In accordance with the Town of Kiawah Island Short Term Rental Ordinance, all guests understand that the approved number of bedrooms is 5, the maximum allowed occupancy is 12, and the maximum allowed number of vehicles is 5.
This Kiawah Island vacation rental offers five bedrooms, a private pool and spa, and breathtaking lagoon views. The home is about a 10-minute walk or a 5-minute bike ride to the beach.
This home offers an open floor plan with multiple gathering areas. The light-filled family room has comfortable seating, a TV, and access to the pool deck. A second living area and den are also on this floor. The spacious kitchen has abundant counter space, Thermador appliances, bar stool seating, and an eat-in area. Payment & Cancellation - 60 Day Policy
Grace Period:
- Guests may cancel for free provided that: (1) reservation is canceled within 48-hours of reservation confirmation, and (2) reservation was confirmed at least 11 days before scheduled arrival.
Payment Policy:
- 60 days or less prior to arrival: Guests pay 100% at time of reservation.
- More than 60 days before arrival: Guests pay 50% at time of reservation, the remaining 50% will be charged 60 days prior to arrival.
- For guests paying with Points or Cash & Points: 100% of payment of both Cash & Points will be deducted at time of reservation, once booking is verified within 48 hours.
Cancellation Policy:
- 60 days or less prior to arrival: No refund issued, unless ‘Grace Period’ applies.
- More than 60 days before arrival: 100% refund.
House rules
- GUEST LICENSE (RENTAL) AGREEMENT – Kiawah Island
- This Agreement shall be interpreted and enforced according to the laws of the State of South Carolina. The invalidity or unenforceability of any one or more provisions of this Agreement shall in no way effect any other provisions. This Agreement may not be transferred or assigned. GUEST may not let, sublet, or assign this Agreement for all or any part of the premises.
- OWNERSHIP
- The property is privately owned, with Property Manager Rentals acting solely as the AGENT for the OWNER. The GUEST acknowledges he is a licensee of the OWNER and not a tenant, and is not acquiring any interest in the property.
- PAYMENT
- We accept credit cards for payment.
- An initial payment of 35% of rents subtotal plus related taxes, 100% of service fee plus related taxes, and 100% of travel insurance (if elected) is due at the time of booking. The remaining balance is due 45 days prior to the arrival date of {{formatDate reservation.checkin ""medium""}}. If your arrival date is less than 45 days away, the total payment is due upon completion of this Agreement.*
- *If reservation was made through a third-party booking site, such as Vrbo, the total payment is due 60 days prior to the arrival date of {{formatDate reservation.checkin ""medium""}}.
- GUEST authorizes AGENT to charge the credit card for the initial and final payment amounts on the dates specified in the payment schedule. GUEST will receive receipts of payment which will act as record of transaction.
- DEPOSITS
- Rental deposits are governed by the South Carolina Real Estate Commission and deposited into an Escrow Trust Account by Property Manager Rentals. Disbursements are made according to policies of the South Carolina Real Estate Commission. GUEST understands that any interest earned on your payment(s) shall belong to Property Manager Rentals.
- CANCELLATION POLICY
- a) All GUEST cancellations must be in writing via email to rentals@akersellis.com or mail to 3730 Bohicket Road, Suite 5, Johns Island, SC 29455. To protect all parties, the AGENT has a strictly enforced policy for cancellations. Cancellations received more than 45 days prior to the arrival date of {{formatDate reservation.checkin ""medium""}} are subject to a full refund, less the service fee plus related tax. Cancellations made within 45 days of arrival will result in the forfeiture of all payments made, unless travel insurance is purchased and the need to cancel is covered under the policy. Should the AGENT re-book the exact dates at the exact rate paid by the cancelled GUEST, a refund of payments made, less the service fee plus related tax, could take place. There will be no transfer of monies paid to be used on another date if a reservation is cancelled within 45 days of arrival.*
- *If reservation was made through a third-party booking site, such as Vrbo, cancellations terms are outlined with the listing on the booking site, and cancellations must be requested via the booking site more than 60 days prior to the arrival date of {{formatDate reservation.checkin ""medium""}}.
- b) The AGENT may cancel a reservation if, in its sole opinion, it is in the best interest of the OWNER. The AGENT will notify the GUEST should this happen and work with the GUEST to provide alternate accommodations or will provide a full refund.
- c) The AGENT is not responsible for the weather or other Acts of God and there will be no refunds for such events. The only way to ensure a refund for such is to purchase travel insurance.
- d) Should the accommodation become unavailable due to reasons beyond the AGENT or OWNER’S control, the AGENT will notify the GUEST immediately and will attempt to provide alternative accommodations or will provide a full refund.
- TRIP CANCELLATION AND TRAVEL INSURANCE
- Trip Cancellation and Travel Insurance covers you and your vacation investment when many unexpected and unforeseen circumstances occur. In addition to protecting your vacation investment against unforeseen circumstances, such as natural disasters, hurricanes, or an illness or injury to someone in the traveling party, travel insurance has other advantages, including 24/7 emergency services hotline and medical coverage while you are at your destination.
- We are proud to offer our guests one of the best vacation rental travel protection policies in the industry, Play Travel Protection Cancel For Any Reason (underwritten by Nationwide). This optional insurance policy must be purchased within 14 days of making your reservation; however, no policy is available to purchase within 30 days of your arrival date. The policy may be cancelled within 10 days of purchase.
- Play Travel Protection Cancel For Any Reason covers up to 100% of your trip cancellation or interruption reason if the reason is covered by the policy. If you have to cancel for a reason not covered by the policy, you are still eligible for up to a 60% benefit (the cancel for any reason benefit must be exercised at least 48 hours before arrival date).
- The cost for this insurance is 10.8% of your reservation total.
- We recommend you purchase travel insurance at the time of booking. For more information and coverage details on Play Travel Protection CFAR, please visit https://myakersellis.rentalguardian.com and/or call 833.610.0736.
- RATES AND AVAILABILITY
- Errors in pricing, availability, and/or descriptions rarely occur but are possible due to the use of various technology systems, and the GUEST will be notified in any event of error. If, in the opinion of the AGENT, the error substantially changes the terms of this Agreement, the AGENT or GUEST may cancel the reservation within 24 hours of such notification and the GUEST will receive a full refund.
- Changes in tax rates are uncommon yet possible and are beyond control of the AGENT. Should local tax entities make any changes in tax rates, the AGENT will notify the GUEST of the tax increase and the additional amount will be the responsibility of the GUEST to submit with final payment.
- TAXES
- Tax rates are calculated and added to the reservation according to the state sales tax and state and local accommodation taxes. Changes in taxes or fees implemented after booking will affect the total reservation price.
- CHECK-IN/CHECK-OUT
- The GUEST acknowledges and agrees that check-in is no earlier than 4:00 PM on the arrival date and check-out is no later than 10:00 AM on the departure date. Should the GUEST choose to depart earlier than the departure date, no refunds will be provided. Furthermore, should the GUEST choose to depart early, GUEST is asked to notify the AGENT of early departure so AGENT may reschedule departure inspection and housekeeping. Should the AGENT find damage resulting from an early departure, including but not limited to: doors and/or windows left open or unlocked, appliances not properly turned off, perishable items not secured, then the GUEST agrees that related damage could result in penalties equivalent to the expense of replacement and/or repair. If the reason for early departure is weather related and the GUEST has purchased travel insurance, the GUEST may utilize that policy. The GUEST agrees that lack of adherence to the standard check-in and check-out times, unless specifically discussed with the AGENT, could result in penalties equivalent to the losses to the AGENT, OWNER, or future guest.
- OCCUPANCY
- GUEST agrees to indemnify and hold AGENT and OWNER harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the premises by the GUEST(S) and/or their guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the premises. The GUEST agrees that the primary person placing the reservation and occupying the property during the term of this Agreement is at least 25 years old. The GUEST agrees to limit occupancy to the stated maximum number for the property at all times. Occupancy and use of the premises and communal areas shall not disturb or offend other guests or residents. The AGENT has the right to terminate this Agreement and evict disruptive GUEST without a refund. GUEST understands that making material alterations, including, but not limited to, moving furniture or wall hangings, painting, or changing locks, is not permitted. GUEST agrees that during the term of this Guest License Agreement, he/she will keep the premises clean and free of trash. All pipes, wires, plumbing and other equipment and fixtures must be kept in the same condition as at the beginning of the term of the Guest License Agreement.
- GROUPS
- The GUEST agrees to limit occupancy to the stated maximum number for the property at all times. The AGENT and OWNER do NOT allow any type of parties or group events including, but not limited to, weddings, receptions, or meetings under any circumstances. Occupancy and the use of the property must be in compliance with town and property owners’ association covenants and restrictions at all times. Should AGENT discover the property is being used in violation of this term, AGENT will evict GUEST and all monies will be forfeited.
- DAMAGES
- ALL damages to the property MUST be reported promptly to the AGENT, who will determine the extent of repairs necessary. The GUEST agrees to indemnify the OWNER for any damages caused by their carelessness and negligence including, but not limited to damaged property, missing accessories, and missing or damaged linens. The AGENT has full authority from the OWNER to collect for damages at the AGENT'S discretion. A non-refundable property protection fee, which protects against minor damages and/or repairs resulting from unintentional accidental damages, is included in the total charge. Should the AGENT find excessive and/or intentional damage in a property, the credit card on file will be charged for related repairs and a receipt will be sent to the GUEST.
- KEYS
- GUEST agrees to maintain a key in the lock box during the term of this Agreement for emergency or maintenance purposes. GUEST will ensure the rental property has the same number of keys and garage door openers (if applicable) upon departure as it did upon arrival. The GUEST agrees that lost keys, lost garage door openers, or damaged locks could result in penalties equivalent to the expense of replacement, repair, or re-keying the rental property.
- EMERGENCIES
- The GUEST agrees that the AGENT and/or contractors may enter the premises when the AGENT deems it necessary to protect the safety and security of the GUEST and/or to protect the well being of the property. Please leave a key in the outside lock box for this reason.
- MAINTENANCE
- The GUEST agrees to notify the AGENT as soon as a maintenance problem occurs. Issues will be repaired or replaced as quickly as possible, based on the nature and severity of the issue. No refunds or compensation will be given. GUEST agrees that the OWNER and/or their AGENTS may enter the premises for the purposes of effecting necessary repairs and/or maintenance or for any other necessary purposes, including inspection. Please leave a key in the outside lock box for this reason.
- TELEPHONE CALLS
- Local calling is available for GUESTS in most properties; however, it is not a standard for all rental properties to have a land line in operation.
- INTERNET
- High-speed wireless internet is available for GUESTS in most properties; however, it is not a standard for all rental properties to have internet. Internet access is provided as a convenience only and is not integral to the Agreement nor is it guaranteed. No refund of rentals shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service. Internet service is provided by an outside agency and/or contractor, therefore the time and speed of repairs done, if needed, is out of the AGENT’S control.
- PETS/ANIMALS
- NO PETS OR ANIMALS are allowed unless the property is marketed as pet friendly in the listing description.
- Exceptions to this term may be made with approval by AGENT and will be subject to an additional fee of $50 per pet per day, with a maximum of two (2) pets.
- Should AGENT discover a pet in violation of this term, AGENT will evict GUEST and all monies will be forfeited OR in AGENT coordination with OWNER, GUEST will be allowed to remain in property with a $100 per pet per day fee assessed for the entire stay.
- GUEST will be responsible for any necessary costs to resolve damages or other issues resulting from pets.
- SMOKING & OPEN FLAMES
- Smoking and open flames are NOT permitted inside the property at any time. Should AGENT discover a violation of this term, AGENT will evict GUEST and all monies will be forfeited. Should damages from smoking be discovered after departure, GUEST will be responsible for any necessary costs to resolve those issues. GUEST understands that their rental property may be in close proximity to other rental guests or residents and that smoking in exterior or communal areas will be done with respect and consideration for non-smokers. All trash and debris will be cleaned up by GUEST.
- RESORT POOLS
- GUEST understands that they do not have access to pools owned and operated by Kiawah Island Golf Resort, and there is no method to purchase access to Resort pools. Resort pools include those located at Night Heron Park, the Sanctuary Hotel, Tennis Club, and West Beach.
- FIREPLACES
- Fireplaces in rental properties are not intended for GUEST use due to safety and liability reasons.
- ELEVATORS
- Unless specifically approved in a subsequent addendum, elevators in private residences are locked and not in operation for GUEST use due to safety and liability reasons.
- EXTERIOR SECURITY CAMERAS
- GUEST understands OWNER reserves the right to install and utilize exterior security cameras at the property. Camera locations may include, but may not be limited to, the doorbell, front entrance/deck/porch/patio area, rear entrance/deck/porch/patio area, and driveway/garage area. These cameras serve to protect both the OWNER and GUEST. AGENT does not have access to camera surveillance and cannot disable cameras. Should the AGENT find intentional damage to a camera, GUEST will be responsible for any necessary costs for related repairs.
- LOST ITEMS
- The AGENT is not responsible for any personal belongings of the GUEST that may become lost, stolen, damaged, or left behind. When notified, AGENT will make reasonable attempts to secure items communicated by GUEST and return to GUEST at the expense of the GUEST. Items found by AGENT that are left unclaimed for over 30 days will be donated to a local charity.
- MANDATORY EVACUATION
- Should state or local authorities order a mandatory evacuation of the area, GUEST agrees to comply with the evacuation order and will do so in a safe and expeditious manner. GUEST is encouraged to purchase travel insurance to safeguard against such disturbances or interruptions to their stay. The only way to ensure a refund for such is to purchase travel insurance.
- QUIET ENJOYMENT
- GUEST understands that all properties are individually owned and operated. AGENT cannot control actions of other rental guests or residents, including, but not limited to, noise, pets, smoking, occupancy restrictions, renovations or major maintenance projects. No refund will be provided for issues arising beyond AGENT’S control. AGENT will make every effort available to provide GUEST with quiet enjoyment of rental property during the term of this Agreement. Likewise, GUEST understands their actions and use of the rental property must be in accordance with all state and town laws and with respect to offering other guests and residents the same quiet enjoyment.
- TOWN OF KIAWAH ISLAND RULES AND REGULATIONS
- Please review the following Town of Kiawah Island rules and regulations. Failure to comply may result in fines up to $1000 per citation from the Town of Kiawah Island and will be the responsibility of GUEST.
- PARKING
- Leave a 25 foot clearance to the residence for emergency response vehicles.
- Parking on the grass or landscaped areas is prohibited. Overnight parking must be off-street.
- Only park approved number of vehicles at rental properties.
- STORAGE
- No clothing or towels are permitted to be draped over deck railing.
- Bicycles and beach gear must be stored in a garage or enclosure from dusk until dawn.
- NOISE
- Noise ordinance is in effect daily from 8:00 PM to 8:00 AM.
- WILDLIFE
- Never feed, harass, or approach alligators and other wildlife such as dolphins, or sea turtles or shorebirds, hatchlings, or their nests.
- Never swim or allow pets to swim in the island ponds and stay away from pond edges. Alligators may be present.
- BEACH
- No glass, metal shovels, plastic carry out bags, plastic straws, Styrofoam, balloons, or drones allowed.
- Stay off the dunes and use public walkovers.
- No wading/swimming in Captain Sam's Inlet (western end of the island).
- No overnight storage of beach equipment.
- Vehicles are not allowed on the beach.
- OCCUPANCY
- Maximum occupancy for rental properties is two occupants per bedroom. Two additional occupants are allowed per dwelling unit.
- FIRE & FIREWORKS
- No open fires or fireworks (beach included).
- LIGHTING
- May 15-October 31
- Outdoor lighting, facing seaward in beach front units must be turned off from 9 p.m. to 8 a.m.
- Outdoor lighting for all other dwellings shall be turned off from 11 p.m. to 7 a.m. daily.
- PETS
- Never allow pets to swim in any of the island ponds and keep them away from pond edges. Alligators may be present.
- Pets must be leashed at all times outside unless they are in an enclosed area.
- Pets are allowed on the beach year-round. For more on year-round leash area and seasonal leash restrictions, visit

- OTHER VEHICLES
- The operation, use, and storage of full-size vans (such as Sprinter, Transit, etc), RVs, campers, boats, trailers, jet skis, motorcycles, motorized bicycles, segways, and similar are not permitted. When in doubt, seek clarification from the Town of Kiawah Island at 843-768-5566.
- POTENTIAL ADDENDUMS TO THE GUEST LICENSE (RENTAL) AGREEMENT
- The following addendums may apply to the property and will be noted in the listing description. When applicable, GUEST understands and agrees to the additional terms and conditions.
- BEACH GEAR CREDIT
- GUEST understands that the property offers a credit to use for beach gear provided by VayKLife, a third-party beach gear delivery service provider. Beach gear may include, but is not limited to, bicycles, beach chairs and umbrellas, beach carts, kayaks, stand-up paddleboards; however, beach gear selection varies per property type and/or community. The credit is applicable to reservations of 3 to 21 nights and represents no cash value if not utilized. GUEST understands that beach gear selections are made directly with VayKLife and failure of GUEST to make selections in a timely manner may impact availability and/or delay delivery of beach gear. GUEST further understands that VayKLife is not owned or managed by AGENT, and GUEST must resolve any beach gear issues directly with VayKLife. GUEST agrees to use beach gear at his/her own risk and to hold harmless both the OWNER and AGENT from any liability.
- GRILLS PROHIBITED
- The use of grills on villa decks or balconies is prohibited. Any violation is subject to fines imposed by the town and will be the responsibility of GUEST.
- COMMUNITY POOL
- By renting the property, GUEST has access to its seasonal community pool. The pool is serviced by the property owners’ association and is not controlled by the AGENT. The pool is open seasonally and the AGENT does not control that schedule.
- PRIVATE POOL
- By renting the property, GUEST has access to its private pool. Unless specifically stated in the listing description, the pool cannot be heated. GUEST, including all invitees of GUEST, understands and agrees to swim at his/her own risk, diving is not permitted, and life jackets are not provided. GUEST hereby accepts all risk of personal injury or death from use of the pool and agrees to defend, indemnify, and hold harmless the AGENT and the OWNER from any such injury or death. The pool is cleaned and serviced on a regular basis by an outside vendor, and therefore, the AGENT is not directly involved in the maintenance and upkeep of such. Any additional cleaning charges incurred by request of the GUEST will be the responsibility of the GUEST.
- PRIVATE HEATED POOL
- The pool at the property is able to be heated and, if elected by the GUEST, will result in an additional fee per day for the entire stay, as disclosed in the listing description. GUEST understands that by electing pool heating, it can take 24-48 hours for the pool water to reach the optimal temperature of 85-87 degrees. GUEST acknowledges that when air temperature falls below 55 degrees, typically November through March, a pool heater will not be able to continually hold the optimal pool temperature and, in such instances, AGENT may elect to turn off pool heating. GUEST also understands that tampering with pool equipment and changing settings could result in an assessment of the per day fee or the cost of repairs associated with any remedies needed, whichever is greater. GUEST must contact AGENT directly to add pool heating to the reservation.
- PRIVATE HEATED SPA
- The spa at the property is able to be heated and, if elected by the GUEST, will result in an additional fee per day for the entire stay, as disclosed in the listing description. GUEST acknowledges that when air temperature falls below 55 degrees, typically November through March, a spa heater will not be able to continually hold the optimal water temperature and, in such instances, AGENT may elect to turn off spa heating. GUEST also understands that tampering with spa equipment and changing settings could result in an assessment of the per day fee or the cost of repairs associated with any remedies needed, whichever is greater. GUEST must contact AGENT directly to add spa heating to the reservation.
- PRIVATE HOT TUB
- The hot tub at the property is available to the GUEST at no additional fee. GUEST, including all invitees of GUEST, understands and agrees to use the hot tub at his/her own risk. GUEST hereby accepts all risk of personal injury or death from use of the hot tub and agrees to defend, indemnify, and hold harmless the AGENT and the OWNER from any such injury or death. The hot tub is cleaned and serviced on a regular basis by an outside vendor, and therefore, the AGENT is not directly involved in the maintenance and upkeep of such. Any additional cleaning charges incurred by request of the GUEST will be the responsibility of the GUEST. GUEST also understands that tampering with hot tub equipment and changing settings could result in an assessment of the per day fee or the cost of repairs associated with any remedies needed, whichever is greater.
- ELEVATOR IN HOUSE
- Upon request, GUEST is permitted to use the elevator at the property. For safety, the elevator is kept locked for guests who do not require its service. The GUEST agrees to use it at his/her own risk and to hold harmless both the OWNER and AGENT from any liability.
- PETS CONSIDERED
- Pets are considered for stays at the property for an additional fee of $50 per pet per day, with a maximum of two (2) pets. GUEST will be responsible for any necessary costs to resolve damages or other issues resulting from pets. GUEST must contact AGENT directly to add pets to the reservation.
- OCEAN GREEN COMMUNITY POOL GATE FOB
- The community pool at Ocean Green is accessible via gate fob, which is provided within the property. There is one fob per property and GUEST is responsible for safeguarding the fob. Lost or damaged fobs cost $200 to replace and replacement cost will be the responsibility of the GUEST.
- SHIPWATCH BOARDWALK GATE FOB
- The boardwalk gate for Shipwatch Villas is accessible via gate fob, which is provided within the property. There is one fob per property and GUEST is responsible for safeguarding the fob. Lost or damaged fobs cost $200 to replace and replacement cost will be the responsibility of the GUEST.
- BOOKING AGREEMENT AND CONFIRMATION
- By booking a reservation, GUEST has read, understands, and agrees to the terms and conditions as well as any potential addendums that apply to the property. Any alterations to the terms and conditions may result in cancellation of the reservation.
