listed items in this paragraph will be deemed extraordinary services and not covered by the cleaning fee. These extraordinary services will be billed, charged and paid from the credit card on file for Renter. If the premises are damaged, or if extraordinary services exceed Damage Insurance purchased in section #5, then an additional payment will be required to return the premises to the same condition as it was at the beginning of the rental term. If the premises are left in good condition upon check-out and a walk-through by Owner, or any other property management company acting on behalf of Owner, with the determination that there are no damages, theft or extraordinary services required, then the credit card on file will not be charged. Should there be theft or an intentional acts that result in damage to the property, a police report will be filed and the cost of any missing or damaged items will be charged to the credit card on file. Intentional acts of damage or theft are not covered by insurance and are the sole responsibility of the Renter.
- 13. Renter understands that the number of people occupying this home is listed on their reservation and that Renter is required to report changes in that number to Owner. The maximum occupancy (typically listed on property detail page) cannot be exceeded. IN THE EVENT OF A BREACH OF THIS PROVISION OF THE AGREEMENT, THE PARTIES AGREE THAT IT WOULD BE EXTREMELY DIFFICULT, IF NOT IMPRACTICAL, TO DETERMINE THE EXACT DAMAGES THAT MAY OR COULD BE SUSTAINED. THEREFORE, THE PARTIES AGREE THAT THERE SHALL BE NO REFUND OF ANY MONIES PAID TO DATE. RENTER SHALL BE REQUIRED TO IMMEDIATELY VACATE THE PREMISES, AND SHALL ADDITIONALLY PAY A FURTHER SUM OF $1,000 TO OWNER.
- 1. Renter understands that if there are complaints to Owner by neighbors or the manager at the complex of noise or disturbing the peace and quiet of the adjoining neighbors or complex, or if the police are called because of any disturbance, this will be grounds for immediate termination of this contract. THEREFORE, THE PARTIES AGREE THAT THERE SHALL BE NO REFUND OF ANY MONIES PAID TO DATE. RENTER SHALL BE REQUIRED TO IMMEDIATELY VACATE THE PREMISES WITHIN 24 HOURS AND SHALL ADDITIONALLY PAY A FURTHER SUM OF $1,000 TO OWNER.
- 14. Lost or unreturned keys, remotes or parking passes: $100 per key, remote or parking pass.
- 15. No one shall be permitted to smoke anywhere on the premises. (See #22 for more information.)
- 1. Charcoal grills are not permitted due to the town ordinance placed by the fire department. If you are caught using the charcoal grills, penalties may be assessed accordingly.
- 16. Any holdover beyond specified termination date on reservation invoice shall be charged at a rate of $2,000 per day, plus any fees that may be incurred for incoming Renter accommodations, unless specific written arrangements have been made and agreed upon with Owner prior to the termination date.
- 17. Owner Rules and Regulations:
- 1. Renter may choose to have a full mid-stay clean, subject to additional fees paid by renter.
- 2. Renter may utilize their own linen and towel supply from the start of the reservation to avoid a mid-stay exchange or clean. No cleaning discounts will be provided should renter choose this option.
- 3. Renter shall use and occupy the premises only for single-family residential use and no other purpose. Renter shall not use or permit the use of the premises, including, but not limited to, the yard, in a manner that creates waste or a nuisance, or that disturbs owners and/or occupants, or cause damage to neighboring premises or properties.
- 4. Renter shall, except as otherwise stated in this agreement, at Renter's sole cost and expense, fully, diligently, and in a timely manner, comply with all applicable laws, which includes laws, rules, regulations, ordinances, directives, covenants, easements and restrictions of record, permits, and the requirements of any applicable fire insurance underwriter relating in any manner to the premises.
- 5. Renter shall not permit any hazardous substance, nor engage in any activity in, on, or about the premises which constitutes a reportable use, as that term may be defined by any applicable law, nor install, use, or maintain any improvement or make any use of the property which could result in an increase in any insurance premiums chargeable to Owner, or constitute a use which is not covered by Owner's existing insurance, or create risk of material increase in liability on the part of the Owner.
- 6. For all reservations exceeding 14 days, it is required that housekeeping exchanges all linens on all beds, and all towels within the unit every 14th day of the reservation at the expense of the renter. If renter would prefer an alternative plan, they may choose one of the following options:
- 7. If an alternative option is not chosen by renter 7 days prior to their scheduled arrival, Nomadness will automatically schedule a linen exchange every 14th day of the reservation and bill for the cost of the exchange accordingly. If Nomadness is unable to charge renter for the exchange 24hours prior to the scheduled arrival, all linens and towels will be removed from the property.
- 18. Waiver of Liability/Attorney Fees and Costs: Should any dispute arise out of the matters described below, Renter agrees to indemnify and hold harmless Owner and Owner operation, as well as their respective members, managers, officers, directors, shareholders, and employees from the costs, including legal expenses, lawsuit liability damages, and claims of every type, including, but not limited to, those arising out of injury or death of any person(s), or damage to any real or personal property of any person(s), including Renter, in any way relating to the management, rental, or operation of the property rented by Owner arising from the actions or inactions or Renter. Finally, the prevailing party shall recover from the other party their costs and attorney fees for any action brought by either party to enforce any terms of this Agreement or to recover possession of the premises.
- 19. The subject may have the following ""nuisance"" problems that may be indigenous to the location. The following constitute examples, which are not exhaustive or limiting, but rather a guideline as to potential problems:
- 1. power outages due to the inclement weather;
- 2. snowstorms may cause road closures and affect skiing conditions;
- 3. lack of snow can affect skiing and snowboarding conditions;
- 4. heavy rainstorms;
- 5. high wind conditions;
- 6. fires;
- 7. high surf conditions;
- 8. flooding; or
- 9. earthquake.
- 20. The owner does not refund reservations due to any of such conditions. The renter should check with the local governmental agency or local chamber of commerce, or Highway Patrol for road conditions and closures.
- 21. If Renters stay is extended at the premises due to road closures or as a result of weather conditions or any other reason the Highway Patrol deems necessary, Owner will discount Renters stay for each day beyond the term that Renter is unable to leave. The renter should contact Owner immediately if Renter's departure has been delayed due to road closures. If Renter is attempting to arrive at the premises and is unable due to weather conditions, or any other reason the Highway Patrol deems necessary to close the roads, Owner will refund Renter's payment only for each day of your term that Renter is unable to arrive at the premises due to road closures. Owner will suggest alternate routes for Renter to take so Renter can arrive at premises. If Renter chooses not to take an alternate route, then no refund will be given. The renter should notify Owner immediately if Renter is unable to arrive at the premises. Road closures are only accepted if imposed by the Highway Patrol due to weather conditions, such as snow, fire, flood, wind, or any other reason deemed necessary by the Highway Patrol. The renter should consider Travel Insurance for the above reasons
- 22. Renter shall not do or permit anything to be done in or about the premises which will in any way obstruct or interfere with the rights of any other tenants or occupants of the building, or injure or annoy them, or use or allow the premises to be used for any improper, immoral, unlawful, or objectionable purposes, including, but not limited to, smoking or use of any illegal substances or other products that cause, maintain or permit any nuisance in or about the premises, or constitute acts of waste in or upon the premises. Renter shall not use the premises or permit anything to be done in or about the premises which in any way conflicts with any laws, statute, ordinance, or governmental rule or regulation, now in force or which may hereafter be enacted or promulgated. Owner reserves the right to declare Renter in default and terminate this lease in accordance with applicable law for a violation of any of the foregoing, and, additionally, to charge Renter for any and all costs, damages, expenses, and fees of any kind or nature whatsoever required to restore the premises to its condition prior to such acts, including, but not limited to, cleaning fees and the like. A fine of $500 plus cleaning fees will be charged to the credit card on file.
- 23. In addition, Renter shall not illegally download videos, or otherwise access any type of media, file, documents, or other material on the internet without proper and complete authorization from the owner and provider thereof. Renter understands that engaging in such unauthorized acts may result in an internet service provider cutting off internet service to the premises, and in that event, could substantially impact the ability of Owner to rent the premises in the future. IN THE EVENT OF A BREACH OF THIS PROVISION OF THIS AGREEMENT, THE PARTIES AGREE THAT IT WOULD BE EXTREMELY DIFFICULT, IF NOT IMPRACTICAL, TO DETERMINE THE EXACT DAMAGES THAT OWNER MAY/OR COULD SUSTAIN, THEREFORE THE PARTIES AGREE THAT, NOT ONLY SHALL THERE BE NO REFUND OF ANY MONIES PAID TO DATE, BUT RENTER MAY BE REQUIRED BY OWNER TO IMMEDIATELY VACATE THE PREMISES AND TO PAY TO OWNER A FURTHER SUM OF UP TO $10,000.
- 1. INTERNET POLICY: Internet service is NOT a guarantee. The property you are renting may provide internet service as an amenity and courtesy to guests; however, neither the property owner of this rental nor Nomadness can guarantee the availability or strength of any WiFi signal or the likelihood of any internet outage. In the event you experience internet difficulty, we will make every attempt to help our guests gain internet access. Refunds and transfers cannot be provided for loss of internet as neither the property owner nor Nomadness is responsible for delivering this service to the rental property, but rather internet connection is secured by a third-party provider which Nomadness has no control over. If internet service is a must for you during your stay, please bring personal WiFi card/Hotspot to ensure connectivity.

- 1. Check-In After 4 pm Check - Out Before 10 am Check-in and check-out times are strictly enforced. Failure to comply will result in the charge of $100 per hour.
- 2. This form of agreement has also been made available for use by parties other than Nomadness Corporation, Owner, and Renter.
- This document may not be applicable to all situations and should not be relied upon or used without consultation with appropriate legal advisers. Each party is advised to consult with their own independent legal counsel. Such third parties are encouraged and advised to use their own form of agreement. To the extent that any third-party chooses to use this form of agreement, they are hereby agreeing to release, indemnify and hold Nomadness Corporation, harmless, as well as their respective members, managers, officers, directors, shareholders, and employees, from any and all damages, liabilities, costs, attorneys' fees, injuries or claims of any nature whatsoever, pertaining to or arising out of use of this form of agreement.
- 3. Access to this unit may require multiple steps or flights of stairs, both to the unit and within the unit. Nomadness Rentals is not responsible for providing alternate methods of accessibility, or for issuing refunds, relocations, credits, and additional services for renters with accessibility concerns. Nomadness Rentals does not advertise or claim any of its properties as handicap accessible or compliant with the American Disability Act. For accessibility concerns, please let our representatives know prior to placing your reservation so that they may accommodate you accordingly.
- 4. Booking a reservation more than 10 months in advance may result in a price change as the arrival date approaches. Renter acknowledges that they will be notified of any price change that has occurred no later than 30 days prior to their scheduled arrival. Renter will have the option to pay any applicable differences or cancel the reservation without a penalty.
- 5. The person booking the reservation must be 25 years of age or older and will be deemed as the “Responsible party.”
- 1. Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the world health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person – to – person contact. As a result, federal state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Nomadness Corporation and the property OWNER have out in place preventive measures to reduce the spread of COVID-19; however, Nomadness Corporation and the property OWNER cannot guarantee that you or others in your party will not become infected with COVID-19. By agreeing to this agreement, I/we acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I/We may be exposed to or infected by COVID-19 by staying at the property and that suck exposure or infection may result in personal injury, illness, permanent disability, and death. I/we understand that the risk od becoming exposed to or infected by COVID-19 at the property may result from actions, omissions, or negligence, of myself and others, including, but not limited to, hold Nomadness Corporation, as well as their respective members, managers, officers, directors, shareholders, and employees, property OWNER from any and all damages, liabilities, costs, attorney’s fees, injuries or claims of any nature whatsoever, pertaining to or arising out of use of this form of agreement. I/we voluntarily agree to assume all of the forgoing risks and accept sole responsibility for any injury to myself and others in my party,, including, but not limited to, personal injury, disability, and death. I/we hereby release, covenant not to sue, discharge and hold harmless Nomadness Corporation, as well as their respective members, manager’s, officers, directors, shareholders, employees and property OWNER from any and all damages, liabilities, costs, attorney’s fees, injuries or claims of any nature whatsoever, pertaining to or arising out of use of this form of agreement.
- I/WE (Renter) speak, write and understand English. I/WE (Renter) acknowledge and agree to abide by the terms of this Vacation Rental Agreement. The name that will appear on the credit card being charged will be provided after the booking reservation has been completed.
