Payment & Cancellation - 60 Day Policy

Grace Period:

  • Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.

Payment Policy:

  • 60 days or less prior to arrival: Guests pay 100% at time of reservation.
  • More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
  • For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.

Cancellation Policy:

  • 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
  • More than 60 days before arrival: 100% refund.

  • The parties involved are the Tenant and the Agency Property Manager S.L. It is agreed that the Tenant will rent a property as a second home for vacation purposes. The Tenant must present their documentation and sign a contract with the same conditions published here and on Marriott before entering the property. The main clauses are:
  • Vacation Use: The Tenant will occupy the property for a specified period for vacation purposes.
  • Heatable Pool: The property has a private pool that can be heated to a temperature of 30°, at an additional cost of €20 per day. NOTICE: to maintain the temperature, the Tenant must cover the pool when not in use. Pool use is exclusively for registered tenants and is only permitted during the rental period. The agency is not responsible for accidents or damages resulting from improper use of the pool.
  • Service: The Tenant accepts the condition and services of the apartment, with no right to claim any services not specified in the listing.
  • Occupancy: Only people registered through the welcome app may reside on the property. Documentation is required to hand over the keys.
  • Check-in and Check-out: The rental contract begins and ends on specific dates and times. Identification is required upon entry, and there are additional charges for check-ins and check-outs outside the designated times.
  • Rent: Payment conditions published on Marriott apply. The security deposit is retained against any damage caused to the property.
  • Property Condition: The Tenant must maintain and return the property in optimal condition.
  • Damage: Damages caused by negligence will be repaired at the Tenant’s expense.
  • Modifications: No work on the property is allowed without prior written permission from the owner or agent.
  • Subletting: The Tenant may not sublet or assign the property without written consent from Property Manager.
  • Usage Restrictions: The use of the property for auctions, immoral purposes, business or professional activities, and parties is prohibited.
  • Access: Property Manager must have access to the property at all times during the rental period.
  • Pets: Pets on the property require explicit written authorization. Specifically, dogs weighing more than 20 kg are not accepted unless prior approval is obtained. Additionally, the number of dogs on the property is limited to one unless written notice and approval are provided for additional pets. Tenants are asked to comply with these rules to ensure the comfort and safety of all occupants.
  • Security: The Tenant must secure all doors and windows and activate the alarm if available.
  • Keys: The Tenant must return the keys at the end of the rental period. Charges apply for lost or forgotten keys.
  • Legal Authority: Property Manager has the legal capacity to lease and enter into this contract.
  • Cancellation Policy: Cancellation fees apply depending on the time before arrival. In the event of border closures due to COVID-19, a full refund or date change is offered.
  • Agreement: Both parties submit to the jurisdiction of the courts and tribunals of the city of Málaga for any dispute or conflict.
  • Any aspect not explicitly specified or agreed upon in this agreement will be subject to the regulations of the Vacation Rental Law and/or the policies and conditions published on Marriott.
