Payment & Cancellation - 14 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 14 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 14 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 14 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 14 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 14 days before arrival: 100% refund.

- Definitions
- “Owner/Manager” includes [his/her/their/its] agents, employees, invitees, licensees, or visitors.
- “Vacation Rate” means the Lodging Fees plus any other amounts of money payable by Vacation Guest to Owner/Manager.
- “Vacation Guest” means the Primary individual who signed this Agreement and [his/her/their] Additional Guests.
- “Premises” means the Rental Premises.
- “Agreement” means this Vacation Rental Agreement.
- Clauses and Covenants
- A. Vacation Guest agrees to—
- 1. Lease the Premises for the entire Term beginning on the Start Date and ending on the End Date.
- 2. Accept the Premises in their present condition “AS IS,” the Premises being currently suitable for the Permitted Use.
- 3. Obey all laws, ordinances, orders, rules, regulations, and covenants applicable to the Permitted Use, condition, and occupancy of the Premises. Obey all laws, ordinances, orders, rules, regulations, and covenants stated in the HOUSE MANUAL & RULES which was sent via email to the Vacation Guest. If Vacation Guest did not receive the House Manual & Rules, Vacation Guest is responsible to request it, and if Vacation Guest does not request it, Vacation Guest will still be subject to any laws, ordinances, orders, rules, regulations, and fees/fines stated in the House Manual & Rules.
- 4. Pay, as additional Lodging Fees, all other amounts due under this Agreement, including fees described in the House Manual & Rules.
- 5. Cover all reasonable costs to repair any damage to the Premises caused by Vacation Guest, or the Additional Guest(s), or any guests on the Premises.
- 6. Give permission to SafelyStay, Inc., to verify Vacation Guest identity, and check criminal databases in order to confirm Vacation Guest reservation. Complete terms regarding Safely’s guest verification can be found at www.safely.com/terms. Vacation Guest may receive an email from Concierge@Safely.com to complete Vacation Guest screening. Vacation Guest should check its spam inbox for this email, and contact Safely at Concierge@Safely.com, or go to www.Safely.com, if Vacation Guest has any questions.
- 7. Leave the Premises on the End Date.
- 8. INDEMNIFY, DEFEND, AND HOLD OWNER/MANAGER HARMLESS FROM ANY INJURY (AND ANY RESULTING OR RELATED CLAIM, ACTION, LOSS, LIABILITY, OR REASONABLE EXPENSE, INCLUDING ATTORNEY’S FEES AND OTHER FEES AND COURT AND OTHER COSTS) OCCURRING IN ANY PORTION OF THE PREMISES. THE INDEMNITY CONTAINED IN THIS PARAGRAPH (a) WILL SURVIVE THE END OF THE TERM AND (b) WILL APPLY EVEN IF AN INJURY IS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OR STRICT LIABLILITY OF OWNER/MANAGER BUT WILL NOT APPLY TO THE EXTENT AN INJURY IS CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF OWNER/MANAGER.
- B. Vacation Guest agrees NOT to—
- 1. Use the Premises other than as a Temporary vacation stay occupied by the named Vacation Guest and the “Additional Guest(s) (other than Vacation Guest).”
- 2. Create or permit a nuisance or interfere with any neighbor’s use of its Premises.
- 3. Change Owner/Manager’s lock system.
- 4. Alter the Premises.
- 5. Allow a lien to be placed on the Premises.
- 6. Assign this Agreement or sublease any portion of the Premises without Owner/Manager’s written consent.
- 7. Permit more than the allowed number of vehicles, stated in the House Manual & Rules, on the Premises unless authorized by the Owner/Manager in writing.
- 8. Install, even temporarily, the following: a spa, hot tub, above-ground pool, trampoline, or any item which causes a suspension or cancellation of insurance coverage or an increase of premiums. Vacation Guest may not permit any part of the property on the Premises to be used for (1) any activity which is a nuisance, offensive, noisy, or dangerous; (2) the repair of any vehicle; (3) any business of any type, including but not limited to child care; (4) any activity which violates any zoning ordinance, owner’s association rule, or restrictive covenant; (5) any illegal or unlawful activity; or (6) activity that obstructs, interferes with, or infringes on the rights of other persons near the Premises.
- 9. Permit any other guest to stay on the Premises without Owner/Manager’s written permission.
- 10. Permit, even temporarily, any pet on the Premises (unless agreed otherwise by the Owner/Manager). If the Vacation Guest violates this provision, the Owner/Manager may declare the Vacation Guest in Default, making the Vacation Guest subject to automatic removal and charge the Vacation Guest any fees incurred by Owner/Manager in said removal and any costs incurred by the Owner/Manager to exterminate, clean, or rehabilitate the Premises.
- 11. Check in sooner than 3:00 PM on the Start Date.
- 12. Check out later than 11:00 AM on the End Date.
- 13. Conduct any parties/events or large gatherings.
- 14. Make loud noises which might disturb neighbors during daytime hours (8 AM – 10 PM) or during nighttime hours/quite hours (10:01 PM - 7:59 AM)
- 15. Smoke or allow any other Additional Guest(s) or guests to smoke on the Premises.
- 16. Leave the property in an extremely dirty condition.
- C. Owner/Manager agrees to—
- 1. Lease to Vacation Guest the Premises for the entire Term beginning on the Start Date and ending on the End Date.
- 2. Obey all laws, ordinances, orders, rules, regulations, and covenants applicable to the use, condition, and occupancy of the Premises.
- 3. Provide the utilities specified in the Vacation Rental Agreement.
- D. Owner/Manager and Vacation Guest agree to the following:
- 1. Release of Claims/Subrogation. OWNER/MANAGER AND VACATION GUEST RELEASE EACH OTHER FROM ALL CLAIMS OR LIABILITIES FOR DAMAGE TO THE PREMISES OR DAMAGE TO OR LOSS OF PERSONAL PROPERTY WITHIN THE PREMISES THAT ARE COVERED BY THE RELEASING PARTY’S PROPERTY INSURANCE OR THAT WOULD HAVE BEEN COVERED BY THE REQUIRED INSURANCE IF THE PARTY FAILS TO MAINTAIN THE PROPERTY COVERAGES REQUIRED BY THIS
- VACATION RENTAL AGREEMENT. THE PARTY INCURRING THE DAMAGE OR LOSS WILL BE RESPONSIBLE FOR ANY DEDUCTIBLE OR SELF-INSURED RETENTION UNDER ITS PROPERTY INSURANCE. OWNER/MANAGER AND VACATION GUEST WILL NOTIFY THE ISSUING PROPERTY INSURANCE COMPANIES OF THE RELEASE SET FORTH IN THIS PARAGRAPH AND WILL HAVE THE PROPERTY INSURANCE POLICIES ENDORSED, IF NECESSARY, TO PREVENT INVALIDATION OF COVERAGE. THIS RELEASE WILL NOT APPLY IF IT INVALIDATES THE PROPERTY INSURANCE COVERAGE OF THE RELEASING PARTY. THE RELEASE IN THIS PARAGRAPH WILL APPLY EVEN IF THE DAMAGE OR LOSS IS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OR STRICT LIABILITY OF THE RELEASED PARTY BUT WILL NOT APPLY TO THE EXTENT THE DAMAGE OR LOSS IS CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF THE RELEASED PARTY.
- 2. Casualty/Condemnation. If the Premises are damaged by fire or other casualty or are condemned, then either Owner/Manager or Vacation Guest may terminate this Agreement by notifying the other. Any Lodging Fees prepaid by Vacation Guest will be returned to Vacation Guest upon termination.
- 3. Default by Owner/Manager/Events. Defaults by Owner/Manager are failing to comply with any provision of this Agreement after written notice.
- 4. Default by Vacation Guest/Events. Defaults by Vacation Guest are (a) failing to timely pay Lodging Fees, (b) abandoning or vacating a substantial portion of the Premises, and (c) failing to comply with any provision of this Agreement.
- 5. Default by Vacation Guest/Owner/Manager’s Remedies. Owner/Manager’s remedies for Vacation Guest’s default include:
- a. enter and take possession of the Premises, after which Owner/Manager may relet the Premises, and Vacation Guest agrees to reimburse Owner/Manager for any expenditures made in order to relet, including but not limited to lost Lodging Fees (including accelerated Lodging Fees), fees for advertising to relet the Premises, repairs to the property beyond normal wear and tear, legal costs for collection, and all other economic damages to which the Owner/Manager may be entitled by law; and
- b. enter the Premises and perform Vacation Guest’s obligations.
- 6. No Establishment of Residency. No part of the Term will result in the establishment of residency for the Vacation Guest by virtue of this Agreement.
- 7. License Only. This Agreement creates a short-term license for the Vacation Guest to use the Premises as stated herein. This Agreement does not create a Tenancy of any kind between the Owner/Manager and the Vacation Guest.
- 8. Mitigation. Owner/Manager and Vacation Guest have a duty to mitigate damages, if any.
- 9. Security Deposit. If Vacation Guest defaults, Owner/Manager may use the Security Deposit to pay arrears of Lodging Fees, to repair any damage or injury, to pay any Vacation Guest’s unpaid fees/fines, or to pay any expense or liability incurred by Owner/Manager as a result of the default.
- 10. Holdover. If Vacation Guest does not vacate the Premises following termination of this Vacation Rental Agreement, Vacation Guest will become a Vacation Guest at will and must vacate the Premises on receipt of notice from Owner/Manager. No holding over by Vacation Guest, whether with or without the consent of Owner/Manager, will extend the Term.
- 11. Refunds/Cancellations. The following Refund/Cancellations policy applies to reservations booked directly on the Property Manager website. When a reservation is eligible for full refund, Owner/Manager will refund everything to Vacation Guest, except the Processing Fee. If reservation is booked more than 30 days before check-in/Start Date, Vacation Guest will receive full refund for cancellations made at least 14 days before check-in/Start Date. Otherwise, Vacation Guest will not get a refund. If reservation is booked fewer than 30 days before check-in/Start Date, Vacation Guest will receive full refund for cancellations made within 48 hours of booking and at least 14 days before check-in/Start Date. After that, 50% refund if Vacation Guest cancels at least 7 days before check-in/Start Date. Otherwise, they will not get a refund.
- Additional Provisions
- 1. Alternative Dispute Resolution. Owner/Manager and Vacation Guest agree to mediate in good faith before filing a suit for damages. This term does not apply to a suit for forcible detainer.
- 2. Attorney’s Fees. If either party retains an attorney to enforce this Vacation Rental Agreement, the party prevailing in litigation is entitled to recover reasonable attorney’s fees, court costs, and any other reasonable costs.
- 3. Venue. Exclusive venue is in the county in which the Premises are located.
- 4. Entire Agreement. This Agreement, together with the attached exhibits and riders, is the entire agreement of the parties, and there are no oral representations, warranties, agreements, or promises pertaining to this Vacation Rental Agreement or to any expressly mentioned exhibits and riders not incorporated in writing in this Vacation Rental Agreement.
- 5. Amendment of Agreement. This Agreement may be amended only by an instrument in writing signed by Owner/Manager and Vacation Guest.
- 6. Limitation of Warranties. THERE ARE NO IMPLIED WARRANTIES OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OR OF ANY OTHER KIND ARISING OUT OF THIS VACATION RENTAL AGREEMENT, AND THERE ARE NO WARRANTIES THAT EXTEND BEYOND THOSE EXPRESSLY STATED IN THIS VACATION RENTAL AGREEMENT.
- 7. Termination. This Vacation Rental Agreement begins on the Start Date and ends on the End Date unless renewed by both parties in writing.
- 8. Notices. Any notice required or permitted under this Vacation Rental Agreement must be in writing. Any notice required by this Agreement will be deemed to be delivered (whether actually received or not) when deposited with the United States Postal Service, postage prepaid, certified mail, return receipt requested, and addressed to the intended recipient at the address shown in this Vacation Rental Agreement. Notice may also be given by regular mail, personal delivery, courier delivery, facsimile transmission, or other commercially reasonable means and will be effective when actually received. Any address for notice may be changed by written notice delivered as provided herein.
- 9. Abandoned Property. Owner/Manager may retain, destroy, or dispose of any personal property left on the Premises at the end of the Term. Abandonment occurs when, in the Owner/Manager’s reasonable opinion, all Vacation Guests have vacated the Premises.
- 10. Emergencies. Vacation Guest may call +1 832-802-7163 or 911 to report emergencies that affect the Premises and that threaten Vacation Guest’s physical health or safety.
