Payment and Cancellation - 30 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation request, and (2) reservation request was made 11 days before arrival.
Payment Policy:
- 30 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 30 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 30 days prior to arrival.
- For guests paying with points: 100% of payment will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 30 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 30 days before arrival: 100% refund.
House Rules
- SHORT-TERM VACATION RENTAL ACCOMMODATION AGREEMENT
- This Short-Term Vacation Rental Accommodation Agreement (the "Agreement") is made by and between Keys to Kelowna Properties Inc. (the “Host") and (the "Guest") as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
- Ownership. The Rental Unit is privately owned by an independent third-party (the "Owner") for which the Host is acting as a liaison. The financial transaction will be made directly with the Owner of this property.
- Visitors. Only members of the Rental Party are permitted to stay overnight in the Rental Unit. Anyone else the Guest allows in the Rental Unit (a "Visitor") is the sole responsibility of the Guest and is strictly forbidden unless pre-approved by the Host in writing.
- Maximum Occupancy. The maximum number of guests is limited to two persons. An additional charge per person per night may be required if additional guests are approved by the Host.
- Fixed Term Agreement. This is a fixed-term agreement that begins at 4 pm PST and ends at 11 am PST (collectively, the "Rental Period”).
- Late Checkout Fee. Unless permission is specifically granted by the Host, Guests who fail to checkout before 11 a.m. will be charged at 2 times the nightly rate for each day beyond the Checkout Time.
- Rental Rules. The Guest agrees to abide by the Rental Rules attached as Addendum A at all times while at the property and shall ensure all members of the rental party and anyone else the Guest permits on the property to abide by the rules at all times while at the property.
- Parking. The Rental Property comes with one designated parking stall(s). The stall(s) associated with the property are 140 on L4 . The Guest agrees to only park in the designated parking stall(s). The Guest is only permitted to park a car, SUV, crossover, passenger truck or motorcycle and it must fit completely into the parking stall. No guest parking is available for short term rental guests. Additional vehicles must use street parking where permitted.
- Form K. Where the Rental Unit is a strata lot, the guest agrees to complete and sign Form K Notice of Guest's Responsibilities, prior to arrival and will at all times during the Rental Period comply with the provisions of the Strata Property Act as it affects the guest of the strata lot. The guest agrees to abide by the provisions of the bylaws and the rules and regulations of the Strata Corporation as adopted.
- Term Extension. Should the Guest wish to extend their stay, the rates will be set according to the published rates advertised on the Host’s website or booking platforms such as Airbnb. The current rates and fees for the Vacation Rental Fixed Term Agreement stated herein do not apply to any future extensions. The Guest agrees that the Host can terminate the Fixed Term Agreement at the end of the term without cause or written notice.
- Over Holding. If the Guest remains in possession of the rental unit after 11 a.m. on the last day of the term as set out in this Agreement, or after any other lawful end of the Agreement, the Host may claim for damages against the Guest and the Guest will be liable for damages suffered by the Host. The Host may use any means necessary to execute an eviction. In addition, the Host and the incoming Guest have a civil right of action against the Guest as a result of the Guest's failure to leave the rental unit as required by law.
- Cancellation Policy. Unless otherwise specified during booking, if the Guest wishes to cancel their reservation, payment will be refunded as follows:
- a. 50% if cancelled 60 days prior to the Check-in Date
- b. 0% if cancelled within 60 days of the Check-in Date
- Housekeeping and Supplies. While linens and consumables are included in the unit, daily housekeeping service and the restocking of supplies is not included in the rental rate. The Guest will be provided with a fixed amount of products to use during the Rental Period and any extra supplies needed is the Guest’s expense. In suite laundry is provided and expected to be used regularly for self-serviced linen maintenance during the length of stay.
- Use And Maintenance Of The Rental Unit. The Guest agrees to use the Rental Unit only for private residential purposes only and not for any illegal, unlawful, commercial, political, or business purposes. No business, including crypto mining may be conducted from the Rental Unit. No public meetings or assemblies may be held in the Rental Unit. No business or commercial advertising may be placed on or at the Rental Unit. The Guest further covenants and agrees to maintain the Rental Unit in a clean, orderly, safe, and sanitary condition, free of trash, junk, pet excrement, refuse, nuisances, or conditions that threaten or tend to threaten the health or safety of anyone, and in a manner or condition which is aesthetically pleasing. The Guest shall not permit any use of the Rental Unit which is inconsistent with or contrary to this Agreement, or which is contrary to applicable laws, rules, and/or regulations ("Applicable Laws"). The Guest agrees to leave the unit in the same condition as when taken. The Guest will not make or cause any structural alteration to be made to the Rental Unit. Painting, papering, or decorating of the rental unit or residential property can not be done. This includes but is not limited to: hooks, nails, tapes, or other devices for hanging pictures or signage, or for affixing anything to the Rental Unit. The Homeowner or the Host will not pay for cleaning or any work of this kind contracted by the Guest, unless expressly authorized in writing. The Guest must ensure that the rental unit is appropriately ventilated, exhaust fans are regularly used, and must follow reasonable housekeeping practices, to minimize the presence or accumulation of moisture, thus preventing the occurrence of mould or mildew.
- Damage. The Guest shall report any damage or issues with the Rental Unit to the Host upon arrival or at time of occurrence. The Guest shall be responsible for any damage to or loss from the Rental Unit which occurs during the Rental Period, howsoever caused.
- Insurance. The Guest expressly recognizes that any insurance for property damage or loss which may be maintained on the Rental Unit does not cover the personal property of the Guest, and that the Guest is responsible for purchasing their own insurance for if such coverage is desired. We encourage all renters to purchase traveler insurance. Here are some references you may contact to purchase such insurance: World Nomads, and TuGO 19. Access. The Guest shall allow the Homeowner or the Host access to the property for purposes of repair and safety inspection. The Homeowner or the Host shall exercise this right of access in a reasonable manner, at minimum once every four weeks.
- Use of Common Areas and Amenities. Unless permission is specifically granted by The Host, use of the Rental Unit DOES NOT include the use of any fitness or recreational facilities, swimming pools, or other common areas associated with the Rental Unit whether indoors or outdoors (the "Common Areas"). Any and all references to the Rental Unit throughout this Agreement does not include the Common Areas unless otherwise specified by The Host. Should these strata amenities fail to operate the Guest will expect no reimbursement.
- Pets. Unless specifically permitted in writing in advance by the Host, the Guest must not keep or allow on the residential property any animal, including a dog, cat, reptile, or exotic animal, domestic or wild, fur bearing or otherwise. Where the Host has given permission in advance in writing, the Guest must ensure that the pet does not disturb any person in the residential property or neighbouring property, and further the Guest must ensure that no damage occurs to the Rental Unit or residential property as a result of having or keeping the pet. This is a material term of this Agreement. If any damage occurs caused by the pet, the Guest will be held solely liable for such damage and will compensate the Host the Homeowner for damages, expenses, legal fees and/or any reasonable costs incurred by the Host and the Homeowner. Further, if the Host has the right to terminate the Agreement and end the Rental Period immediately along with making the appropriate claims against the Guest. Having regard to the potential safety issues, noise factors, health requirements, and mess, the Guest will not encourage or feed wild birds or animals at or near the residential property.
- Indemnification and Assumption of Risk. The Guest expressly assumes the risk of harm to themselves, their property, the Rental Party, and any Visitors arising from their use of the Rental Unit and the Common Areas. Guest shall indemnify and hold harmless The Host, the Owner, and any of The Hosts’s affiliates, employees, agents, representatives, sub-contractors, successors, or assigns from and against any liabilities or any loss or damage whatsoever arising from, related to, or in connection with the Guest’s use of the Rental Unit and/or Common Spaces, including, but not limited to, any claim for liability for personal injury or damage or loss of property which is made, incurred or sustained by the Guest, Rental Party, or any Visitors to the Rental Unit during the Rental Period.
- Governing Law. This Agreement shall be governed by and interpreted in accordance with local laws in British Columbia, Canada.
- Arbitration. All disputes arising out of, or in connection with, this Agreement, or in respect of any legal relationship associated with it or derived from it, will be finally resolved by arbitration administered by the British Columbia. The seat of arbitration will be Kelowna, British Columbia, Canada.
- Special Requests or Notes.
- Electronic Signature. This Agreement creates binding legal obligations. The Guest acknowledges having read the terms hereof. By the Guest’s signature below, the Guest agrees that all rental monies are non-refundable per the cancellation policy above and understands their rights to purchase independent travel insurance. By making this reservation the Guest acknowledges that they are responsible for all guests and or visitors and the Guest agrees to all additional terms and costs associated with this reservation.
