Payment & Cancellation - 14 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 14 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 14 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 14 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 14 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 14 days before arrival: 100% refund.
House rules
- RENTAL AGREEMENT
- This Agreement is entered into between Property Manager LLC (“Bella,” “we,” or “us”), acting for itself and for the owner of the applicable property (the “Owner”), and the person who is the responsible guest of the property (“Guest” or “you”), in connection with Guest’s rental of the vacation property described in the applicable reservation (“the Property”).
- 1. CHECK-IN / CHECK-OUT. Your right to occupy the Property begins at 4 PM on the “Check-in Date” and ends at 11 AM on the “Check-out Date” unless an otherwise agreed upon check-in and check-out time is confirmed in writing by us.
- 2. PAYMENT TERMS AND CANCELLATION. The payment terms are explained in the “Payment Terms” section of the checkout web page for the Property rental. Rental payments are fully refundable up until 30 days prior to the reservation except certain fees. Cancellations within 30 days of reservation are non-refundable. Cleaning fees for reservations canceled prior to check in are refundable at all times. Additional restrictions may apply for high demand and holiday periods. The 3% convenience credit card fee is NON-REFUNDABLE in all cases. We reserve the right to modify the cancellation policy on a case-by-case basis.
- *2(a). EXTRA CLEANING. If your reservation extends past 30 days, a mid stay clean is required, as well as a monthly Maintenance Wellness check. If the condition of the premises requires extra cleaning or excess garbage removal beyond the norm or the Guest requests extra cleaning services, the Guest shall be responsible for the cost of such cleaning.
- *2(b). PETS AND SMOKING. Pets are permitted, with a pet fee, on the premises during the rental term. Please note that a non-refundable pet cleaning fee is required. The specifics of this fee will need to be discussed directly with our team. Additionally, it is a legal requirement to clean up after your pet at all times. Guest agrees that they shall neither smoke nor allow smoking, of any substance, in the premises during the event term.
- *2(c). UTILITIES. Gas, electricity, water, internet wifi, and cable television are included. Gas for pool heating is an additional fee based on usage.
- 3. MAXIMUM OCCUPANCY. The Property may not be used by more than the number of adults and children listed in your reservation, and having no more than the number of vehicles on the premises at any time during the reservation stated in the home guide. Parties and other gatherings are expressly prohibited unless prior written authorization is received from us. Exceeding occupancy may result in eviction and forfeiture of amounts paid.
- 4. HOUSE RULES. Guest agrees to abide by the applicable “House Rules” attached as Exhibit A to this Agreement. Guest agrees that he/she is responsible for the actions of all members of the rental party and anyone else that Guest permits on the property. This includes being responsible for making sure that members of the rental party and anyone else permitted at the property follow the House Rules and being responsible for any damages, liability, and injuries resulting from their conduct and actions.
- 5. MINIMUM AGE FOR RENTAL. The minimum age to rent the Property is 25 years of age. All guests under 25 years of age must be accompanied by an adult over the age of 25 unless prior written authorization is received from us.
- 6. DAMAGES; SECURITY DEPOSIT; INSURANCE. Guest is liable for any damage to the Property. To ensure that the proper party is held responsible, please notify us immediately of any damages found at check-in.
- *6(a). TRUST AND SAFETY INSURANCE. The SafelyStay, Inc. Trust and Safety Fee includes up to $10,000 of accidental coverage for contents damage and up to $500,000 coverage for accidental property damage and bodily injury. Complete terms regarding the Trust and Safety coverage can be supplied if needed. The Trust and Safety Fee is refundable only if the reservation is canceled in writing at least twenty-four (24) hours prior to the arrival date. The $100 deductible and/or minimum claim amount will be the responsibility of the Guest, and the property manager will process using the form of payment on file for Guest.
- *6(b). GUEST VERIFICATION. I give permission to SafelyStay, Inc., to verify my identity, and check criminal databases in order to confirm my reservation. Complete terms regarding Safely’s guest verification can be found at www.safely.ai/terms.
- 7. INCLEMENT WEATHER / TRAVEL INSURANCE. Owner and Bella disclaim all liability for loss, damage or injury to persons or their property in connection with inclement weather, as well as any liability in connection with inconveniences resulting from such inclement weather such as shortages or stoppages in the supply of water, gas, electricity, plumbing, television / cable service or Internet / WIFI access. The Southwest region is subject to extreme weather conditions. In summer months, wind storms can create havoc and in extreme cases can cause damage to a home, or a dirty pool/spa. Guest expressly bears the risk of the existence and effects of inclement weather, and we strongly recommends that Guest purchase travel insurance (see BellaPalazzo.com - for Travel Insurance purchase options) as Bella and Owner will not provide refunds for cancellations and/or early departures due to inclement weather.
- 8. MAINTENANCE / INSPECTION. We will diligently attempt to address maintenance issues as they occur. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time, and if such issue significantly impacts the Guest’s stay, we reserves the right to relocate Guest to a comparable Property or refund Guest’s rental fees. Guest agrees to allow Owner or Bella access to the Property for purposes of repair and inspection. Owner will exercise this right of access in a reasonable manner.
- 9. SUBSTITUTION. In the event of serious and substantiated unforeseen circumstances, Bella reserves the right to substitute the rented property described herein with another of an equivalent level, quality, value and location. In the event of force majeure or sale of property rented, PM reserves the right to cancel and terminate this contract and return any amounts paid with no further obligation, responsibility, or liability.
- *9(a). SALE CONTINGENCY. In the event that the Property that you have reserved is sold and unavailable for rental, we will make every effort to provide Guest with a comparable Property at no additional cost to Guest. If a comparable property cannot be found, we reserve the right to terminate this Agreement at any time and refund Guest’s payment without penalty.
- 10. FALSIFIED BOOKINGS. If your booking was made under false pretenses, including but not limited to, a falsified name, age or size of party, you will be subject to immediate eviction and forfeiture of all amounts paid in addition to each and every other legal and equitable remedy that is available to us under applicable law.
- 11. DISCLAIMER. The Property is privately owned. Neither Owner nor Bella are responsible for any accidents, injuries or illness that occurs while on the Property or its facilities. Neither Owner nor Bella are responsible for the loss of personal belongings or valuables at the Property. By accepting this reservation, it is agreed that Guest expressly assumes the risk of any harm arising from their use of the Property or others whom they invite to use the Property.
- 12. INDEMNIFICATION. You agree to indemnify and hold harmless the Owner and Bella for any liabilities, damages, cost or expense whatsoever arising from or related to any claim in connection with your use and / or occupancy of the Property, including, but not limited to, any claim or liability for personal injury or death, damage, loss of personal belongings or theft of the property which is made, incurred or sustained by you and/or anyone in your party or that you invite to use the Property, as well as any negligence or improper conduct of any persons entering, occupying or visiting the Property. In any action concerning the rights, duties or
- liabilities of the Guest, or the Owner, their principals, agents, successors or assignees, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
- 13. LOCAL LAWS; ORDINANCES; HOMEOWNERS ASSOCIATION. Guests are required to follow all laws and local ordinances during their stay, as well as any homeowners association rules. Failure to comply with any regulations may result in us filing a report with local authorities, forfeiture of fees paid, eviction, and any additional legal or equitable remedies available under applicable law.
- *13(a). GOOD NEIGHBOR AND CITY ORDINANCE. All local municipalities have a noise ordinance. Weddings, Parties and Events are strictly prohibited at vacation rentals by City Ordinance. No parties or events are allowed on the premise of any property. Loud noise curfew is from 10:00PM - 7:00AM. No more than the total number of guests allowed on property at one time equal to the number of bedrooms of two people per room per home. Failure to follow the Noise Ordinance could result in monetary fines imposed by local municipalities and deducted from the guest's security deposit and or charged to the credit card on file and/or request funds through rental platform. A.R.S. 9-500.30 prohibits the use of short-term rentals for “nonresidential uses, including for a special event that would otherwise require a permit or license pursuant to a city or town ordinance or a state law or rule or for a retail, restaurant, banquet space or other similar use.” This law applies to the entire state of AZ.
- *13(b). NONCOMPLIANCE. IF EVIDENCE OF AN EVENT OR PARTY IS FOUND YOU COULD FACE A FEE OF $500 TO $1,000 FOR NONCOMPLIANCE OF THE RULES.
- *13(c). ORDINANCE G-54444. The purpose of the new law is to cut down on so-called “party houses.”PV Ordinance Section 10-13-2 (an “Unruly Gathering” is defined as: a gathering of five (5) or more persons on any private property, including property used to conduct business, in a manner which causes a disturbance of the quiet enjoyment of private or public property by any person or persons and also includes one of the following: excessive noise, impeding traffic, obstruction of public streets by crowds or vehicles, use or possession of illegal drugs, drinking in public areas, the service of alcohol to minors or consumption of alcohol by minors, fighting, disturbing the peace, and/or littering.
- 14. THIRD-PARTY BENEFICIARY. Owner shall be considered a third-party beneficiary to this Agreement entitled to all rights and benefits hereof as if it were a direct party to this Agreement and may enforce the provisions hereof as if Owner was a party hereto.
- 15. GENERAL. This Agreement is the entire Agreement among the parties and it may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision of this Agreement. This Agreement, and all disputes arising from it, will be governed and bound by the laws of the State of Arizona.
- 18. ATTORNEYS’ FEES. Guest and Bella agree that Bella shall be entitled to recover any attorneys’ fees and costs that we incurs as a result of (a) Bella having to enforce the Guest Rental Agreement, (b) Guest’s breaches of the Guest Rental Agreement, or (c) damages, injuries, or harm resulting from the actions of Guest, members of the rental party, or anyone else Guest permits on the Property.
- 19. DISPUTE RESOLUTION. Guest and Bella agree that any legal dispute arising from the Guest Rental Agreement and / or any actions, conduct, injuries, or damages occurring at the Property or sustained during the term of the Guest Rental Agreement shall be heard and resolved in the State of Tennessee.
- EXHIBIT A: HOUSE RULES
- 1. SMOKING. No smoking is permitted in the home or anywhere on the Property.
- 2. NO STRUCTURES. No tents, RVs or other structures may be erected on the Property.
- 3. NO PARTIES. No parties, gatherings, or special events at the Property without Bella’s written consent.
- 4. GARBAGE REMOVAL. Guests must dispose of all trash and recycling in the appropriate bins, and are expressly prohibited from leaving trash exposed or unsecured. Some properties have trash in the alley behind the house. If Guest is unsure how to dispose of trash, Guest is responsible for asking Bella for additional instructions.
- 5. QUIET HOURS. All Guests are asked to observe quiet hours between 10:00 p.m. and 7:00 a.m. City regulations prohibit outdoor amplified sound after 10:00 p.m. and Guests are liable for any citation issued in violation of the quiet hours. Thanks for being a good neighbor to the residents that may live nearby!
- 6. PETS. Pets are not permitted unless specifically noted in the reservation. If pets are permitted, Guest must pay a $300 per pet fee. Kindly notify us of the dog breed so we can adjust the pet fee accordingly or as needed.
- *6(a). BREED RESTRICTIONS. German Shepherd, Pit Bull/Terrier, Cane Corsos, Rottweiler, Staffordshire Terrier, Akita, Mastiff, Great Dane, Doberman, and Cats are not permitted.
- 7. WHAT WE SUPPLY. Unless otherwise noted in the reservation, the Property is fully equipped and furnished Property including linens, towels, kitchen utensils, etc. We will supply a starter supply of paper products and detergents. Guest should plan to bring or buy additional supplies once the starter supplies are consumed.
- 8. PHONES / INTERNET / TELEVISIONS. Most homes are equipped with a telephone to be used for local calls only. High speed internet is not always reliable in the area. Neither Owner nor Bella are responsible for gaps in coverage. Any purchases made through homeowner televisions or other devices (i.e. pay-per-view movies) are the responsibility of the Guest. By signing this Agreement, you authorize us to charge your credit card on file for any such amounts, or charged through the third party booking site.
- 9. HOUSEKEEPING. While linens and bath towels are included in the Property, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the Property for outdoor use.
- 10. HOT TUB. Hot tub use must not precede 8:00am or exceed 10:00pm. No children under the age of 16 are permitted in hot tubs at any time. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later that evening. DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers
- are for insulation purposes and are not designed to support a person or persons. The covers do break and you may be charged for replacement. Remember when not using the hot tub, leave cover on so hot tub will stay warm. Guest assumes all risks involved in and related to the use of the hot tub.
- 11. SWIMMING POOLS. If the Property has a swimming pool, Guest should observe all rules and policies posted at the Property. Guest assumes all risks involved in and related to the use of the swimming pool. Please do not use house linens for the swimming pool. If Guest wishes for the pool to be heated, Guest must pay a fee and request heating through the Lynx site provided by Bella or by messaging Bella.
- 12. FIREPLACE. If the Property has a fire non-vented propane gas log fired firebox, please do not throw any paper or other combustible materials in the fireplace. Fireplaces may not be operational during certain months of the year due to fire hazard.
- 13. BUNK BEDS. Some properties have bunk beds. Guests are fully responsible for any risks to themselves and other guests when sleeping in the bunk beds.
- 14. WATER AND SEPTIC. Certain properties may use a well and septic systems and others use the public sewer system. Regardless of the type of disposal system, it will clog up if improper material is flushed. DO NOT FLUSH anything in the toilets other than toilet paper. If it is found that something other than toilet paper has been flushed and clogged the plumbing system, you will be responsible for the damages and cost of repair.
- 15. MISCELLANEOUS. The House Rules incorporate by reference any other rules that are listed on the reservation, guest guide or otherwise conveyed by us to the Guest.
