Payment & Cancellation - 60 Day Policy

Grace Period:

  • Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.

Payment Policy:

  • 60 days or less prior to arrival: Guests pay 100% at time of reservation.
  • More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
  • For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.

Cancellation Policy:

  • 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
  • More than 60 days before arrival: 100% refund.

  • Please read your vacation rental agreement carefully before you begin your vacation. Any monies received by VistaNova Luxury Villas for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.
  • 1) RESERVATION DEPOSIT
  • Secure your booking with a 30% deposit, with the balance due 60 days before arrival.
  • 2) CANCELLATION POLICY & FEE
  • Enjoy peace of mind with free cancellation within 48 hours of booking. Up to 30 days before arrival, a 60% refund is available on payments made. A full refund is possible if the dates are rebooked at the same rate. Holiday dates are excluded from this cancellation policy, All holiday dates are non-refundable. We would also like to encourage all our guests to purchase travel insurance for a peaceful and worry-free vacation.
  • 3) CREDIT CARD AUTHORIZATION FORM & SECURITY DEPOSIT
  • The following credit card authorization form must be completed and signed in this rental agreement. This authorization allows VistaNova Luxury Villas to place a hold on the credit card for the amount $1000 or $2000 (property dependent). A hold will not be made on your credit card if a Security Deposit was already charged. Please note that you need to provide a credit card even if you have used an alternative method to pay. This deposit will be released 3 days after check-out, by VistaNova Luxury Villas to the same credit card, provided nothing is missing, broken or terms of this contract violated. It may take 3-5 business days to see the refund from your credit card company. The house must be kept in the same condition at your check out, as it was when you arrived. If something does get broken, turns up missing or terms of this contract are violated, the value of these items or the penalty amount will be charged to your card. If you do not have a credit card on file, you will be required to provide one before check-in, by calling the office at any of the listed numbers.
  • Please note all reservations with stays during BPM or Ocaso Music Festivals, require a wire transfer of $2000 as a refundable security deposit.
  • DAMAGE VOUCHER AND CREDIT CARD AUTHORIZATION FORM
  • A credit card form will be sent to your email prior to arrival.
  • CREDIT CARD INFORMATION
  • Please understand that a 5% additional fee will be charged for transactions made with an American Express (AMEX) card after completing the booking process.
  • All credit card transactions are processed through Vacation Rental Payment (Yapstone). Since all of our transactions are processed remotely, and for your own protection, verification of the credit card holder is required. For all credit card transactions (credit card payment, security deposit, damage voucher) it is required to provide a selfie and a photo of a valid form of identification document of the credit card holder (Examples: Driver's license, passport). The identity verification process is manage by our partner HelloSign. In rare cases, our payment processor requires an additional verification step if the transaction is considered of "high risk". This may involve a selfie picture from the guest showing the ID or in person verification at our office right before check-in. Transaction security is of outmost importance for us as well as protection of data.
  • 4) LATE PAYMENT POLICY
  • In signing this contract the client agrees to make all payments by the scheduled dates listed in the Deposit/Payment Schedule above. If any payment is not received by these scheduled dates VistaNova Luxury Villas reserves the right to cancel the reservation and the client forfeits any payments made.
  • 5) CHECK-IN, CHECK-OUT
  • Check-in time is 4 p.m. Check-out time is 11 a.m. If you would like to request a late check-out, please confirm in writing with the VistaNova Luxury Villas staff ahead of time to ensure we don't have any one-day turnovers. If we do not have a same day turnover we are more than happy to extend a late check-out, however if we do and you do not leave on time you are compromising the check in of our other guests. Any late check-out without written permission from our staff will be charged $100/hour. Unauthorized early check-ins will also be billed $100/hour, please confirm in writing with our staff beforehand if you would like to check-in early.
  • Note guests with any outstanding balances overdue and/or without a signed rental contract will not be allowed to check-in.
  • 6) OCCUPANTS/ VISITORS
  • Our company reserves the right to charge an extra guest fee for groups exceeding the standard house capacity. Please contact our reservation team for occupancy details. Please be sure to accurately select the number of guests to receive the precise quote for your stay, including any additional guest fees, if applicable. Kids under the age of 2 are not counted as guests. Kids aged 2 and above are considered guests.
  • Outside visitors not pre-approved with VistaNova Luxury Villas are not allowed at any time inside the premises, unless authorized with written permission by the VistaNova staff. In order to receive written permission, you must send an email minimum 24hrs ahead of time with visitors full name. Exceeding the number of guests indicated in this contract is grounds for eviction and $500.00 USD penalty charged to the card on file. In particular, prostitutes are not allowed, their relationship with the criminal elements makes them a risk to our homes. Under no circumstances are they allowed.
  • 7) SMOKING
  • All villas have a strict no-smoking policy. We ask that you do not smoke in the house at all. If evidence of smoking, such as the smell of cigarettes inside the home and/or cigarette burns on the furniture is noticed by the cleaning crew there will be a $1000 damage assessment. Smoking is only allowed outside and not around the outdoor furniture.
  • 8) SLEEPING CAPACITY & DISTURBANCES
  • Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:
  • A) Occupancy exceeding the rental capacity stated in this contract.
  • B) Using the premises for any illegal activities.
  • C) Causing damage to the premises rented or to any of the neighboring properties.
  • D) Occupancy and use of the premises and common areas in such a fashion that disturbs or offends other guests or residents.
  • E) Smoking inside the house. Smoking is only allowed outside.
  • F) Any other acts which interferes with a neighbors' right to quiet enjoyment of their property. We wish you to have an enjoyable vacation, but you must respect the rights of other guests.
  • 9) PETS
  • Pets are strictly not allowed unless otherwise approved in writing by VistaNova. Violation of our pet policy is grounds for immediate termination of the rental agreement, eviction with no refund, and/or a $500.00 USD penalty charged to the card on file.
  • 10) PERSONAL BELONGINGS
  • We ask that the occupants take full responsibility for securing their personal belongings. Please lock your valuables whenever leaving the house. VistaNova Luxury Villas is not responsible for any lost or damaged personal items.
  • 11) THEFT PREVENTION
  • As in many places around the world, petty theft and burglary can be common, it is almost always an act of opportunity. We are asking you to help us in avoiding the circumstances that would result in any loss to you. For instance, we provide safes, please use them where they are available, make sure to lock the door at night when you go to sleep and also don't keep the key in the door while hanging around the house. Cellphones, laptops, and cash are the most common targets. We would also like to ask you to not bring anything of tremendous value on your vacation. Please consider checking with your homeowner's insurance, or renter’s insurance, or if necessary, get a personal policy before traveling to Costa Rica, so anything that you bring that could become stolen would be covered, as we cannot provide any insurance for you.
  • 12) AC/ ELECTRICITY/ WATER
  • VistaNova Luxury Villas is an ecologically minded business, we ask that you obey the following guidelines in regards to conserving energy: When using the air-conditioning units, please try to keep usage to a comfortable minimum. ACs must be turned off when guests leave the property. If the air conditioning is left on while guests are out of the property, VistaNova reserves the right to have someone on our team enter the property to turn it off. Client will be charged a $50 fine for each time VistaNova finds the AC is left on with no one home. Also, please turn off all lights when you leave any room. During the dry season the Guanacaste province can suffer from droughts and as a consequence a shortage of water to the homes. If you are staying with us during the dry season please try to use water conscientiously to avoid running out of water.
  • 13) NOISE LEVELS
  • We are located in a residential community and, although this is a holiday destination, it's home to many people. As such we ask that you respect their privacy and their right to a peaceful existence. Guests who create excessively high noise levels may be expelled from the property with no refund, and/or a penalty of $700 USD per incidence, charged to the card or security deposit on file.
  • - Between 8:00am to 6:00pm noise intensity cannot be greater than 80 decibels.
  • - Between 6:00 p.m. to 10:00 p.m. noise intensity may not be greater than 60 decibels.
  • - Between 10:00pm to 8:00am of the following day, excessive noise; above 25 decibels, either from music or people is strictly prohibited.
  • Please consider this carefully and if you do not want to be constrained by this policy we ask you please, do not rent this home.
  • 14) APPLIANCE MALFUNCTIONS
  • There are no rebates or refunds issued for any malfunctions or service requests for air conditioning, televisions, hot tubs, pools, appliances, elevators etc. as every good faith effort is made to ensure the property is maintained to the highest standards. Every effort will be made to effect repairs as quickly as possible. Additionally, blackouts, water shortage, flooding, or construction at adjacent properties.
  • 15) GROSS NEGLIGENCE AND ABUSE
  • Accidents happen, we all know this to be a reality of life. For this, there are insurances and we hope you have purchased one through us. If you have not purchased a damage insurance, please contact your guest manager or concierge before check in and purchase one of our damage insurance policies that will protect you up to $1500 of accidental damage. We also ask that you report any accidental damage within 24 hours of the incident.
  • 16) EVENT FEE
  • If you have been permitted to host an event by VistaNova Luxury Villas, whether it is formal or informal, there is an event fee starting at $1000 (unless otherwise stated on the invoice) and a refundable event security deposit of $1000. All events/weddings must be preauthorized before booking. All weddings or events over 30 people must have a planner pre-approved by VistaNova.
  • 17) TENANTS LIABILITY
  • You agree to accept liability for any damages caused to the property (other than normal wear and tear) by you or your guests.
  • 18) HOME KEYS / DOOR AND/OR GATE CODES
  • Due to past security issues, we have implemented a strict policy regarding the sharing of keys or codes of our properties. You agree by signing this contract to never share your house and/or gate code or give keys of your vacation rental to anyone outside of your guest list. If you do so, you will be fined for breaking this clause. The fine will be assessed by the guest manager as each property has different logistics. For example, if you rent a golf cart you are not permitted to share the gate code with the golf cart company.
  • 19) HOLD HARMLESS
  • Accepting this rental indicates that Renter and its guests agree to HOLD HARMLESS & RELEASE the Owner, Property Manager, and all affiliated agents of the Property of any liability for any accident, injury, death, and/or loss or damage of personal property while at or renting the property.
  • We do not accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, or plumbing. Nor do we accept liability for any loss or damage caused by weather conditions, natural disasters, theft, or other reasons beyond our control.
  • Any services contracted for or by the guest is at the sole discretion of the guest. VistaNova Luxury Villas nor the owner is responsible for 3rd party services.
  • 20) ACKNOWLEDGEMENT
  • I acknowledge that I have reviewed and understand the terms of this lease and agree to be bound thereby. I hereby apply to lease the above-described premises for the term and upon the conditions set forth. By signing below, I agree to abide by all rules and regulations pertaining to the rental property and will take responsibility for other occupants of the rental unit. Further I authorize VistaNova Luxury Villas LLC to charge the credit card or eCheck on file to cover any damage or loss caused by me or my guests during our stay. Agent agrees to provide Tenant with an itemized bill for all damages.
